RE: APPROVAL OF LOT SIZE VARIANCE NO. 60 - VINCENT RAUCH AND
ED BOEHM.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 27th day of February, 1978, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Vincent
Rauch and Ed Boehm, which land is more particularly described
as follows:
S1 of the SEA of Section 18, Township 2 North, Range
67 West of the 6th P.M. , Weld County, Colorado
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that said
applicants may make application to the Board of County
Commissioners for a recorded exemption, as set forth in Section
9-4 .A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements , be, and hereby is , granted to Vincent Rauch
and Ed Boehm for the above-described parcel of land.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
February, A.D. , 1978.

RE : Lot Size Variance #60 and Recorded Exemption #305
Dear Commissioners :
The attached application, plat , and related items are in reference to a
request by Mr. Vincent Rauch and Ed Boehm for a lot size variance and
recorded exemption. The parcel of land in question is described as Pt .
SE-14 Section 18, T2N, R67W of the 6th P.M. , Weld County, Colorado. This
property is located adjacent to the north town limits of Firestone on
County Road 20. The property in question contains 79. 82 acres of Class
III and IV irrigated soils and Class IV and VI non-irrigated soils .
The request is to split the property into parcels of 49. 84 acres and
29. 98 acres .
This property was brought to the attention of the Board as a subdivision
violation on March 28, 1977. Having been advised of the circumstances
of the subdivision violation, the Board found that Mr. Rauch did not
intentionally violate the Weld County Subdivision Regulations, and that
legal action against Mr. Rauch would not be taken at that time. Mr.
Rauch was advised to apply for a recorded exemption.
Based upon the information submitted, the above additional information,
and the adopted policies in the County, the Department of Planning Ser-
vices Staff recommends the request be approved for the following reasons :
1 . The proposed split conforms with the intent clause of the
Recorded Exemption Procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricul-
tural District (Section 3. 3a of the Weld County Zoning Reso-
lution) , and the Weld County Comprehensive Plan since the use
would be compatible with the surrounding agricultural uses.
2. The Tri-Area Planning Commission has suggested to deny this
request because it was their feeling that this would open up
this area for further subdivision. However, it should be
noted that if this request is approved, further subdivision
could not occur for a 5 year period or until such time that
an application for a change of zone and subdivision were made.

3. The Town Clerk of Firestone has indicated verbally that no
action has been taken by the town on this request . This
was due, in part , to the fact that no development was antici-
pated with this request .
4. The request complies with the provisions of Section 9-4(A) of
the Weld County Subdivision Regulations.

RESOLUTION
RE : SUBDIVISION VIOLATION OF VINCENT RAUCIH.
WHEREAS , Vincent Rauch is the owner of certain real property
described as the South Half of the Southeast Quarter of Section 18 ,
Township 2 North, Range 67 West of the 6th P .M. , located one (1)
mile North and one (1) mile East of Firestone , approximately , and
WHEREAS , Mr. Rauch has sold a portion of this property cre-
ating a parcel of less than thirty-five (35) acres , and
WHEREAS , under the Weld County Subdivision Regulation, if a
parcel of land is subdivided so as to create a parcel of land of
less than thirty-five (35) acres , then the landowner must follow
the procedures of the Subdivision Regulations unless he is granted
a recorded exemption from the definition of subdivision or sub-
divided land, and
WHEREAS , Mr. Vincent Rauch has neither complied with the Sub-
division Regulations , nor applied for a recorded exemption prior
to creating a parcel of land of less than thirty-five (35) acres ,
thus violating the Weld County Subdivision Regulations , and
WHEREAS , the Weld County Planning Commission has recommended
tc the Board of County Commissioners that legal action be taken in
this matter, and
WHEREAS , the Board of County Commissioners has been advised
of the circumstances , and finds that Mr. Rauch did not intentionally
violate the Weld County Subdivision Regulations, and that the ends
of justice would not be met by prosecution for violation of the
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners , Weld County, Colorado, that no legal action be taken
at this time against Mr. Vincent Rauch for violation of the Weld
County Subdivision Regulations , at least and until Mr. Rauch
has applied for a recorded exemption, and
BE IT FURTHER RESOLVED that Mr. Vincent Rauch shall have
a period of forty-five (45) days in which to apply for said recorded
exemption.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
March , A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 30th day of March, A. D. , 1977 .

the Board of County Commissioners for February 27, 1978, at approxi-
mately 9 : 30 a.m. This meeting will take place in the County Commis- 1
sioners ' Hearing Room, First Floor , Weld County Centennial Center ,
915 - 10th Street , Greeley, Colorado. It is recommended that you
and/or a representative be there to answer any questions the Board
might have with respect to your application .
It is the policy of Weld County to refer an application of this
nature to any town lying within 3 miles of the property in question .
Therefore, I have forwarded a copy of the materials submitted to the
Town of Firestone for their review and comment . According to our
records, the Town of Firestone is scheduled to review and comment
on your application on February 6 , 1978 . Please contact Minnette
Paul with the Town of Firestone at 833-3291 for further details on
the Town of Firestone meeting. I have also forwarded a copy of the
