RESOLUTION State of Colorado, Weld County Clerk Recorder U f{-S
RE: APPROVAL OF FINAL PLAT FOR PETERS SUBDIVISION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Final Plat for Peters Subdivision has been
submitted to the Board of County Commissioners of Weld County,
Colorado for approval in accordance with the Subdivision Regula-
tions of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request and studied the recommendations of the Weld County Planning
Commission, as submitted, and finds that said Final Plat should be
approved providing the applicant accomplishes the following prior
to recording the Final Plat:
1. Amend the Developmental Covenants, Article I,
Section 1 , by exchanging the word "shall" for
"should. "
2. Amend the Developmental Covenants, Article I,
Section 3, to read:
"A detailed study of each lot shall be conducted
to determine at least two (2) sites on each lot
for sewage disposal and develop a property owner' s
maintenance program to insure the feasibility of
on-lot septic systems. This sutdy shall be done
prior to construction. "
WHEREAS, the Board of County Commissioners finds that the
Final Plat conforms in all major aspects to the Preliminary Plat
as previously reviewed and approved by the Board of County
Commissioners, and
WHEREAS, the Board of County Commissioners further finds
that the applicant has complied with the Final Plat submission
requirements as set forth in the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Final Plat of Peters

Subdivision described in "Exhibit A" attached hereto and incor-
porated herein by reference, be and hereby is approved subject to
the Development Standards as shown on said Final Plat, the condi-
tions as set forth above and the park fee being paid.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 15th day of
November, A.D. , 1978 .

SUBDIVISION AGREEMENT
THIS AGREEMENT, made and entered into this 15thday of November
1978 by and between the County of Weld, Colorado, acting through its Board
of County Commissioners , hereinafter called "County" , and
Walter J. Peters , hereinafter called
"Subdivider".
WITNESSETH:
WHEREAS, Subdivider is the owner of or has a controlling interest in
the following described property in the County of Weld, Colorado:
A tract of land located in the Northeast Quarter (NE 1/4) of the Northwest
Quarter (NW 1/4) of Section 32, Township Six North (T6N) , Range 65 West (R65W) ,
of the Sixth Principal Meridian (6th P.M.) , Weld County, State of Colorado,
being more particularly described as follows:
Beginning at the Northeast Corner of the Northwest Quarter (NW 1/4) of
said Section 32, and considering the East Line of the Northwest Quarter (NW 1/4)
to bear S 00 00' 00" E, with all other bearings herein being relative thereto,
thence S 00 00' 00" E a distance 40 feet fran said Northeast Corner to the
True Point of Beginning, thence following these seven courses:
N 90 00' 00" W, a distance of 388.20 feet,
S 00 00' 00" E, a distance of 280.00 feet,
N 90 00' 00" W, a distance of 275.03 feet,

WHEREAS, a final subdivision plat of said property, to be known as
Peters Subdivision
has been submitted to the County for approval ; and
WHEREAS, Section 11-1 of the Weld County Subdivision Regulations pro-
vides that no final plat shall be approved by the Board of County Commissioners
until the Subdivider has submitted a Subdivision Improvement Agreement
guaranteeing the construction of the public improvements shown on plans ,
plats and supporting documents of the subdivision, which improvements , along
with a time schedule for completion, are listed in Exhibits "A" and "B" of
this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF the foregoing and of the acceptance
and approval of said final plat, the parties hereto promise, covenant, and
agree as follows :

1 . Lngineering Services : Sulniivider shall furnish , at its own
expense, all engineering services in connection with the rlr!sign
and construction of the subdivision improvements listed on
Exhibit "A" which is attached hereto and made a part hereof by
this reference.
1 . 1 The required engineering services shall be performed
by a Professional Engineer and Land Surveyor registered
in the State of Colorado, and shall conform to the
standards and criteria established by the County for •
public improvements .
1 . 2 The required engineering services shall consist of,
but not be limited to, surveys , designs , plans and pro-
files, estimates , construction supervision, and the
• submission of necessary documents to the County.
1 . 3 Subdivider shall furnish drawings and cost estimates
for roads within the subdivision to the County for ap-
proval prior to the letting of any construction contract.
Before acceptance of the roads within the subdivision by
the County, Subdivider shall furnish one set of repro-
ducible "as-built" drawings and a final statetie1 of con-
struction cost to the County.
2. Rights-of-Way and Easements : Before commencing the construction of
any improvements herein agreed upon, Subdivider shall acquire , at its
own expense, good and sufficient rights-of-way and easements on all
lands and facilities traversed by the proposed improvements. All such
rights-of-way and easements used for the construction of roads to be
accepted by the County shall be conveyed to the County and the docu-
ments of conveyance shall be furnished to the County for recording.
3. Construction: Subdivider shall furnish and install , at its own
expense, the subdivision improvements listed on Exhibit "A" which is
attached hereto and made a part hereof by this reference, according
to the construction schedule set out in Exhibit "B" also attached hereto
and made a part hereof by this reference.
3. 1 Said construction shall be in strict conformance to the
plans and drawings approved by the County and the speci-
fications adopted by the County for such public improve-
ments. Whenever a subdivision is proposed within three

mile; of an incorpor,ited community located in Lilo Calmly
or located in any adjacent county, the Subdivider shall
be required to install improvements in accordance with the
requirements and standards that would exist if the plat
were developed within the corporate limits of that com-
munity. If the incorporated community has not adopted
such requirements and standards at the time the subdivision
is proposed, the requirements and standards of the County
shall he adhered to. If both the incorporated community
and the County have requirements and standards , those re-
quirements and standards that are more restrictive shall
apply.
3. 2 Subdivider shall employ, at its own expense, a qualified
testing company previously approved by the County to per-
form all testing of materials or construction that is re-
quired by the County; and shall furnish copies of test re-
sults to the County.
3. 3 At all times during said construction , the County shall
have the right to test and inspect or to require testing and
inspection of material and work at Subdivider•'s expense. Any
material or work not conforming to the approved plans and
specifications shall be removed and replaced to the satis-
faction of the County at Subdivider' s expense.
3. 4 The Subdivider shall furnish proof that. proper arrangements
have been made for the installation of sanitary sewer or
septic systems, water, gas , electric and telephone services .
3. 5 Said subdivision improvements shall be completed, according

to the terms of this Agreement, within the construction
schedule appearing in Exhibit "B" . The Board of County
Commissioners , at its option, may grant an extension of the
time of completion shown on Exhibit "5" upon application
by the Subdivider.
4. Release of Liability: Subdivider shall indemnify and hold harMless
the County from any and all suits , actions or claims of every nature
and description caused by, arising from, or on account of said con-
struction, and pay any andall- judgments rendered against the County
on account of any such suit, action or claim, together with all reasonable

expanses and ,ILtnrney lees incurred by unity in defending 5ucli snit,
action or claim. All contractors and other employees engaged in
construction of the improvements shall maintain adequate workman 's
compensation insurance and public liability insurance coverage, and
shall operate in strict accordance with laws and regulations of the
State of Colorado governing occupational safety and health.
5. Acceptance of Streets for Maintenance by the County: Upon com-
pliance with the following procedures by the Subdivider, streets with-
in a subdivision may be accepted by the County as a part of the County
road system and will be maintained and repaired by the County.
5. 1 If desired by the County, portions of street improvements
may be placed in service when completed according to the
schedule shown on Exhibit "B" , but such use and operation
shall not constitute an acceptance of said portions .
5. 2 County may, at its option, issue building permits for con-
struction on lots for which street improvements detailed
herein have been started but not completed as shown oin
Exhibit "B",and may continue to issue building permits so
long as the progress of work on the subdivision improvements
throughout the development is satisfactory to the County;
• and all terms of this Agreement have been faithfully kept
by Subdivider.
5. 3 Acceptance for Partial Maintenance: Upon the completion of
the construction of streets within a subdivision according
to Weld County Specifications , the Subdivider shall request
in writing that the County Engineer inspect said streets and
accept them for partial maintenance by the County. Partial
maintenance consists of all maintenance except for actual
repair of streets , curbs and gutters and related street
improvements. The County Engineer shall accept streets for
partial maintenance for a period of one year. Nine months
after initial acceptance, the County Engineer shall inspect
the subject streets , and notify the Subdivider of any defi-
ciencies . The County Engineer shall reinspect the streets
after notification from the Subdivider that any deficiencies
have been corrected. If the County Engineer finds that the
streets are constructed according to County standards , he
shall recommend the acceptance of the streets for full main-

a recommendation from the County Engineer for acceptance of
streets within the subdivision, the Board of County Commis-
��.111 sioners shall accept such streets as public facilities and
County property , and shall be responsible for the full main-

tenance of such streets including repair.
6. Improvements Guarantee: Subdivider shall furnish to the Board of
County Commissioners as guarantee of compliance with this Agreement,
collateral such as , but not limited to, performance or property bonds ,
private or public escrow agreements , liens on property, deposit of
certified funds or .other similar surety agreements acceptable to the
Board of County Commissioners . The amount of any of the above guarantees
shall be set by the Board of County Commissioners and portions of the
guarantee may be released upon completion of various portions of the
improvements. All or any portion of the guarantee will be released upon
completion of the guaranteed improvements according to County standards
and the terms of the subdivision plans and plats and, in the case of

w the streets , upon acceptance of the streets by the County for full
maintenance as a part of the County road system.
7 . Public Sites and Open Spaces : The Planning Conanission and the Board

of County Commissioners , upon consideration of vehicular traffic and
facilities and the particular type of development proposed in the
subdivision, may require the dedication, development and/or reservation
- of areas or sites of a character, extent and location suitable for pub-
lic use for parks , greenbelts or schools , other than subdivision streets
and utility easements designated, in accordance with one of the' following

alternatives , or as specified in the PUD plan, if any:
7. 1 The required acreage as may be determined according to
Section 8-15-B of the Weld County Subdivision Regulations
shall he dedicated to the County or the appropriate school

district, for one of the above purposes. Any area so dedi-
cated shall he approved by the County or school district, and

shall be maintained by the County or school district.
7. 2 The required acreage as determined according to Section 8-15-B
of the Weld County Subdivision Regulations may be reserved
through deed restrictions as open area , the maintenance of
which shall be a specific obligation in the deed of each lot

1 . 3 In lira of land , the Board of Comity Crnnni•,:, inner', may re-
quire a payment to the County in an amount equal to the
market value at the time of final plat submission of the
required acreage as determined according Lo Section 8-15-L'.
Stich value shall be determined by a competent land appraiser
chosen jointly by the Board and the Subdivider. The cash
collected shall be deposited in an escrow account to be
expended for parks at a later date.
3. Successors and Assigns : This Agreement shall be binding upon the
heirs , executors , personal representatives , successors and assigns of
the Subdivider, and upon recording by the County, shall he deemed a
covenant running with the land herein described , and shall be binding
upon the successors in ownership of said land.

workmanship and materials which may become apparent during the period from November 15,
1978 to November 15, 1979.
NOW THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, That if the Principal shall
fully indemnify and save harmless the Obligee from all costs or damages which the Obligee
may suffer by reason of defects in workmanship and materials, then this obligation shall
be null and void; otherwise to remain in full force and effect.

4 . On October 12 , 1978 , the Weld County Utilities Coordinating
Advisory Board recommended approval of the utility plan for
the final plat .
The Planning Commission recommendation for approval is subject to
the applicant accomplishing the following prior to recording the
final plat :
1. Amend the Developmental Covenants , Article I , Section 1 , by
exchanging the word "shall" for "should" .
2. Amend the Developmental Covenants , Article I , Section 3 , to
read :
"A detailed study of each lot shall be conducted to
determine at least two (2) sites on each lot for
sewage disposal and develop a property owner' s
maintenance program to insure the feasibility of
on-lot septic systems. This study shall be done
prior to construction . "
These items were recommended by the Colorado Geological Survey
in a letter dated October 18 , 1978/

Comments :
1. The Weld County Health Department in a letter dated October 20,
1978 , has indicated that an existing septic system on the prop-
erty under consideration was not installed according to Health
Department criteria, in that a paved parking area was constructed
over the septic system.
The letter further states, "Before an approval can he given , the
system will have to be modified to compensate for the paved
area. "
It is the feeling of the Department of Planning Staff that this
is a matter which should be resolved between the applicant and
the Health Department .
2. The Eaton Area Fire Protection District did not respond to the
referral sent to them.

in the State of Colorado, and shall conform to the
standards and criteria established by the County for
public improvements . •
1 . 2 The required engineering services shall consist of,
but not be limited to, surveys , designs , plans and pro-
files , estimates , construction supervision , and the
submission of necessary documents Lu the County.
1 . 3 Subdivider shall furnish drawings and cost estimates
for roads within the subdivision to the County for ap-
proval prior to the letting of any construction contract.
Before acceptance of the roads within the subdivision by
the County, Subdivider shall furnish one set of repro-
ducible "as-built" drawings and a final state"';.' ' 'ii con-
struction cost to the County.
2. Rights-of-Flay and Easements : Before commencing Lhe construction 'H
any improvements herein agreed upon, Subdivider shall acquire, at its
own expense , good and sufficient rights-of-way and easements on all
lands and facilities traversed by the proposed improvements . All such
rights-of-way and easements used for the construction of roads to be
accepted by the County shall ho' conveyed to the County and the docu-
ment; of conveyance shall be furnished to the County for recording.
3. •Construction : Subdivider shall furnish and install , at its own
expense, the subdivision improvements listed on Exhibit "A" which is
attached hereto and made a part hereof by this reference , according
to the const"ruclion schedule set out in Exhibit "B" also attached hereto
and made a part hereof by this reference.
3. 1 Said construction shall be in strict conformance to the
plans and drawings approved by the County and the speci-
fications adopted by the County for such public inprove-
rents. Whenever a subdivision is proposed) within three

quirements and standards that are more restrictive shall
apply.
3. 2 Subdivider shall employ , at its own expense, a qualified
testing company previously approved by the County to per-
form all testing of materials or construction that is re-
quired by the County; and shall furnish copies of test re-
sults to the County.
3, 3 At all times during said construction , the County shall
have the right to test and inspect or to require testing and
inspection of material and work at Subdivider's expense. Any
material or work not conforming to the approved plans and
specifications shall be removed and replaced Le the, satis-
faction of the County at Subdivider ' s expense.

have been made for the installation of sanitary sewer or
septic systems , water, gas , electric and telephone services .
3. 5 Said subdivision improvements shall he completed, according
to the terms of this Agreement, within the construction
schedule appearing in Exhibit "B" . The -Board of County
Commissioners , at its option, may grant an extension of the

4. Release of liability : Subdivider shall indemnify and hold harmless
the County from any and all suits , actions or claims of every nature

struction, and pay any and all judgments rendered against the County

Construction of the improvements shall maintain adequate workman 's
compensation insurance and public liability insurance coverage, and
shall operate in strict accordance with laws and regulations of the
• State of Colorado governing occupational safely and health.
5. Acceptance of Streets for Maintenance by the County__ Upon com-
pliance with the following procedures by the Subdivider, streets with-
in a subdivision may be accepted by the County a; a part of the County
road system and will be maintained and repaiired by the County.

may he placed in service when completed according to the
schedule shown on Exhibit "B", but such use and operation
shall not constitute an acceptance of said portions .
5. 2 County may, at its option, issue building permits for con-
struction on lots for which street improvements detailed
herein have been started but not completed as shown on
Exhibit 'B",aixlmay continue to issue building permits so
long as the progress of work on the subdivision improvements
throughout the development is satisfactory to the County ;
and all terms of this Agreement have been faithfully kept
by Subdivider.
5. 3Acceptance for Partial Maintenance: Upon the completion of
the construction of streets within a subdivision according
to Weld County Specifications , the Subdivider shall request
in writing that the County Engineer inspect said streets and
accept them for partial, maintenance by the County. Partial
maintenance consists of all maintenance except for actual
repair of streets , curbs and gutters and yelated street
improvements. The County Engineer shall accept streets for
partial Maintenance for a period of On(' year. Nine months
after initial acceptance. tine County Engineer shall inspect
the subject streets , and notify the Subdivider of any defi-
ciencies. the County Engineer, shall reinspect the streets
after notification from the Subdivider that any deficiencies
have been corrected. If the County Engineer finds that the
streets are constructed according to County standards , he
shall recommend the acceptance of the streets fnr full main-

DECLARATION OF COVENANTS AND AGREEMENTS
PETER'S SUBDIVISION
This declaration made on this day of , 1978, by
Walter J. Peters, hereinafter referred to as the Declarant, Witnesseth:
Whereas, Declarant is the owner of certain property in the County of Weld,
State of Colorado, which is more particularly described as follows:
A tract of land, approximately 10.23 acres, namely Peter's Subdivision, Lots
One (1) through Seven (7) , located in the Northeast Quarter (NE 1/4) of the
Northwest Quarter (NW 1/4) of Section 32, Township Six North (T6N) , Range 65
West (R65W) of the Sixth Principle Meridian (6th P.M.) , Weld County, State of
Colorado.
Now, therefore, Declarant hereby declares that all the above property described
shall be held, sold and conveyed subject to the following easements, restric-
tions, covenants and conditions, which are for the purpose of protecting the
value and desirability of, and which shall run with, the real property and be
binding on all parties having any right, properties or interest in the described
properties or any part thereof, their heirs, successors and assigns and should
inure to the benefit of each owner thereof.

ARTICLE I
DEVELOPMENTAL COVENANTS
Section 1. Soil Investigation
A soil engineering test should be made prior to construction to insure proper
design of footings and foundations.
Section 2. Soil Protection
It will be the responsibility of each owner to provide, in those open spaces
not used for building or parking, a vegetative plan using grass, trees, shrubs,
etc. , installing and maintaining for the purpose of soil protection.
Section 3. Sewage Disposal
A detailed study of each lot should be conducted to determine at least two (2)
sites on each lot for sewage disposal and develop a'homeowner's maintenance
program to insure the feasibility of on-lot septic systems. This study should
be done at the time of construction.
Section 4. Parking Restrictions
There will be no parking in the street, namely 7th Avenue, to allow for an open
roadway for emergency access and egress.
Section 5. Drainage
A drainage study has been made for all lots (one through seven) . It shall be
the owners responsibility, at the time of construction, to install and maintain
the required detention pond together with the outlet control structure.

UTILITY INSTALLATION AGREEMENT
ilm Greeley Gas Company, Mountain Bell , and the
Home, Light, & Power, along with North Weld County Water
District
hereinafter collectively called "Utility Companies", and
Walter J. Peters , hereinafter called "Developer",
enter into the following agreement this 23rd day of August
19 . 78
WITNESSET H:
1. The Developer is the owner or builder of a certain subdivision,
planned unit development, planned building group or other comercial,
residential or industrial real estate development (hereinafter
called "Development") known as Peter' s Subdivision
2. Developer desires to have telephone, electric, gas, water
and services available to the future purchasr,r
or tenants of his development as soon as practically possible.
3. Developer desires to have the utility cables, wires, pipe, conduits,
etc. , underground.
1. In order to provide telephone, electric, gas, water
and , service at the
earliest practical date, it is necessary for the Utility Companies to
commence installation of underground facilities during the con-
struction of the development.

5. The placing of cables, wires, pedestals, pipes, conduits, meters,
etc. , by the Utility Companies prior to completion of all construc-
tion, grading, or other work results in a substantial risk that
these facilities may lx) damaged, cut, injured or otherwise destroyed
in whole or in part. The damage may be occasioned by the action of
the Developer, his Contractor and/or his Subcontractors, or third
persons not ogiloyed by or working for the Developer. The risk of
injury to Utility Companies' property could be virtually eliminated
by installing aerial plant or waiting until. all other construction,
grading and other murk has been completed.
6. It is understood that Developer is selling sites iwthin the Develop-
ment, and once ownership is transferred to a third party purchaser,
Developer shall he released from any responsibility arising by virtue
of the acts of said third party purchasers which result in damage to
the facilities of the Utility Companies.
NOW, Tiff N, in consideration of the above and the mutual convenants herein-
after set forth the Utility Companies and the Developer agree as follows:
PROCEDURES:
A) The Developer shall develop a utility plan with the Utility Companies
in reference to the location of utility lines and easements during pre-
liminary planning of land usage. Such a utility plan wi.il be reduced
to writing, signed and dated at an appropriate time by the signatories
of this contract. Changes in such plan alter this time will be agreed
uixm by the parties to this contract. It is understood that the sub-
ject utility plan shall consist of Developer's recorded plat together
with any written easenents agreed to by the parties.
B) The Utility Companies will assign contacts that will be responsible
for the coordinating of planning, engineering and construction work.
Names and telephone numbers of the assigned contacts will be exchanged
between Utility Companies and Developer.
C) The Developer will provide a preliminary plan to the utility contacts.
The utility contacts will be responsible for the layout of compatible
distribution plans, agree to easement specifications and set up joint
meeting with the Developer with the purpose of finalizing the utility
plan. The preliminary plan shall consist of Developer's plat.

D) The Developer will dedicate or grant adequate easements agreed upon
with the utilities under Paragraph (A) and will grant additional
easements not anticipated at that tune but which are reasonably re-
quired to provide adequate and necessary service to the development.
All such additional easements shall require the prior mutual consent
of the parties.
E) The Developer will furnish each utility contact a tentative develop-
ment schedule and keep the Utility Cu-ninnies advised of change in
the schedule which should include the following:

1. Date grading will be completed and property pins installed.
2. Date subdivision will be ready for utility installations.
3. Date curbs, gutters and sidewalks will be constructed.
4. Date for start of street and parking area paving.
F) The Utility Oxipanies will keep the Developer informed of any changes
in utility schedules that could affect the services for his project.
G) lilien the final development plans are approved, they should include
the following information:
1 . Typical cross-section of streets and easuients.
A. Width of street
B. Location for curb, gutter and sidewalk with relation to right-
of-way.
C. Water, serer, telephone, electric and other utility locations
and method of installation (Aerial and Buried).
D. Width and location of easem:.nts a:; agreed in utility plan.

H) Installation of telephone, electric, gas, water
will he scheduled and completed within a previously agreed to length
of time, upon receipt of written notice that the final grades in
easement areas have been established and that the easenunts are free
of all obstructions, prior to the placing of driveways, curbs, paved
parking areas, sprinkling system$, etc. , except by special agreaivnts
with the Utility Companies and written into this agreement as a part

thereof. The Developer will be responsible for the actual locating
and staking of utility easements upon request and prior to the in-
stallation of utilities within the easements.
1) The Utility Conyrinies will locate facilities for anyone excavating in
the easements or streets occupied by the Utilities. Telephone numbers
of Utility Locators will be provided.
J) Compaction will be to 95% of original undisturbed ground.
REPHISENPATIONS:
A) After Utilities (Gas, Electric, and Telephone) have been installed in
accordance with the Utility plan and until the Developer has completed
his work in the areas of the installation, the Developer agrees to
indemify, hold harmless and reimburse the Utility Companies for any
and all loss, injury, or damage including the cost of replacement of
repair to the Utility Companies' property within the development when
such loss, injury or damage is caused by persons or parties other than
the undersigned Utility Companies, save and except as to acts of
vandalism, acts of God, acts beyond the control of Developer other
than acts of the contractors, sub-contractors, electricians, plumbers,
or others performing work for the Developer and acts by or under the
direction of third party purchasers within the Developaimt. Similarly,
the Utility Companies agree to indemnify, hold harmless and reimburse
the Developer for any and all loss, injury or damage to the Developer's
property within the development, including the cost of replacement or
repair of its property arising from any damage, injury or cut where

sane was occasioned by the act or acts of the Utility Conpanics or
their agents. Furthernure, if grading or landscaping is changed by
Developer, its employees or sub-contractors sufficiently to endanger
the continued use of utility facilities, the facilities will be re-
located by the Utility C<xpanies to a nciv agreed upon location and
the Developer agrees to reimburse the Utility Companies for the cost
of relocations.
13) The Utility Conpany will advise the Developer, at an early date, of
the type of service available. If service is not available, the De-
veloper will be advised in accordance with the Public Utility Carr-
missions regulations, of the anticipated date service will be avail-
able, if known.
C) This agreement does not cover telephone facilities normally handled
by the Building Industry Consulting Group.
ADDITIONAL AGRTf I XIS:
A) This agreement covers construction specification requirenents appli-
cable to the Utility Companies participating, hut may not fulfill
financial and other requirements of individual Utility Companies.
Separate agreanents any be required to satisfy these requirements.
B) In the event the Developer initiates changes after establishing and
agreeing upon a proposed utility plan with the signatories of this
contract, the Developer shall pay the additional costs including en-
gineering costs incurred by the Utility Companies to accamodate
such changes. In the event a Utility Company initiates changes after

agreeing on such a plan, the Utility Company will reimburse the De-
veloper and/or other Utility Companies for costs incurred in accom-
modating such changes; as well as, relocating service facilities with
all reasonable dispatch. Signatories of this contract may unilateral-
ly or mutually agree in writing to relieve the other of this liability
in specific or general (vises.
C) This Agreement shall be binding upon and inure to the benefit of the
sigm atories, their successors, assigns and legally appointed repre-
sentatives.

FOR PETER'S SUBDIVISION
1. Zoning - Commercial
2. Location - Northeast Quarter (NE 1/4) of Northwest Quarter (NW 1/4) of
Section 32, Township 6 North (T6N) , Range 65 West (R65W) , of the Sixth
Principle Meridian (6th P.M. ) , Weld County, State of Colorado, (approxi-
mately County Road 64 and U.S. 85) .
3. Proposal
The proposal is to divide this currently commercially zoned land, approxi-
mately 10.23 acres, into seven (7) lots. The subdivision would plat one
cul-de-sac with a 65' radius and one street, namely 7th Avenue which is
approximately 740' long and at this time has been paved from the cul-de-
sac to County Road 64, providing access from County Road 64 to al.l lots.
The site is currently developed with three existing commercial buildings,
one each on Lot 1 , Lot 5, and Lot 6.
The subdivision would be served by a six inch water line located in
7th Avenue, using North Weld County Water. 1Wo fire hydrants are proposed.
Drainage for this project has been developed on a per site basis using the
100 year storm as design for detention ponds on site and releasing this at
five year historical rate.

GEOLOGIC HAZARD INVESTIGATION
SCOPE
This report will present the results of our geologic hazard investigation
of the Peters Subdivision which is locatedc in Section 32 of Township 6
North, Range 65 West of the 6th Principal Meridian in Weld County, Colora-
do. The purpose of this investigation was to find which, if any, of the
geological hazards identified in H.B. 1041, or in guidelines of the Colo-
rado Geological Survey, are present at this site, and to determine their
effects on the proposed development. Consideration is also given to con-
ditions which can be expected to change with the change in land use.
LOCATION
The approximate 10.3 acre site is located at the north edge of Greeley,
just north of the U.S. 85 ByPass. This location is two miles from down-
town Greeley. The specific location is shown on the accompanying map.
TOPOGRAPHY
The site is gently sloping southeasterly and the surface elevation is
approximately 4,700 feet. The general slope is at 0.8 to 1.0 percent.
GEOLOGY
The surface geology of the area consists of silty sands and gravels
which occupy the Cache La Poudre River Valley. This materials is
generally 15 or more feet in thickness. During excavation, a clay was
encountered in lenses and not consistent throughout. The water table
was not located. The deepest hole was 15 feet.
The bedrock was not encountered and no exposures were observed in the
general vicinity. At this site the bedrock is inferred to be near the
contact between the Pierre Shale and Fox Hills Sandstone as shown on the
accompanying map. The exact location of the contact was not identified
and could vary from that shown.
GEOLOGIC HAZARDS
Geologic hazards are defined by H.B. 1041 as "a geologic phenomenon which
is so adverse to past, current or foreseeable construction or land use as
to constitute a significant hazard to public health and safety or to
property. " Several of the specific hazards usually considered, such as
rock fall , slippage, or creepage, are not applicable to this site because
of the gentle topography.

A. Seismic Acticity - All of Colorado is in Seismic Risk Zone 1 (minor
damage). There is no history or evidence of seismic activity in
this vicinity.
B. Ground Subsidence - There are no sub-surface excavations such as mine
workings known in this area.
C. Water Table - The water table was not encountered in drilling so it
may be said that it was at least 15 feet in depth.
D. Expansive Soil - The clays found at the site have no tendency for
volume change with change in moisture content.
E. Flood Plain - The site is not within any area designated as flood
prone by the U.S. Geological Survey studies of this region.
NATURAL RESOURCES
The site is located in an area having very little potential as a future
source of gravel for use as cement aggregate and road material . There is
now a minimum of 15 feet of overburden over the site which would have to
ion removed. We know of no other economic minerals which may occur below
surface of this site.
CONCLUSIONS
A. This geology of the site is a relatively deep alluvial deposit of
sand and gravel with over 15 feet of silty sand and gravel overburden.
Bedrock was not encountered in drilling.
B. The geologic hazard of this location is limited to a slightly expansive
soil .

We have reviewed the final plat and attendant information on the above
referenced subdivision. In a previous letter dated June 12, 1978, we
indicated that the feasibility of on-lot septic systems should be
determined prior to the approval of the application and that adequate
foundation designs should be obtained from soils engineering work.
Article I, Sections 1 and 3 of the Developmental Covenants address these
concerns. We suggest that these Sections be amended slightly by exchan-
ging the word "shall " for "should" and by requiring the sewage disposal
study prior to construction.
With regard to design of the sewage disposal facilities , we recommend
that the disposal systems not be placed in the detention pond areas
because of possible pollution during periods of heavy runoff. Additionally,
if on-lot leach fields are used, we suggest that service roads or parking
lots not be placed over the fields.
If the above suggestions are followed, we have no objection to the approval
of this application.

We have reviewed the final Plat - Peters Subdivision, located in a portion of the
n of Section 32, Twp. 6N, Range 65W, adjacent to the north side of U.S. Highway
85 bypass north of Greeley.
The comments we made on the review of the preliminary plan suggested that a surface
drainage plan be submitted indicated cross sectioned areas of the proposed drainage
channels. Such a plan was submitted with the final plat, however, the surface drain—
age system has been changed to a detention pond per lot system. The present plan
allows for storm runoff storage and release at a rate of 5 year storm rate. The plan
seems feasible, however, the calculations used to determine required storage per lot
is based on time of concentration ranging 30 to 40 minutes. Our calculations indicate
time of concentration to be in the range of 8 to 15 minutes under ideal conditions. E
shorter time of concentration will create a greater peak flow that will occur sooner
than shown in the proposed plan. This indicates that the capacity of the detention
ponds may need to be enlarged, in this case deepened, to insure adequate storage for
the time needed.
The outlet structures as designed utilize a 4" diameter PVC plastic pipe. The calcu—
lations to determine the pipe discharge utilize a formula and application that is
theoretically accurate, however, inlet losses are not considered and coefficient of
roughness factors are incorrect. Roughness coefficient for. PVC pipe is 0.009. There-
fore, the pipes will discharge larger quantities than shown on the design. (The lack
of consideration of inlet losses will reduce the flow while the incorrect roughness
coefficient will increase the flow resulting in a net increase over that shown on the
design). The retention pond drainage system does exceed design requirements as states
in current county subdivision regulations for storm drainage.
In the review of the preliminary plan a statement was made that a vegetative plan be
made part of the final plan. The final plan includes a statement that each lot owner
will be responsible to vegetate all areas that are not used for buildings or parking.
There is no mention of ground protection during development stage to avoid soil loss
by wind and water erosion. We would like to suggest that at least some consideration
he given to adequate surface roughness to help prevent wind erosion.
Other than the continents above, we can see no reason why the final plat should not be
approved.

As per your request, I have reviewed Peters Subdivision Final Plat.
The drainage plan as designed with lot retention areas is acceptable.
Nevertheless, I suggest that the retention area be graded with a
gradual taper to the outfall structure, rather than a sump arrangement,
to avoid maintenance problems as a result of silting.
The applicant will be required to supply pavement design calculations
before the Engineering Department will consider accepting the road
for maintenance. The design should be based on the subgrade soils
classification and a 10 year projected traffic count. The Weld County
Construction Standards require a minimum of 6 inches of base with a
3 inch asphalt mat for truck traffic. The cross section of the road
should be constructed with 4 foot shoulders, adequate ditches, and
drive culverts. Approval of the final plat should not indicate acceptance
of the road design.
The final plat should show all existing pavement and drainage patterns.

Having reviewed the preliminary plat for the Peters Subdivision ,
the Planning Commission finds that a formal recommendation on the
final plat will not he necessary . In reviewing the materials
transmitted I find no conflict with the preliminary plat, however ,
the proposed roadway width for Seventh Avenue does not appear to
provide sufficient area for movement of emergency vehicles . This
concern was expressed by our fire department and by the Planning
Commission at the time of preliminary review.

We have reviewed the final plat of the Peters Subdivision. We have previously
reviewed the preliminary plat, and our comments were contained in a letter to
you dated June 8, 1978 (copy of which is attached).
We note that on-site retention has been provided under the proposed plan
which would address Item 1 of our previous letter. The cul-de-sac which intruded
on the 15-foot drainage easement, however, has not been relocated. We do note
that a portion of it has been cut off so that it would not intrude on the drainage
and utilities. We have no objections to this if this is the way they want to
handle this.
The final plat does not indicate the location of any buildings ; therefore,
we cannot determine what setbacks or abatement measures have been taken to
minimize noise. We would again emphasize (as we did under Item 2 of our previous
letter) that abatement measures be provided, either by a minimum 100-foot setback
distance from the highway centerline or other measures that the developer may
wish to take, such as walls , earth berms, or noise-insulated construction.

The Colorado Division of Highways has reviewed the Preliminary Plan of the
Peters Subdivision, and we ask your consideration of the following comments.
1. This subdivision was discussed at the March 29, 1978, meeting of the City of
Greeley Administrative Review Team. At that time, the comment was made that
additional runoff attributable to this development should be retained and
released at the historical rate. According to the drainage report provided
for review, on-site detention may be required if additional runoff over-
burdens Eaton Draw. We suggest that on-site detention be provided whether
or not additional runoff overburdens Eaton Draw, since we feel that new
development should adapt to existing drainage facilities whenever possible.
We note that the cul-de-sac, as shown, intrudes on the 15-foot drainage and
utility easement. We suggest that this easement not be encroached upon,
and that the cul-de-sac be constructed outside of this easement. This would
appear to only require the movement of the cul-de-sac for a distance of
three feet.
2. We re-emphasize our comment concerning the need to have a minimum 100-foot
setback distance from the highway centerline in order to provide adequate
protection from highway noise. This distance assumes no other abatement
measures such as wails, earth berms or noise-insulated construction.

Principle Meridian (6th P.M.) , Weld County, State of Colorado.
DESIGN CRITERIA
The "Modified Rational Method" as referred to in a report for the Design of
Retention Facilities as prepared by Frasier & Glider, Inc. of Denver was used
as the basis for this report. The rainfall intensity curves for the Greeley
area were used for the respective design storm frequency and intensities.
These are shown in Exhibit B.
The design requirements include using the 100 year storm frequency as the basis
for design of the retention areas with discharge from these areas to be equal
to or less than the historical runoff for a 5 year storm.
A runoff coefficient of 0.25 was selected for the site under present conditions.
This runoff coefficient reflects the present undeveloped status of this area. A
runoff coefficient of 0.73 was selected for the site when it is fully developed.

deep, Lot 6 being canprised of only 1.81 acres. We cannot recommend this
drainage system as we feel that it would cover too wide an area over an already
existing site.

State of Colorado, being more particularly decribed as "Lot 3" of Peter's
- Subdivision.
DESIGN CRITERIA
The "Modified Rational Method" as referred to in a report for the Design of
Retention Facilities as prepared by Frasier & Glider, Inc. of Denver was used
as the basis for this report. The rainfall intensity curves for the Greeley
area were used for the respective design storm frequency and intensities.
These are shown in Exhibit B.
The design requirements include using the 100 year storm frequency as the basis
for design o€ the retention areas with discharge from these areas to be equal
to or less than the historical runoff for a 5 year storm.
A runoff coefficient of 0.25 was selected for the site under present conditions.
This runoff coefficient reflects the present undeveloped status of this area. A
runoff coefficient of 0.67 was selected for the site when it is fully developed.
