HomeMy WebLinkAbout20170037.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 9, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 9, 2017, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly El MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of January 4, 2017, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Kirkmeyer moved to approve the Certification of Hearings conducted on January 4, 2017, as follows: 1) COZ16-0003 — Jacob and Laura Owen, and 2) RES16-0001 — Jacob and Laura Owen. Commissioner Conway seconded the motion, which carried unanimously. Ei AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and upon a roll call vote the motion passed three to one, with Commissioner Conway opposed and Commissioner Moreno excused. PRESENTATIONS: El 1) RECOGNITION AS RECIPIENT OF 2016 ROCKY MOUNTAIN ASSOCIATION OF FAIRS, FAIR MANAGER OF THE YEAR - JANET KONKEL: Chair Cozad read the certificate for the record recognizing Ms. Konkel's accomplishments as the Fair Board Manager. Ms. Konkel displayed the several awards won by the Fair Board. Each one of the Commissioners congratulated Ms. Konkel and expressed their appreciation for all those that organized the successful event. (Clerk's Note: the Board paused for a photo opportunity.) ki 2) RECOGNITION BY AMERICAN CONCRETE PAVEMENT ASSOCIATION FOR WORK ON COUNTY ROAD 49 PARKWAY PROJECT - MIKE BEDELL - DEPARTMENT OF PUBLIC WORKS: Chair Cozad presented the plaque awarded to Mike Bedell of the Department of Public Works. Mr. Bedell thanked the Board for the recognition, and Don Dunker thanked Mr. Bedell for all his work on this project. Each one of the Commissioners congratulated Mr. Bedell for receiving the award and expressed their pride in the Public Works Department. (Clerk's Note: the meeting was paused for a photo opportunity.) • 3) 2016 PARTNERSHIP AWARD, COLORADO WEED MANAGEMENT ASSOCIATION - TINA BOOTON: Chair Cozad read the certificate for the record recognizing Ms. Booton for her hard work. Jay McDonald, Director of Department of Public Works, stated he is proud of the work that Ms. Booton does for the County. Each one of the Commissioners congratulated her on her successful partnerships within the County and all the work she does for the citizens of the County. (Clerk's Note: the Board paused for a photo opportunity.) Chair Cozad stated she is proud of all the Weld County staff. ei PUBLIC INPUT: No public input was given. BIDS: 1) PRESENT BID #B1600189, ROOF REPLACEMENT (JAIL SECTION) - DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, presented the seven (7) bids received and stated staff will bring back a recommendation on January 23, 2017. • 2) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (E1/2 SW1/4 NE1/4, S24, T3N, R63W): Barb Connolly, Controller, presented the two (2) bid amounts submitted for the 10 acres, the first amount was $1,200.00 per acre and the second was $600.00 per acre. Rick Rowe, representative of Verdad Resources, LLC, increased his offer to $1,250.00 per acre and Tyler Hammond, representative of Kerr-McGee Oil and Gas Onshore, LP, increased the bid to $1,500.00 per acre. The winning bid was from Mr. Rowe in the amount of $1,550.00 per acre. Commissioner Kirkmeyer moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. (Clerk's Note: The audio record reflects discussion concerning ten (10) acres; however, the associated legal description and paperwork was actually for 20 acres, which resulted in an incorrect calculation of the bonus amount. A refund was subsequently issued to Verdad to correct the error.) • 3) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN (N1/2 S1/2 NW1/4 NE1/4, S24, T3N, R63W): Ms. Connolly presented the amounts of the bids received. Mr. Rowe, representative of Verdad Resources, LLC, offered the amount of $1,250.00 per acre. Commissioner Kirkmeyer moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. The motion was seconded by Commissioner Freeman, and it carried unanimously. 5) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN (S1/2 NE1/4 SE1/4, S24, T3N, R63W): Ms. Connolly reviewed the amounts submitted from the two bidders. Mr. Rowe stated Verdad Resources, LLC, will pay $1,250.00 per acre. Commissioner Kirkmeyer moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. El 6) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN (NW1/4 NW1/4 SE1/4, S24, T3N, R63W): Ms. Connolly presented the amounts submitted from the two (2) bidders. Mr. Rowe offered the amount of $1,250.00 on the behalf of Verdad Resources, LLC. Commissioner Conway moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. 7) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN (SW1/4 NW1/4 SE1/4, S24, T3N, R63W): Ms. Connolly reviewed the bids submitted. Mr. Rowe offered $1,250.00 per acre. Commissioner Kirkmeyer moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. El 8) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN (NE1/4 SW1/4 SE1/4, S24, T3N, R63W): Ms. Connolly stated there are two (2) bidders present. Verdad Resources, LLC, offered $1,250.00 per acre. Commissioner Conway moved to accept the bid, approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. Minutes, January 9, 2017 Page 3 2017-0037 BC0016 NEW BUSINESS: 1) CONSIDER VETERANS SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION OF PAY FOR NOVEMBER, 2016, AND AUTHORIZE CHAIR TO SIGN: Wendy Bailey, Veterans Office, presented the report for the month of November, 2016. Commissioner Kirkmeyer moved to approve report and certification for pay for November, 2016, and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. le 2) CONSIDER CONTRACT ID #959 APPLICATION FOR 2017 EMERGENCY MANAGEMENT PERFORMANCE GRANT AND AUTHORIZE CHAIR TO SIGN: Roy Rudisill, Director of the Office of Emergency Management, reviewed the details of the grant to help support the County Emergency Management Program with a total requested amount of $129,338.25. Commissioner Kirkmeyer moved to approve said application and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. ei 3) CONSIDER COMMUNITY DEVELOPMENT BLOCK GRANT AGREEMENT FOR DISASTER EMERGENCY FUNDS (CDBG-DR) AND AUTHORIZE CHAIR TO SIGN: Mr. Rudisill presented the grant for the amount of $742,640.90. In response to Commissioner Conway, Mr. Rudisill stated these projects were the result of the 2013 Flood and most of the projects have been completed. Commissioner Kirkmeyer moved to approve said grant and authorize the Chair to sign. Commissioner Conway seconded the motion, and it carried unanimously. El 4) CONSIDER WORK ORDER FORM (FLOOD REPAIRS - EM-BR53-58A) PURSUANT TO AGREEMENT FOR FINAL DESIGN OF REPLACEMENT OF BRIDGE AND AUTHORIZE CHAIR TO SIGN - ATKINS NORTH AMERICA, INC: Clay Kimmi, Department of Public Works, presented the work order for the final design on the Kersey bridge that was damaged in the Flood of 2013. Commissioner Kirkmeyer moved to approve said work order and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. 5) CONSIDER REAPPOINTMENT OF RON BLAND TO GREELEY-WELD COUNTY AIRPORT AUTHORITY BOARD: Commissioner Conway moved to approve said reappointment. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. El 6) CONSIDER REAPPOINTMENTS TO WELD COUNTY BUILDING CODE BOARD OF APPEALS: Commissioner Freeman moved to approve said reappointments. Seconded by Commissioner Conway, the motion carried unanimously. El 7) CONSIDER REAPPOINTMENT TO FEDERAL MINERAL LEASE DISTRICT BOARD OF DIRECTORS: Commissioner Conway moved to approve said reappointment. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. OLD BUSINESS: El 1) CONSIDER PETITION FOR VACATION OF A PORTION OF CR 118 AND CRS 81 AND 87 - JAMES KONIG (CON'T FROM 11/21/2016): Frank Haug, Assistant County Attorney, presented a request to vacate approximately three (3) miles of right-of-way, and this was continued from November 21, 2016, due to a request from the Board to look at various options to assist Mr. Konig. Dan Holmes, from the Department of Public Works, conducted a survey and found the garage is six (6) feet in the right-of-way. Mr. Haug presented the options for the Board to consider and explained after the garage was built staff found out it was located within the right-of-way. a Tiffane Johnson, Department of Public Works, pointed out the roads that are located closest to the property and the roads which are maintained by the Minutes, January 9, 2017 Page 4 2017-0037 BC0016 County. aIn response to Chair Cozad, Mr. Haug clarified the owner of the parcel to the north is also Mr. Konig and suggested, as a third option, a portion of the right-of-way could be vacated. Chair Cozad stated she would like to vacate a ortion of the road so the applicant is in compliance and doesn't have to go the Board of Adjustment. U. John Foster, resident of Grover, stated the Konigs and he are the only ones that use County Road 118 and there isn't any oil and gas activity at the present time. He explained he spoke with surroundin• •roperty owners who would like to not have the encumbrance of a road going through the property. M. In response to Commissioner Kirkmeyer, Bruce Baker, County Attorney, explained that the mineral rights cannot be reserved on a vacation so the County won't be able to preserve mineral rights. Commissioner Freeman moved to approve the petition for a vacation of road Right -of -Way. The motion, which was seconded by Commissioner Conway, carried unanimously. Mr. Foster thanked staff for working with him on this matter. (Clerk's Note: the following two (2) items were not listed on the Agenda.) Brett Eckelkamp, representative from Congressman Ken Buck's office, introduced himself to the Board and stated he looks forward to working with the Commissioners. Each one of the Commissioners thanked him for representing the Board and Weld County. ei Chair Cozad stated anytime there is a roll call vote, especially on the Consent Agenda, she would like a reason for why the vote was requested for the record. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
