Member J. S . Ogilvie offered the following resolution.
J '2S , it has been certified to the Board of County Commissioners of geld
County by the Directors of Denver-St. Vrain Irrigation District that the amount necessary
required to feet the maintenance , operating and current expenses of said District for the
fiscal year commencing on the first day of January 1931, as estimated by the Board of
Directors of said District is hereby fixed at 31.55 per acre of land assessed in 1930 for
the purpose of said District , including the 150 which the Board of County Commissioners is
required to add in making a levy for said last mentioned amount.
WHEREAS , the return from the assessor of 'Meld County shows the total
assessment and valuation for the purposes of said District of the real estate included
in said District and assessable for the purposes of said District to be 0100 ,905.00.
BL IT FT`HTE R itiL SOLVED, that 155 mills on the dollar of assessed valuation
for irrigation District purposes of said District is hereby fixed as the rate of levy
necessary to meet the maintenance , operating and current expenses of said District for
the fiscal year commencing on the first day of January 1931, which levy includes the 15j;
which the Board of County Commissioners is required to add in making such a levy.

"WITER. S , it has been certified to the Board of County Commissioners of
the County of `geld, State of Colorado , by the Board of Directors ofTHE DLItiVER-GRE'ELEY
VALLEY IRRIGATION DISTRICT , that the amount require i to meet the maintenance, operating,
and current expenses of said District for the fiscal year commencing on the first day
of January, 1931, is $2.14 for each acre of land assessed in 1930 for the purposes of
said District , according to the valuation placed thereon for District purposes, including
15;0 which the Board of County Commissioners is required to add in making the levy to
cover delinquencies; and

the total assessment and valuation, for the purposes of said District , of the real estate
included in said District for the purposes of said District , to be $311,070.00, and the

Yield County, Colorado, that the rate necessary to raise the amount, regaire to meet
the maintenance, operating, and current expenses of said District for the fiscal year
commencing on the first day of January , 1931, as estimated by the Board of Directors of
said District , is hereby fixed at 32.14 on each acre of land assessed in 1930, for the
purposes of said District, based upon the valuation of T10.00 per acre, and including the
15j'o which the Board of County Commissioners is required to add in making the levy for said
expenses to cover delinquencies , and that a levy of 214 mills on the dollar of assessed
valuation, for the purposes of said District in Weld County , be , and the same is hereby
made for the maintenance, operating, and current expenses of said District , for the
fiscal year commencing on the first day of January, 1931; and

to the Board of County Commissioners of the County of Adams, State of Colorado , to be used

LEVY OF THE GREEN CITY IRRIGATION
DISTRICT.
Member J. S . Ogilvie moved the adoption of the following resolution:
WHEREAS , it has been certified to the Board of County Commissioners of
Weld County by the Board of Directors of the Green City Irrigation District that the amount
required to meet the maintenance , operating, and current expenses of said District for
tie fiscal year commencing on the first day of January, 1931, is 1.11 per acre , including
the 15 percent which the Board of County Commissioners is required to add for delinquencies
in making the lev for said expenses;
NOW, THEREFO'TE, BE IT RESOLVED by the Board of County Oommissioners of the
County of Weld and State of Colorado that the rate necessary to raise the amount required
to meet the maintenance, operating, and current expenses of said District for the fiscal
year commencing on the first day of January, 1931, as estimated and certified by the Boars
of Directors of said District , is g.11 per acre , being 111 mills on the dollar of valuation
of the lands in said district for irrigation district purposes , and that said amount and
rate includes the 150 required to be added by the Board of County Commissioners, and the
said 111 mills on the dollar of valuation for irrigation district purposes is hereby fixed
as the rate of levy necessary: to raise the said maintenance , operating, and current expenses
of the said District for the fiscal year commencing January 1, 1931,

Member J. S . Ogilvie offered the following resolution and moved its adoption.

"WHEREAS , it has been certified to the Board of County Commissioners of
Weld Count, b;, the Directors of the HENRYLYN IRRIGATION DISTRICT , that the sum of 4,625.00 is
required to be levied for the purpose of paying interest on bonds issued in 1928 which
will become due daring the year 1931.
• WHEI-U S , that the amount necessary require7' to meet the maintenance,
operating and current expenses of said District for the fiscal year commencing on the
first say of January 1931, as estimated by the Board of Directors of said District is hereby
fixed at $1.70 per acre of land assessed in 1930 for the purpose of said District , including
the 15 which the Board of County Commissioners is required to add in making a levy for
said last mentioned amount.
WHEREAS , the return from the Assessor of Weld County shows the total
assessment and valuation for the purposes of said District of the real estate included in
• said District exclusive of emprovements and assessable for the purposes of said District
to be 4344,919.b0.
NOW, THEREFORE, BE IT RESOLVED, that 25.1 mills on the dollar of assessed
valuation for Irrigation District purposes of said District is hereby fixed as the rate
of levy necessary for interest which will become due during the year 1931 on bonds issued
in 1928 for Said District.

BE IT FURTHER RESOLVED, that 170 mills on the dollar of assessed valuation
for irrigation district purposes of said district is hereby fixed as the rate of levy
necessary to meet the maintenance , operating and current expenses of said District for the
fiscal year commencing on the first day of January, 1931 which levy includes the 15 which
the Board of County Commissioners is required to add in making such a levy.

Member J. S., Ogilvie moved the adoption of the following resolution:
"WHEREAS , it has been certified to the Board of County Commissioners of
• Weld County , by the Board of County Commissioners of Morgan County, that• it is necessary
to raise the amount of funds for the various purposes required by law, to meet the
expenses and other charges aginst the RIVERSIDE IRRIGATION DISTRICT , for the year 1931,
to make the levy as follows:
For Maintenance a $1.50 Per Acre (15;0 included)
based on the valuation of $10.00 per acre
NOW, THEREFORE, BE IT FURTHER RESOLVED, that levies be and they hereby are
made upon each dollar of valuation on all the real estate assessed in said District for
Irrigation District purposes and situated in Weld County , as Follows:

The following communication was received from the Colorado Tax Commission,
authorizing the Board of County Commissioners of Weld County, Colorado, to fix the
levies for the year 1930 at a rate in excess of that provided by Statute , the said
communication was read and the same being fully understood by the Board, was accepted
as sufficient authority to proceed with the levies for the year, 1930; and it was
further ordered that same be spread upon the minutes of the proceedings of the Board;

APPROPRIATION RESOLUTION
In compliance with an act of law entitled "An act to require thO affairs of the
several Counties of this State to be conducted from the Revenue derived from taxation
and prevent other expenses of any county from exceeding its Revenue" , the Board on motion
unanimously passed and adopted the following, viz:
BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado ,
that there shall be appropriated from the Revenue of said County to defray the necessary
expenses and liabilities of said County for the ne;.t fiscal year the following sums,. to-wit:

BE IT FURTHER RESOLVED, that all the surplus fees turned into the office of the
County Treasurer by the various Officials during the year 1931, now estimated to be,
$75,000.00 be and the same are hereby appropriated by General County Purposes.
BE IT FURTHER RESOLVED, that all sundry collections made on account of
patients and other services rendered by or through either and both of the Hospitals
belonging to the County, for the year 1931, now estimated to be $50,000.00 be, and hereby
are appropriated to the support of the "Poor Fund."
AND BE IT FURTHER azsoLVED , that any funds remaining in the hands of the Treasurer
at the close of business on December 31, 1930, be and hereby are re-appropriated in each
resp,_.ctive fend for the purpose of such funds for the. next fiscal year.

Commissioner Carlson offered the following resolution which was read to-wit:
WHEREAS , The County Commissioner districts of 'geld County do not , in the opinion
of the Board of County Commissioners , conform to a proper division of the County v.ith
respect to population, value of assessable property , revenues returned and amount of
roads in each district , and that the best interests of the County will be subserved by a
redistricting of the County into Commissioner' s districts.
TI-'.EREFOaE, BE IT RESOLVED By the Board of County Commissioners of Weld County
that ' the boundaries of each of the commissioner' s districts be and the same are hereby
altered and established so that each of the districts shall be situated within the
boundary lines respectively as follows , to-wit:

consist of all that territory lying and being within the following described boundary
line , viz: --Commencing; on the West County line at the Northwest corner of Section eighteen,

Weld, PARTIES OF THE FIRST PART , and THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, Party OF THE SECOND PART, WITNESSETH:
WHEREAS , The parties of the first part have this day executed and delivered a
Warranty Deed to the party of the second part to the following described premises, to-wit:
Lots ten and twelve , fourteen and sixteen, eighteen and twenty, Block twenty-two ,
in the Town of Mead, Colorado , and, IN CONSIDERATION THEREFORE, the parties hereto agree
as follows:
Parties of the first part are to retain possession of the above described
premises and to live thereon during their entire lifetime and have the right to enjoy
the proceeds derived from said above described premises during their lifetime.
Party of the second part agrees that should the parties of the first part
ever be unable to care for themselves, party of the second part will provide for them
a place in The Greeley Hospital at Greeley, Colorado, and provide all necessary care
incident to their keep in that institution, and, shall advance sufficient funds to
provide parties of the first part with such necessities as they may require in
addition to their keep in the hospital, and during the time that parties are confined in
the Greeley Hospital, party of the second part shall have the right to collect all proceeds
from the above described premises.
In addition bo the proceeds from the above described premises, party of the
second part agrees to pay parties of the- first part not in excess of but agrees to
pay Thirty-five ($35.00) Dollars per month, said amount to be used by them in purchasing
the necessities of life, including fuel, food and clothing.
Party of the second part agrees to pay the taxes on the above described property
for 1931.

Party of the second party agrees that, upon the death of either one of first
parties, party of the second part will pay burial expenses not in excess of One Hundred
and twenty-five ($125.00) Dollars, for each party, and should any friend or relative of
either party desire to advance money for the purpose of such burial then party of the
second part agrees to add any amount or amounts so advanced to the amount for which
second party is liable. •
Upon the death of either party of the first part, the survivor thereof shall
have the right to oontinure in possession of the above described premises under the terms
of this contract for the remainder of his or her life.
The parties hereto agree that , upon the death of both parties of the first part ,
all rights and liabilities under this agrement , shall cease and party of the second part
shall be entitled to immediate possession of said property herein described and no heir at
law, legatee or devisee of parties of the first part shall ever have any claim thereto.

Lupton, Colorado, for storage of road and bridge material; and
WHEREAS , it is considered that the best interests of said County will be subserved
by the execution of said rider;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD , COLORADO:
That the terms of said rider be and the same are hereby accepted on behalf of said
County , and that the Chairman of said Board of County Commissioners be hereb; authorized,
empowered and directed to execute said rider on behalf of said County and that the County Clerk
be directed to duly attest the same.

WHEREAS , J. R. Patterson, County Treasurer, shows that a tax sale of the year 1929

Side, assessed to Mary Cerventey, that said assessment was made in error because said
improvements were removed from said Block before the year 1928, and owing to said error same
should be redeemed by the County for the two years , 1928 and 1929 .
NOW THEREFORE, be it resolved, that J. R. Patterson, County Treasurer, hereby
ordered and directed to redeem said Certificate 1031) of 1(J29 Sales on account of error in

The Sattley Funeral Home of Greeley, Colorado, being the only bidder it was found
that the bid submitted called for an increase for Pauper Burials over previous years and to
enable the Board to have an opportunity to interview Ray Sattley of said firm relative
to the necessity of an increase, on motion of Commissioner Clark, seconded by Commissioner
Carlson, the awarding of bid was postponed until a later date to enable the Board to
interview Mr. Sattley, relative to the same.

LEASE
THIS AGREEMENT , made and entered into this day of - 19 by
and between UNION PACIFIC RAILROAD COMPANY, a corporation of the State of- Utah (hereinafter
called "Lessor" ) , party of the first part , and COUNTY OF WELD, State of Colorado , ( hereinafter
called "Lessee" ) , party of the second port , WITNESSETH:
Section 1. The Lessor, for and in consideration of the covenants and apyments herein-
after mentioned, to be performed and made by the Lessee , hereby agrees to lease and let
and does hereby lease and let unto the Lessee for a term beginning on the First day of
March 1931, and extending to the First day of March 1936 , unless sooner terminated as
herein provided, the following described portion of the premises of the Lessor at LaSalle ,
Weld County, Colorado, to-wit:
Beginning at a point which is one thousand five hundred fifty-eight and five-tenths
( 1558.5) feet distant northeasterly from the intersection of the south line of Section
Thirty-one ( 31) , TowhEhip Five ( 5) North, Range Sixty-Five ( 65) West of the Sixth ( 6th)
Principal Meridian with the center line of the main track of the Lessor when measured along
said center line and one hundred twenty-five (125) feet distant northwesterly therefrom
when measured along a radial line thereto; thence southeasterly along said radial line a
distance of seventy-five ( 75)feet; thence northeasterly and parallel with said center
line a distance of one hundred twenty-five ( 125) feet; thence northwesterly on a straight
line radial to the last described course at the last described point a distance of seventy
five ( 75) feet ; thence southwesterly and parallel with said center line a distance of
One hundred twenty-five ( 125) feet , more or less to the point of beginning, containing an
area of nine thousand three hundred seventy-five ( 9375) square feet , more or less,
( the premises so leased being shown in yellow on the plat thereto attached, and made a
part hereof) .
Anything herein to the contrary notwithstanding the right is hereby reserved to
the Lessor to place or construct and thereafter maintain at prominent placee on the
leased ptemites, ( including buildings of the Lessor, if any, covered by this lease) signs
advertising TINION PACIFIC SYSTEM lines.
Section 2. The Lessee agrees to pay to the Lessor for the use of said premises ,
rental at the rate of Ten Dollars (410.00) per annum payable annually in advance , and
also t ) pay as further rental , before the same shall become delinquent , all taxes and
assessments levied and assessed during the continuance of this lease upon any buildings or
improvements placed upon the leased premises. Acceptance of said rental in advance by the
Lessor shall not act as a waiver of its right to terminate this lease as hereinafter
provided.
The Lessee convenants that the Leased premises shall not be used for any other purpose
than for storage of road and bridge material , gasoline and oil for use in connection with
road construction and amintenance on the part of the lessee and agrees that if the Lessee
abandons the leased premises, the Lessor may enter upon and take possession of the same,
and that a non-user for the purpose mentioned, continuing for thirty days shall be
sufficient and conclusive evidence of such abandonment.
The Lessee agrees not to let or sublet the leased premises, in whole or in part, or
to assign this lease without the consent in writing of the Lessor and it is agr-:ed that
any transfer or assignment of this lease , whether voluntary or involuntary, without
such consent in writing, shall be absolutely void and shall terminate this lease.
It is hereby especially convenanted and agreed that gambling, lewd and immoral conduct
upon the leased premises , and the use thereof for any unlawful purpose whatsoever, are,
under the terms of this lease , expressly prohibited, and that no loose, rude or immoral
characters shall be harbored or sheltered thereon, or permitted to loiter upon, or
frequent the leased premises , or any part thereof; and in the event any part of the leased
premises are used in any unlawful manner, or in any manner or for any of the purposes
herein prohibited or proscribed, and a fine , judgement , lien, penalty or forfeiture accrues
therefrom to the damage or injury of the Lessor, or to the leased

premises, or any part thereof, then and in that event, the Lessee shall hold harmless the f
Lessor and the leased premises from any and all such liens, fines , damages, penalties,
forteitures or judgments; it being the intent hereof that the Lessee shall, at all times ,
protect the Lessor and the leased premises from all injury, damage or loss by reason of the
occupation of the leased premises by the Lessee , or from any cause whatsoever growing out
of said Lessee' s use thereof.
Section 3. The Lessee hereby covenants and agrees that any and all buildings erected
upon the leased premises whall be painted by the Lessee a color satisfactory to the Lessor, and
shall at all times be kept in good repair; that the roff of each such builidng shall be
of fire-proff material; that when such buildings are without solid foundation the
openings between the ground and the floor thereof shall be covered with fire-proff material;
that the leased premises shall during the continuance of this lease be kept by the Lessee
in a neat and tidy condition and free from all straw, rubbish, or other material which
would tend to increase the risk of fire , or give the station grounds an untidy appearance;
that none of the buildings or other structures erected on said premises shall be used for
displaying circus posters or any signs or advertisements other than such notices ans signs as
may be connected with the business of the Lessee , and that such signs and notices shall
be neatly written or printed and shall be property maintained.
No building, platform or other structure shall be erected or maintained and no material
or obstruction of any kind or character shall be placed, piled, stored, stacked or maintained
closer than eight (8) feet six ( b) inches to the center line of the nearest track of the
Lessor; PROVIDED, however, that in the case of platforms not higher than Butz, (4) feet abote .the
top of the rail a minimum ehearance of seven ( 7) feet three ( 3) inches from the center line
of the nearesttract of Lessor will be permitted; and PROVIDED, further that along and adjacent
to all tracks having a curvature greater than ten ( 10) degrees the clearances hereinbefore provid-
ed shall , with reference to platforms four (4) feet or less in height, be increased horizontally
six ( b ) inches , and with reference to all buildings platforms, structures and other obstructions
greater than four (4) feet in height, shall be increased horizontally one ( 1) foot. All doors,
windows or gates shall be of the sliding type or shall open toward the inside of the building or
enclosure when such building or enclosure is so located that the said doors , windows or gates
when opened would swing closer than eight ( 8) feet six (b) inches to the center of the nearest track
of the Lessor.
It is further agreed that no gunpowder, gasoline , dynamite, or other explosives or inflam-
mable material shall be stored or kept upon the leased premises. Nothing herein contained ,
however, shall prevent the storage of oil or gasoline upon the leased premises when the purpose
for which the same are to be used, as indicated by the second paragraph of Section 2 hereof, con-
templates such storage ; nor the storage of oil or gasoline where same are used by the Lessee
for fuel in the business carried on by the Lessee on the leased premises , and are stored in
quantities reasonable for such purpose ; PROVIDED, however, that in all of said excepted cases,
the Lessee shall strictly comply with all statutory and municipal regulations relating to
the storage of such commodities.
The Lessee shall not locate or permit the location or erection of any poles upon the
property of the Lessor, nor of any beams, pipes , wires , structures or other obstruction over or
under any tracks of the Lessor without the consent of the Lessor.
The Lessee shall be liable for any and all injury or damage to persons or property, of
whatsoever nature or kind, arising out of or contributed to by any breach in viable or in part
of any covenant of this agreement.
Section 4. No railroad company other than the Lessor shall be allowed to use any track
owned or built by the Lessor now or hereafter upon or eYtending to any part of the leased
premises , without the permission in writing of the Lessor.
Section b. It is understood by the parties hereto that the leased premises are in dangerous
proximity to the tracks of the Lessor; and that by reason thereof there will be constant danger of
injury and damage by fire , and the Lessee accepts this lease subject to such danger.
It is therefore agreed, as one of the material considerations for this lease and without
which the same would not be granted by the Lessor, that the Lessee assumes all risk of loss,
damage or destruction of or to buildings or contents on the leased premises, and of or
to other property brought thereon by the Lessee or by any other person with the knowledge
or consent of the Lessee , and of or to property in proximity to the leased premises when connected
with or incidental to the occupation thereof, and any incidental loss or injury to the business
of the Lessee , where such loss, damage , destruction or injury is occasioned by fire caused
by , or resulting from, the operation of the railroad of the Lessor, whether such fire be
the result of defective engines , or of negligence on the part of the Lessor or of negligence of
misconduct on the part of any officer, servant or employe of the Lessor, or otherwise , and the
Lessee hereby agrees to indemnify and hold harmless the Lessor from and against all liability ,
causes of action, claims , or demands which any person may hereafter assert , have, claim
or claim to have , arising out of or by reason of any such loss, damage , destruction or injury ,
including any claim, cause of action or demand which any insurer of such buildings or other
property may at any time assert , or undertake to assert , against the Lessor.

Commissioner Wm. A. Carlson moved the adoption of the following resolution:
RESOLVED: That satisfactory proff has been given to the Board of County
Commissioners by 0. W. McKinley, that at a sale of real estate held by the Treasurer
of Weld County on December 11, 1909 for delinquent taxes of 1908, 0. W. McKinley
became the purehaser of said tax sale of Lots 34 , 35, 36 , 37, Block 5, 1st addition
in the Town of Ault , and the County Treasurer of said County, issued to him a certificate
of purchase therefor, which certificate was numbered 266 of sales of 1909 .
That said certificate of purchase has since been lost , and this affiant after
diligent search has been and still is unable to find the same , and that 0. W. McKinley
having filed his bond in double the amount of redemption money due by the face of said
tax sale certificate undertaking to indemnify the County of Weld and its officials for
redemption from said tax sales without surrender of the original certificate of purchase ;
BE IT FURTEJ2 RESOLVED, That the County Treasurer be and he is hereby directed
to redeem said tax certificate for fees only.

WHEREAS , Homer F. Bedford, County Assessor, shows that there was erroneously
assessed to the Farmers Loan Company of Denver, a one-half interest in oil , gas and other
minerals on the S. E. & of Section 3, Township 4 , Range bb, that said assessment was made
in error and Certificate Number 1147 is now in the name of Weld County.
NOW THEREFORE, be it resolved, that J. R. Patterson, County Treasurer, hereby
ordered and directed to redeem said Certificate number 1147 on account of erroneous
assessment and tax s _le for the years 1928 and 1929 , redeem for fees only.

CERTIFIED COPY OF RESOLUTION OF THE BOARD OF DIRECTORS OF THE; DENVER-ST,. VRAIN MUNICIPAL
IRRIGATION DISTRICT
WHEREAS , the board of directors of The Denver-St. Vrain Municipal Irrigation District,
under date of October 7th, 1930, did certify to the board of county commissioners of Weld
County , Colorado , that the amount of money necessary to be levied to meet the maintenance,
operating and current expenses of said district for the fiscal year commencing on the
first day of January , 1931, is 411.35 against each acre of land assessed in 1930, for the
purposes of said district according to the assessed valuation placed thereon by the assessed
valuation placed thereon by the assessor for irrigation district purposes , including such
amount as the board of county commissioners is required to add in making the levy for
said expenses to cover delinquencies; and

WHEREAS , the board of county commissioners of Weld County misconstrued said
resolution and instead of making a levy of $1.35 against the lands in said district
for said maintenance purposes, did add 15jo thereto and did make a levy of $1.35 per
acre for said purposes;
NOW, THEREFORE, BE IT RESOLVED by the board of directors of The Denver-St. Vrain
Municipal Irrigation District that in order to correct the erroneous levy made by the
board of county commissioners of 'geld County for maintenance purposes against the lands
in said district , payable in the year 1931, the said board of county Commissioners of
veld County, Colorado , be , and it is hereby requested and directed to adopt such resolution
as may be necessary to abate the levy heretofore made for maintenance purposes payable
in 1931 , to the extent of 204 per acre , and so that the maintenance assessment payable
in the year 1931 against the lands in said district shall be the sum of $1.35 per acre ; and
BE IT YURTFER RESOLVED that the assessor and treasurer of Weld County , Colorado,
be , and they are hereby authorized and directed to change their books and records so
as to make same show that the total assessment payable for maintenance purposes against
the lands in said district in the year 1931 is $1.35 per acre; and
BE IT FURTHER RESOLVED that the treasurer of Weld County be , and. he is hereby
authorized and directed to accept the sum of $1.35 per acre as the total assessment
payable in the year 1931 for maintenance purposes against the lands in said district.

RESOLUTION
RELATING TO LEVY FOR MAINTENANCE PURPOSES IN THE DENVER-ST. VRAin MUNICIPAL IRRIGATION
DISTRICT.
WHEREAS , The Board of Directors of The Denver-St. Vrain Municipal Irrigation
District under date of October 7 , 1930, did certify to the Board of County Commissioners
of Weld County , Colorado , the amount of money necessary to be levied to meet the
maintenance , operating and current expenses of said district for the fiscal year commencing
on the first day of January, 1931, and,
WHEREAS , The Board of County Commissioners construed said resolution to mean
that there should be levied for such purposes against the lands in said district , $1.35 per
acre , and, in addition thereto, should levy 15co additional and would make a levy of $1.55
per acre for said purposes , and ,
WHEREAS , It now appears bLr resolution of the Board of Directors of The Denver-St.
Vrain Municipal Irrigation District , adopted March 10, 1931 , that the total levy for
such purposes should be 41.35, per acre , without adding thereto 15;a to cover delinquencies ,
and that said amount to cover delinquencies was included in said amount of 41.35 per acre ,
and,
WII rS , The Board of Directors of said district , by said resolution , have
directed the County Commissioners by resolution to abate the levy so made , as aforesaid, to
the extent of 20 cents per acre , so that the maintenance assessment payable in the year
1931 against the lands in said district to be the sum of $1.35, per acre , and,
WHEREAS , By said resolution, it is further provided that the Assessor and
Treasurer of Weld County , Colorado, were authorized and directed to change their books
and records so as to mane same show that the total assessment for maintenance purposes
against the lands in said district , in the year 1931, is $1.35, per acre , and that the
Treasurer of Weld County was thereby authorized to accept the sum of $1.35 per acre as
the total assessment payable in the year 1931, for maintenance purposes against the
lands in said district.
NOW, THEREFORE, BE IT RESOLVED , That the levy hereto-fore made by the Board of
County Commissioners to meet the maintenance , operating and current expenses of the
Denver-St. Vrain Municipal Irrigation District for the fiscal year commencing on the
first day of January , 1931, in the amount of $1.55 per acre be and the same is hereby
abated to the extent of 20 cents per acre , and the maintenance assessment payable
in the year 1931 , against the lands in said district, shall be the sum of $1.35 per acre ,
and,
BE IT F7RTHr.R RESOLVED that the Assessor and Treasurer of weld County , Colorado ,
be and they are hereby authorized and directed to change their books and records so as to
make same show that the total assessment payable for maintenance purposes against the

INSURANCE COMPANY OF
MINNEAPOLIS .
WHEREAS , THE NORTHWESTERN NATIONAL LIFE INSURANCE COMPANY of Minneapolis,
Missesota, has offered to sell to Weld County, a group insurance policy on the
employees of said Weld County , to insure against loss of life and permanent disability
to such employees , and,
WHEREAS , Weld County now deems it advisable to buy said policy and to pay
the premiums thereon.
IT IS , THEREFORE, ORDERED By the Board of County Commissioners of Weld County
that the said Northwestern National Life Insurance Company be and it is hereby
authorized to issue said policy and the County agrees to pay the premiums thereon as
therein provided, when and if said insurance policy is written, issued and delivered
into the possession of Weld County.

,WHEREAS , the UNION PACIFIC RAILROAD COiPANY has tendered to the COUNTY OF WELD,
STATE OF CLORADO , an agreement granting to the County certain rights for highway purposes
in portions of the Railroad Compares right of way in said County, which said agreement
is in words and figures following, to-Veit:

The Railroad Company hereby grants to the County for the same period
( a) the right to construct and maintain a public highway over and across the right of
way and tracks of the Railroad Company on the prem±Ses.-described as follows:
A strip of land 60 feet in width situate in the West Half (WQ) of
Section Six ( b ) , Township r'our (4) North , Range Sixty-five ( b5) West of the sixth
Principal Meridian , being all that part of the Railroad Company' s right of way included
between lines parallel with and distant respectively 140 feet and 200 feet northwesterly
at right angles from said center line of the Railroad Company' s main track of its
Denver to Cheyenne main line and extending southwesterly from a line parallel with and
75 feet distant northwesterly and radially from the center line of the Railroad Company' s
main track from Dent to LaSalle , to a line parallel with and 75 feet distant southeasterly
and radially from said center line of main track from Dent to LaSalle , as shown outlined
by red lines on said xhibit C .
(b) The right to construct and maintain an overhead viaduct and necessary approaches for
highway purposes over and across the right of way and tracks of the Railroad Company on
the premises dJperibed as follows:
A strip of land b0 feet in width situate in the Southwest luarter of Section Twenty-
one ( 21) , Township Nine ( 9 ) North , Range Sixty-six ( bb) pest of the Sixth Principal
Meridian, being all that part of the Railroad Company' s right of way included between
lines parallel with and 30 feet distant at right angles on each side of a straight line that
intersects said center line of main track at a point thereon that is 585.7 feet diStant northwst-
ly from the south line of said Section Twenty-one ( 21 ) , when measured along said
center line of main track and which said straight line makes an angle from northwest
to northeast of b0° with said center line of main track and extending from a line
parallel with and 200 feet distant southwesterly at right angles from said center
line of main track to a line parallel with and 200 feet distant northeasterly at
right angles from said center line of main track, as shown outlined by red lines on said
Exhibit D.
The premises described in subparagraphs ( a) and ( b) of this section are hereinafter
called "crossing areas" .
The rights herein granted are subject and subordinate to the prior and continuing
right of the Railroad Company to construct , maintain, use and operate existing or additional
railroad tracks, telegraph, telephone , signal or other pole and wire line , pepe lines and
other facilities upon , along or across any or all parts of said crossing areas , all or
any of which may be freely done at any time or times by the Railroad Company without
liability to the County or any other party for compensation or damages.
Section 2. As a consideration for the rights hereinbefore granted, the County
agrees to pay in advance to the Railroad Company a rental of Five Dollars ( 5.0Q) per
annum; to assume all taxes and assessments levied upon the leased premises and crossing
areas during the continuance of this agreement; at its own expense to maintain ,
subject to the supervision of the Railroad Company and in accordance with plans and
specifications to be approved by the Railroad Company, an overhead viaduct and necessary
approaches to carry said highway over the right of way and tracks of the Railroad
Company in the location described in subparagraph ( b) of Section 1 hereof; to keep the
leased premises and crossing areas free from combustible material ; to plant no trees or
shrubbery thereon without the previous written consent of the Railroad Company , and to
erect no structures thereon except such as may be necessary for highway purposes; to
put nothing upon the leased premises or crossing areas which might obstruct or interfere
with the view; to provide , in locations and in accordance with plans approved by the
Railroad Company before the work is commenced , such ditches, culverts , bridges and other
structures as may be necessary properly to care for the drainage from the leased premises
and crossing areas and the adjoining right of way of the Railroad Company; and to hold
the Railroad Company harmless from any and all damages to any of such structures on said
leased premises or crossing areas ( including,among other things, the said viaduct
extending over and across the right of way and tracks of the Railroad Company on the
premises described in subparagraph ( b) of Section 1 hereof) arising from fire caused
directly or indirectly by sparks or fire emitted from the engines or trains of the Railroad
Company; and further to hold the Railroad Company harmless from any damages to the
highway upon the leased premises and crossing areas which my result from the construction
of drainage ditches or waterways by the Railroad Company.
Section 3. The Railroad Company reserves the right to take possession of all
of any portion of the leased premises whenever the use thereof may become necessary or
expedient , in the judgment of the Railroad Company, for railroad purposes, or for, or in
connection with, drilling for or mining of oil, gas, coal or other minerals of what-
soever nature mnderlying the leased premises by the Railroad Company or by others with its
permission; PROVIDED, however,
( a) that in the event the Railroad Company elects to take possession of all or
ahy portion of that portion of the leased premises between Grand and
Reynolds Avenues in the sown of Platteville, Colorado , in accordance with
this reservation, it shall first serve upon the County ninety ( 90) days'
written notice of such election; and
( b) that in the event the railroad Company elects to take possession of all or
any portion of the leased premises other than that described in subparagraph
(a) of this Section 3 hereof, in accordance with this reservation, it shall
give to the County six ( b) months' notice of its intention so to do , and
shall provide at its expense the necessary land for and reestablish, or,
in lieu thereof, at its election , pay to the County the cost of such itirld
and expense for reestablishing, the highway and appurtenant improvements
thereon in as good condition as it was in at the time of taking possession
thereof.
Section 4. The County agrees that without the approval of the Railroad Company
it will not construct or permit the construction of a concrete or other hard surface road
or permanent pavement on that portion of the leased premises covered by this agreement

be,yween Grand and Reynold Avenues in the Town of Platteville , Colorado , and that any
repairs to the present road between said Grand and Reynolds Avenues shall be made with
gravel in such a manner as not to interfere with any trackage or development plans of
the Railroad Company.
Section b. The Railroad Company reserved the right to maintain , operate ,
repair and renew any of its existing railroad tracks crossing said leased premises and
the right to cross the leased premises with such additional railroad tracks which may
be required for its convenience or purposes, in such a manner as not unreasonably to
interfere with their use as a public highway. In the event the Railroad Company shall
place tracks upon the leased premises in accordance with this reservation it shall, upon
completion of Such tracks , restore the highway across the same to its former state of
usefulness.
Section b. The County shall not use the leased premises or the crossing areas
or permit them, or either of the , to be used exceptfor the usual and ordinary purposes of a
street or highway , and it is expressly understood and agreed that such purposes shall not
be deemed to include the tie by the County, or by others , of the leased premises or the
crossing areas for railroad, street or interurban railway or other rail transportation
purposes or for the construction or maintenance of electric power transmission lines.
Section 7. This agreement is bubject to all outstanding superior right ( including
those in favor of telegraph and telephone companies and leases to abutting property owners
and others) , and the right to renewals and extensions of the same ; and ti si understood
that nothing in this agreement contained shall be construed as a covenant to put the
County into possession or to protect the County in the Peaceable possession of said
premises.
Section 8. No special assessments for establishing or improving the highway
located upon the leased premises and the crossing areas are to be made against the
adjacent railroad right of way of the Railroad Company, and the County agrees to
protect the Railroad Company against and save it harmless from such special assessments.
Section 9. The County agrees that , at points where the Railroad Company at
the date hereof maintains a fence on its ri`:ht of way between its track and the inner
margin of the leased premises, the County will, at its own cost and expense , move
such fence to the inner margin of the leased premises, and that, at points where the
Railroad Company dies not maintain a fence in such location, the County will construct
a fence on the inner margin of the leased premises when and where requested in writing
by the Railroad Company. The County further agrees to assume the responsiblity of
constructing, or of making such arrangements as may be necessary with owners or lessees of
property abutting upon the right of way along the line of said highway, for constructing,
maintaining and repairing fences on the outer margin of the Railroad Company' s right of
way, and relieve the Railroad Company of all obligation, if any there be , to establish
or maintain fences upon the outer margin of its right of way and of all expense incident
to the construction, maintenance and repair of such fences. In the reloc?_:tion of
existing fences and in the construction of new fences in accordance with the provisions
of tnis section, the County shall , at its own cost and expense , also relocate or construct
such wing fences that mgy be necessary and also any necessary connections with existing
fences of the Railroad Company. All fences shall be in accordance with the standards
of the Railroad Company and all work of relocating and constructing fences shall be done
n a manner satisfactory to the Railroad Company.
Section 10. For the purpose of protecting the reversionary interests of the
Railroad Company against the assertion of adverse rightp, the County agrees to prevent
encroachments upon the leased premises , and to this end will , at its own expense , take
all necessary acting, including as far as practicable the building of its ditches on
and the borrwing of earth from the outer margin of said leased premises.
Section 11. If the County should breach or fail to keep any of the covenants
or conditions hereof, or fail to perform such covenants or conditions, or to remedy the
same for thirty 030) days after written notice of such failure or breach on the part of
the County, given by the Railroad Company to the County and The State Highway Department
or its successor in jurisdiction over highways in the State of Colorado, then this
agreement shall be null and void.
Section 12. Non-user by the County of the leased premises and crossing areas
for highway purposes continuing at any time during the term hereof for a period of
eighteen (18) months shall , at the option of the Railroad Company, work a termination
of this agreement and of all rights of the County hereunder, and non-user by the County
of a portion of the leased premises and crossing areas continuing for a like period
shall , at the option of the Railroad Company, work a termination of all rights and interests
of the County with respect to such portion.
Section 13. Upon the effective date hereof, to-wit: December 1, 1930, that
certain lease from the Railroad Company to the County, dated May 25, 1923, made for a term
of fifty ( 50) years effective May 1, 1923, indentified in the records of the Railroad
Company as Audit No. 28345, and those two certain supplements to said lease dated May
25, 1923, dated respectively August 15, 1924 and March 18, 1929 , shall be , and the same
are hereby, terminated.
Section 14. This agreement is not to be assigned, nor is any portion of the
leased premises to be sublet , without the written consent of the Railroad Company. The
County will surrender peaceable possession of the leased premises and the crossing
areas at this expriation of this agreement.
Section .lb. All covenants and agreements herein contained are made by the parties
hereto for, and Skill be binding upon, themselves and their successors and assigns.

to be signed by its proper officers thereunto duly authorized, and the County of Weld,
State of Colorado has caused these presents to be signed by the Chairman of its
Board of County Commissioners pursuant to authority vested in said Chairman by a
resolution duly passed and adopted by said BOard of County. Commissioners on the

be, and the same are hereby, accepted in behalf of the County of Weld, State of CDloraao ;
that the Chairman of said Board of County Commissioners of the County of Weld is hereby
authorized, empowered and directed to execute said agreement in behalf of said County
and that is be duly attested by its Clark.

WHEREAS , The State Game and Fist Commissioner of the State of Colorado has, -ii

(4150.00) Dollars, and the County Commissioners have agreed to advance
the sum of One Hundred Fifty (S150.00) Dollars to the Greeley Chapter, No. 21 of the
Isaac Walton League for the purpose of paying an average bounty of five ( 5) cents a
head for the eradication and extermination of magpies in the County of Weld, Three ( 3 )
cents for young magpies and Ten ( 10V) cents for old magpies, apiece , and,
WHEREAS , The Board does now declare the magpies to be a pest , and does hereby
determine that said magpies are causing depredation upon live stock and poultry in Meld
County , Colorado.
NOW, THEREFORE, IT IS HEREBY ORDERED, that Weld County advance and pay the sum
of One Hundred Fifty (0150.00) Dollars to Greeley Chapter no. 21, of the Isaac Walton
League in cooperation with the State Game and Fist Department , as aforesaid, which sums
of money shall be used by said League in payment of bounties not in excess of five cents

WHEREAS , The Colorado-Wyoming Gas Company has made application for the license 5i 'f'
to lay and construct a pipe line on the County Highway along the line as described as
follows, towit:
Between Sections Eighteen ( 18) and Nineteen ( 19) , in Township One ( 1) North,

of Range Sixty-eight (b8) West of the Sixth (bth) P.M. , approximately 3974 feet East of
the County Line between Weld and Boulder Counties, Colorado ; thence Easterly along said
County highway for a distance of approximately twelve (12 ) miles to a point on the Fort
Lupton-Brighton paved State highway No. 2 approximately two and one-half ( 2*) miles south
of the Town of Fort Lupton; thence from said last mentioned point northerly along said
paved State Highway No. 2 to the town limits of the Town of Fort Lupton , Colorado;
thence also from said point in a general southerly direction along said paved State Highway
No. 2 to the town limits of the Town of Brighton, Colorado ;
AND WHEREAS , Contract has been presented to the Board proposing the terms upon
said Pipe Line should be constructed;
NOW THEREFORE, BE IT RESOLVED, That the County of Weld grant such license upon the
terms as presented and forth in contract , made a part of this resolution, and that the
Chairman of the Board and Clerk to be authorized to execute on same forthwith on behalf
of Weld County.

THIS AGREEMENT , made and entered into this 11th day of May, 1931 , by and between
COLORADO-WYOMING GAS COMPANY, a corporation .organized and axisting under and by virtue of
the laws of the State of Delaware , party of the first part , and THE BOARD OF COUNTY COMMISSIONERS
OF WELD COUNTY, COLORADO , party of the second part , WITNESSETH:
THAT , WHEREAS , The party of the first part is about to construct a pipe line from
a point in Weld County, Colorado , on the county highway between Sections Eighteen ( 18) and
Nineteen ( 19 ) , in Township One ( 1) North, of Range Sixty-eight ( b8) West of the Sixth ( 6th)
P. . , approximately 3974 feet East of the County Line between geld and Boulder Counties ,
Colorado; thence L:ast::rly along said county highway for a distance of approximately twelve
( 12 ) miles to a point on the Fort Lupton-Brighton paved State Highway No.2 approximately two
and one half ( 22) miles south of the Town of Fort Lupton; thence from said last-mentioned
point northerly along said paved State Highway No. 2 to the town limits of the Town of
Fort Lupton, Colorado ; thence also from said point in a general southerly direction along

AND WHEREAS , According to the plans and specifications under which said pipe line
is to be constructed, the party of the first part desires to lay said pipe line in , un' 3r,
along and across certain county highways and bridges in sgid County of Weld, State of Colorado ;
- AID WHEREAS_, TO() party of the second part is willing to permit the use of said
highways and bridges for said pipe line , subject to certain terms and conditions as hereinafter
set forth;
NOW, THER::FORE, In consideration of the premises and of the covenants and conditions
to be by the party of the first part kept and performed as hereinafter set forth, the party of
the second part does hereby grant unto the party of the first part a license to lay, construct
and maintain a pipe line in, upon, under and along the county highway hereinabove described,
including bridges , and in, upon, under and along each and every county highway and bridge
crossed or intersected by said pipe line in Weld County, Colorado , as the same appears upon
the map or plat attached hereto market "Exhibit A" , hereby referred to and made a part hereof,
the route or line of said pipe line appearing in red thereon.
As a consideration for the granting of the aforesaid license party of the first
part agrees that said pipe line shall have a cover of at least thirty inches of earth; that
where , at the date of this instrument , barrow pits have been constructed along said highways ,
the pipe line shall be buried at least thirty inches below the surface of such barrow pits;
and that along such portions of said highways as barrow pits have not been constructed , at
the date of this instrument , the pipe line shall be built within two feet of the fence at
the side or edge of said highway and shall be buried thirty inches below the surface of the
ground.
The party of the first part further agrees that if at any time hereafter the grade
of any highvvay or bridge burdened with said pipeline is changed, it will , at its own expense,
change and re-lay its said pipe line to the depth and distance aforesaid; that it will at
all times maintain said pipe line and re >air all leaks and damages at its own expense ; and further
that if, by reason of any leak or damage to the Wipe line, damage to the highway or to any bridge
is sustained, party of the first part will repair and replace the highway or bridges so damaged
and restore the same to the same condition they were in prior to said leak or break.
The party of the first part shall lay and construct said pipe line at the side of the
road and as elsely as possible to the fence line , having in view the width of the ditching

machine used in digging the trench for said pipe line, and wherever said trench is excavated
by hand party of the first part agrees that it shall be at a distance of not more than four
feet from the fence line at the side of the road and that where telephone poles or power line
poles are located inside the fence line the trench so excavated by hand shall be at a distance
of not more than four feet from said telephone poles or power line poles . The party •
of the first part further agrees to avoid placing dirt or gravel on the traveled portion
of the highway and agrees that wherever it becomes necessary to excavate across the traveled
portion of the highway it will replace the ;;ravel thereon. The party of the first part further
agrees to re-surface and restore all that portion of the roads and highways excavated , torn up and
used in the laying and construction of said pipe line , placing the same in good order and
condition, and in the event that party of the first part shall fail so to do , said party of the
first part shall promptly pay the actual expense of the County of Weld incurred or sustained

in the repairing and resurfacing or said roads and highways necessitated by the installation
of said pipe line to the end that the same may be placed in the same order and condition
as now exists along the route of said pipe line. And the party of the first part further
agrees that , upon completion of the work of laying and installing said pipe line, it will
furnish to the party of the second part a plat or blue print of said pipe line showing the
location thereof as constructed."
If at any time any county highway shall be re-established and constructed, or
if at any time any existing county highway shall be widened, and any such high hay so re-
established, constructed and/or widened shall be affected by said pipe line , then the
party of the first part agrees that it will re-lay and reconstruct said pipe line in such
manner as shall meet with the approval of the County Engineer.
The party of the first part further agrees to indemnify and save harmless the
County of Weld from and against any claims or damages arising from the laying or maintenance
of said pipe line .
It is further agreed that the laying of said pipe line and the maintenance
thereof along said county highways and bridges shall be subject to the approval of the
County Engineer.
It is further understood and agreed that this agreement and all of the terms
and conditions hereof mxy be assigned by the party of the first part, and that upon such
assignment each and all of the terms and conditions hereof shall be binding upon such
assignee.

THIS AGR1 ENT , Made- and Entered into this eleventh day of gay, A.D. 1931,
by and between MRS. A. R. SCOTT of Larimer County, Colorado, Party of the First Part,
and WELD COUNTY, a division of the. State of Colorado, Party of the Second Part ,
WITNESSETH:
FOR and in consideration of Five Hundred ($500.00) Dollars to be paid to the
party of the first part by the party of the second part, the party of the first part
does hereby grant and sell to the party of the second part a license to take and remove
from that part of the Northeast Q,uarter of Section eight ( 8) Township seven ( 7 ) North
of Range Sixty-seven ( b7 ) , West of the Sixth P.M. , in Weld County , lying east of a
certain lateral in the southeast corner of said lands, sufficient gravel to surface
twenty miles of highway in Weld County, Colorado, estimated to take on an average of
eight h. ndred ( 800 ) years per mile of surfacing, and does hereby grant to the party
of the second part , the right of ingress and egress to take and remove said gravel,
provided , however, that this sale and grant of license for removal of gravel is limited
to the year 1931, and, if said gravel is not removed within the year 1931 , this sale
and license shall , nevertheless , terminate on January 1 , 1932, whether said gravel is
wholly removed within said period of time or not.
It is specifically agreed that said gravel is to be taken from the dry land
portion of said lands lying east of said lateral, and that the place of removal from
said portion of said lands shall be at the selection and option of the party of the
second part.
IN WITNESS WHEREOF, Tha party of the First part has hereunto set her hand,
and the Party of the Second party has caused its name to be subscribed by Chairman of
the Board of County Commissioners and its Clerk, with the County Seal , the day and year

West of a line fifty ( CO) feet West of and parallel to the center line of the pavement on the
State highway , measured at right angles to the center line of said highway, and to pay therefore
the sum of 434.00.

Lot nine ( 9 ) , in Block One Hundred Seventy-three ( 175) in the Town of Evans , lying nest of a

at said tax sale of Certificates Number 598-599 and 870, and the County Treasurer of said
County, issued to him the certificates of purchase therefor, which certificates were
numbered 59th-599 and 870 of sales of 1928. Said certificates having been redeemed and
having been deposited in mail addresssd to County Treasurer and newer received by County Treasurer.
