Existing Public Improvement Map C. Annexation Map Forward: This "annexation impact report" has been prepared pursuant to Section 31-12- 108.5 Colorado revised Statutes, 1986 Repl. Vol. Contained in Exhibit "A" is a map depicting the proposed annexation, the exiting and proposed public services to the property and the exiting and proposed land use for the property. 1. Project Description: The property proposed for annexation consists of one parcel Beginning at the W '/a corner of Section 10, Township 2 North, Range 68 West of the 6th P.M., County of Weld, State of Colorado, thence North 00'38.05" East 808.08 feet along the West line of Section 10: thence South 89°51'48" East 662.23 feet to the East fine of the West half of the Southwest quarter of the Northwest quarter; thence South 00°32'44" West 808.28 feet, more or less, along the East line of the West half of the Southwest quarter of the Northwest quarter of said Section 10 to the South line of the Southwest quarter of the Northwest quarter of said Section 10; thence West along the said South line of the Southwest quarter of the Northwest quarter of said Section 10, 662.32 feet, more or less, to the point of beginning. Adjacent land use to the north is public, south industrial, west residential, and east is a retention pond. 2. Municipal Services: Municipal services for the Brunemeier Annexation will be provided in the following manner: Electricity Telephone Water Sanitary Sewer Fire Electric services are to be provided by either Town of Frederick or United Power U.S. West Communications Left Hand Water District St. Vrain Sanitation Frederick/Firestone fire protection district 3 Police the Town of Frederick Street Maintenance Maintenance of roadways within the annexation will be provided by the Town after construction to Town specifications and acceptance by the Board of Trustees. Financing the municipal services within the area to be annexed is addressed in an annexation agreement between the applicant and the Town of Frederick. The annexation agreement is currently under negotiation and not yet available. 3. Special Districts: The area to be annexed is included within the following special districts: • St. Vrain Valley School District R -1J • Mountain View Fire Protection District • Northern Colorado Water Conservancy District • St. Vrain Sanitation District • Left Hand Water District • High Plains Library • Longmont Conservation The property is to be included in the Carbon Valley Recreation District at the time of annexation. 4. School District Impact: Development is not anticipated at this time. Agricultural zoning is proposed, no immediate impact to the school district. 5. Exhibits: A. 31-12-108.5. Annexation impact report - requirements. (1) The municipality shall prepare an impact report concerning the proposed annexation at least twenty-five days before the date of the hearing established pursuant to section 31-12-108 and shall file one copy with the board of county commissioners governing the area proposed to be annexed within five days thereafter. Such report shall not be required for annexations of ten acres or less in total area or when the municipality and the board of 4 county commissioners governing the area proposed to be annexed agree that the report may be waived. Such report shall include, as a minimum: (a) A map or maps of the municipality and adjacent territory to show the following information: (I) The present and proposed boundaries of the municipality in the vicinity of the proposed annexation; (II) The present streets, major trunk water mains, sewer interceptors and outfalls, other utility lines and ditches, and the proposed extension of such streets and utility lines in the vicinity of the proposed annexation; and (III) The existing and proposed land use pattern in the areas to be annexed; (b) A copy of any draft or final preannexation agreement, if available; (c) A statement setting forth the plans of the municipality for extending to or otherwise providing for, within the area to be annexed, municipal services performed by or on behalf of the municipality at the time of annexation; (d) A statement setting forth the method under which the municipality plans to finance the extension of the municipal services into the area to be annexed; (e) A statement identifying existing districts within the area to be annexed; and (f) A statement on the effect of annexation upon local -public school district systems, including the estimated number of students generated and the capital construction required to educate such students. Based on staff experience, there are clear keys to success. The following is a list of suggestions designed to help you through the application and subsequent review process as quickly and efficiently as possible. Set up an appointment with Town Staff well in advance of submittal. During this initial concept meeting, staff will help you confirm the "big -picture" items, such as zoning, utilities and traffic circulation. It is in your best interest to bring as much information to this meeting as possible related to the nature of the project you are proposing. Town staff can be of great assistance to you, but we need the right information in order to be the most helpful; Once you have the broader issues under control, start to delve into the details of the Town Land Use Code prior to submittal of an application. This suggestion may seem like a given, but typically the most significant project delays occur when a site has to undergo significant redesign because the designer did not consult the regulations first. Town staff is available prior to application submittal to answer questions regarding code provisions that may impact your project; Confusion and subsequent project delay can occur when too many people try to manage the project. Designate a single project manager that will serve as your "point person" throughout the process. This person would ideally be a planner, engineer, or architect with prior knowledge of municipal development review process. Town staff will have one designated planner assigned to your project who will pull in other staff as needed; During your review of the code, take note of provisions that you believe cannot be complied with due to unusual site constraints or other extenuating circumstances, and discuss with staff the potential for a minor modification, waiver or variance prior to application. However, some scheduling components are bound by state statute and local ordinance and are constant as a result. The following schedule is generally what applicants can expect, although finer scheduling details for each project will be addressed by staff directly during pre -application. Projects are reviewed for sufficiency on the first and third Mondays of each month. Projects submitted by 5:00 on the previous Friday will be reviewed for sufficiency and having been found sufficient will enter the development review process. Should Monday be a holiday, projects will be reviewed on Tuesday. Step 6: Staff and Referral Agency Review Period Once an application is submitted, Town staff will perform a "sufficiency review" during which time they take inventory of the contents of the application and ensure that all components have been submitted. Staff may take up to a week to perform this review. At the end of the sufficiency review, staff will make the applicant aware if components of the application are missing or are incomplete. Otherwise, the application can proceed directly to the review process. Town Staff and outside referral agencies have 21 days to review the application, plus 14 days for processing for a total of approximately 5 weeks before initial comments will be available to the applicant. Once the review period has elapsed, staff will compile a "development review committee report" which contains all comments submitted by reviewing agencies. When complete, staff will email the report to the applicant, project manager or other appropriate contact person. After staff submits the report, it is incumbent upon the applicant to make the requisite changes to the plans or other documents, or provide information that may be missing. Staff is available by email, phone or in -person to discuss the comments and help the applicant work through project issues. After the required changes have been made, the applicant must re -submit the plans or other information to staff for another review. Depending upon the nature of the changes, revised plans may be re -submitted via email for review prior to approval (administrative applications) or public hearings (major and minor applications). However, it is possible that re -submittal of full plan sets may be required if revisions are significant. The following are some tips from staff on how to get through this process as quickly and efficiently as possible: Respond to review comments as quickly as possible. This suggestion may seem like a given. However, delayed response to comments is one of the biggest issues that delays projects. Remember, that staff still has to review the resubmittal, and that can take time; 14 Communicate with staff. If your response to staff comments is going to take more time than you anticipated, let us know. This suggestion too, may sound like a given, but there are times that we don't hear from applicants for extended periods of time. Remember that there are strict statutory deadlines relative to the public hearing process and review process in general, and we need to know what your intentions are in order to keep things on track; Plan ahead and be patient. While we would like to, we cannot promise you a next -day turnaround on resubmittals. We are willing to move as quickly as possible in order to reduce processing time, but we may need two or three weeks for subsequent reviews. Based on staff experience, there are clear keys to success. The following is a list of suggestions designed to help you through the application and subsequent review process as quickly and efficiently as possible. Set up an appointment with Town Staff well in advance of submittal. During this initial concept meeting, staff will help you confirm the "big -picture" items, such as zoning, utilities and traffic circulation. It is in your best interest to bring as much information to this meeting as possible related to the nature of the project you are proposing. Town staff can be of great assistance to you, but we need the right information in order to be the most helpful; Once you have the broader issues under control, start to delve into the details of the Town Land Use Code prior to submittal of an application. This suggestion may seem like a given, but typically the most significant project delays occur when a site has to undergo significant redesign because the designer did not consult the regulations first. Town staff is available prior to application submittal to answer questions regarding code provisions that may impact your project; Confusion and subsequent project delay can occur when too many people try to manage the project. Designate a single project manager that will serve as your "point person" throughout the process. This person would ideally be a planner, engineer, or architect with prior knowledge of municipal development review process. Town staff will have one designated planner assigned to your project who will pull in other staff as needed; During your review of the code, take note of provisions that you believe cannot be complied with due to unusual site constraints or other extenuating circumstances, and discuss with staff the potential for a minor modification, waiver or variance prior to application. However, some scheduling components are bound by state statute and local ordinance and are constant as a result. The following schedule is generally what applicants can expect, although finer scheduling details for each project will be addressed by staff directly during pre -application. Projects are reviewed for sufficiency on the first and third Mondays of each month. Projects submitted by 5:00 on the previous Friday will be reviewed for sufficiency and having been found sufficient will enter the development review process. Should Monday be a holiday, projects will be reviewed on Tuesday. Step 6: Staff and Referral Agency Review Period Once an application is submitted, Town staff will perform a "sufficiency review" during which time they take inventory of the contents of the application and ensure that all components have been submitted. Staff may take up to a week to perform this review. At the end of the sufficiency review staff will make the applicant aware if components of the application are missing or are incomplete. Otherwise, the application can proceed directly to the review process. Town Staff and outside referral agencies have 21 days to review the application, plus 14 days for processing for a total of approximately 5 weeks before initial comments will be available to the applicant. Once the review period has elapsed, staff will compile a "development review committee report" which contains all comments submitted by reviewing agencies. When complete, staff will email the report to the applicant, project manager or other appropriate contact person. After staff submits the report, it is incumbent upon the applicant to make the requisite changes to t plans or other documents, or provide information that may be missing. Staff is available by email, phone or in -person to discuss the comments and help the applicant work through project issues. After the required changes have been made, the applicant must re -submit the plans or other information to staff for another review. Depending upon the nature of the changes, revised plans n be re -submitted via email for review prior to approval (administrative applications) or public hear (major and minor applications). However, it is possible that re -submittal of full plan sets may be required if revisions are significant. The following are some tips from staff on how to get through this process as quickly and efficiently possible: Respond to review comments as quickly as possible. This suggestion may seem like a given. However, delayed response to comments is one of the biggest issues that delays projects. Remember, that staff still has to review the resubmittal, and that can take time; r he iay ings as 14 Communicate with staff. If your response to staff comments is going to take more time than you anticipated, let us know. This suggestion too, may sound like a given, but there are times that we don't hear from applicants for extended periods of time. Remember that there are strict statutory deadlines relative to the public hearing process and review process in general, and we need to know what your intentions are in order to keep things on track; Plan ahead and be patient. While we would like to, we cannot promise you a next -day turnaround on resubmittals. We are willing to move as quickly as possible in order to reduce processing time, but we may need two or three weeks for subsequent reviews. Remember that the review period dictated by the code is no less than 21 days, and we may need all of that time, so please account for this time in your project schedule and try to address as much as possible prior to submittal of the application. Step 7: Public Hearing Scheduling and Notification Some applications are "administrative" meaning that they can be approved at staff level and do not require public hearings. "Major" and "Minor" applications are required to go before the Planning Commission first and then to the Board of Trustees for final approval, so time for thesepublic hearings . g must be built into the project schedule. Annexations are "major" applications, but according to state law must go before the Board of Trustees first, then to the Planning Commission and back to the Board for final approval. The following time constraints apply and must be accounted for in the l roject schedule: project The Planning Commission meets on the 2nd and 4th Tuesdays of every month; The Board of Trustees meets on the Pt and 3rd Tuesdays of every month; Typically, development review comments must be satisfied prior to scheduling of public hearings; Notice of public hearing must be given by the applicant 15 days in advance of the hearing; g Planning Commission and Board of Trustee hearings for the same project are not typically held in Yp Y back-to-back weeks because it does not give staff enough time to prepare the relevant materials, so allow for 21 days between hearings.
