HomeMy WebLinkAbout20173321.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO SEPTEMBER 25, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 25, 2017, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of September 20, 2017, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Kirkmeyer moved to approve the Certification of Hearings conducted on September 20, 2017, as follows: 1) 1MJUSR17-16-0029 — Reynoldo Bonilla, 2) Certificate of Designation — CH2E Colorado, LLC, and Hudson Tireville, LLC, and 3) PUDZ17-0004 — Union Farms Development, LLC. Commissioner Freeman seconded the motion, which carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. e CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PROCLAMATIONS: 1) RAILROAD SAFETY WEEK, SEPTEMBER 25 - 29, 2017: Chair Cozad read the proclamation supporting the importance of educating the public to achieve a greater safety awareness, regarding railroad safety. Mike McCoy, representative of Operation Lifesaver, reported Weld County has nearly 300 railroad crossings, and 10% of the State of Colorado's crossings are located in Weld County. He stated the obvious goal is to have zero incidences and talked about the different locations they have visited to bring awareness to the public. He made a request to put the cellphones away and pay more attention at IO1S/I"1 Minutes, September 25, 2017 Page 1 2017-3321 BC0016 railroad crossings. Mr. Jankowski stated Weld County has the highest incidences in the State of Colorado. He stated they will be talking to the citizens of the County to make the community safer. Each one of the Commissioners thanked them for bringing this important safety issue to the public. In response to Commissioner Kirkmeyer, Mr. McCoy explained the statistics are available on the Federal Railroad Administration website. Commissioner Kirkmeyer stated the County is working to close eleven (11) crossings to make the U.S. Highway 85 Corridor safer. (Clerk's Note: The Board paused the meeting for a photo opportunity.) Fri PUBLIC INPUT: No public input was given. BIDS: El 1) PRESENT BID #B1700132, ROOF TOP UNIT REPLACEMENT (SWW) - DEPARTMENT OF BUILDINGS AND GROUNDS: Rob Turf, Department of Purchasing, presented the two (2) bids received and stated staff will bring back a recommendation on October 9, 2017. In response to Commissioner Conway, Toby Taylor, Director of the Department of Buildings and Grounds, confirmed the bids are under the projected budget. NEW BUSINESS: El 1) CONSIDER VETERANS SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION OF PAY FOR AUGUST, 2017, AND AUTHORIZE CHAIR TO SIGN: Deon Harris, Veterans Office, reviewed the details of the report for the month of August, 2017. Commissioner Conway moved to approve said report and certification of pay for August, 2017, and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. 2) CONSIDER CONSTRUCTION AGREEMENT FOR GOVERNMENTAL ENTITIES AND ELECTRIC CONTINGENCY LIST FOR NUNN GRADER SHED AND AUTHORIZE CHAIR TO SIGN — XCEL ENERGY: Mr. Taylor presented the agreement which will allow Xcel Energy to install power to the Nunn Grader Shed. Commissioner Freeman moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 3) CONSIDER CONTRACT ID #1459 INTERGOVERNMENTAL AGREEMENT FOR A CNG FUELING STATION AND AUTHORIZE CHAIR TO SIGN: Jim Flesher, Department of Public Works, reviewed the terms of the Intergovernmental Agreement to the expand the CNG Fueling site. In response to Commissioner Conway, Elizabeth Relford, Department of Public Works, explained the reason for wating to take action on the approval of the agreement was to await pending action on the MPO. Commissioner Kirkmeyer moved to approve said intergovernmental agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. 4) CONSIDER CONTRACT ID #1444 AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY FOR CERTAIN IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS - VIRTUS AND AMY JO BANOWETZ: Cameron Parrott, Department of Public Works, presented the agreement for the total amount of $22,000.00. Commissioner Conway moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. El 5) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON CR 57 AT CR 20: Mr. Parrots reviewed the details for the installation of two Stop signs along County Roads (CR) 57 and 20 to stop traffic in the north and southbound direction of the intersection. He stated both roadways are classified as gravel roads and CR 57 is not maintained by Weld County, north of the intersection. He Minutes, September 25, 2017 Page 2 2017-3321 BC0016 reported there is an obstructed view to the east for northbound traffic. In response to Commissioner Kirkmeyer, Mr. Parrott explained the request came from staff. Commissioner Kirkmeyer moved to approve said installation of traffic control devices, which was seconded by Commissioner Freeman. After further discussion and concerns about putting a traffic control device on a road that isn't County maintained, Commissioner Kirkmeyer stated she would like to continue this matter to have a work session and be able to review the details. Commissioner Kirkmeyer moved to amend the previous motion to continue this matter to October 9, 2017. Seconded by Commissioner Conway, the motion carried unanimously. 6) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES WITHIN VANTAGE ACRES SUBDIVISION ON 197TH WAY AND VANTAGE DRIVE AT 195TH AVENUE: Mr. Parrot presented the request from the residents to install two (2) Stop signs on the local gravel roadway. Commissioner Kirkmeyer requested clarification for the roads, asking if they are County maintained roads. She stated she wanted staff to be sure that the County has ownership of the road and would like to continue this matter. Commissioner Kirkmeyer stated when the subdivision was created there were Conditions of Approval put in place, and she is sure the Board did not agree to maintain the roads. Commissioner Kirkmeyer moved to continue said matter to October 9, 2017. Seconded by Commissioner Conway, the motion carried unanimously. PLANNING: El 1) CONSIDER VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1399 - RONALD AND JAMIE SISNEROS: Michael Hall, Department of Planning Services, stated the applicants were administratively approved on July 31, 2017, for a two (2) Lot Recorded Exemption. He explained the applicants requested a complete vacation of USR-1399, on Lot A of Corrected Recorded Exemption, RE -1822, because both Lots A and B will have one (1) single-family dwelling. He presented photos displaying the location and details of the property, and discussed the background of the USR. In response to Commissioner Kirkmeyer, Mr. Hall stated the proposed acreages for Lot A are 2.5 acres and Lot B is 6.5 acres and the Recorded Exemption meets the provisions in the Code. Mr. Hall made known that both lots are not eligible to be split again. Jamie Sisneros, applicant, stated they have had two (2) houses on the separate lots for about fourteen (14) years. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve said vacation of Use by Special Review Permit, USR-1399. The motion, which was seconded by Commissioner Conway, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
