RESOLUTION
RE: APPROVAL OF AMENDMENT TO SUPPLEMENTAL AGREEMENT TO SANITARY
LANDFILL CONTRACT AND AUTHORIZATION FOR CHAIRMAN TO SIGN
THE SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a certain agreement entitled Supplemental Agree-
ment to Sanitary Landfill Contract was entered into between
Weld County, Colorado and Colorado Landfill, Inc. on the 25th day
of July, 1979, and
WHEREAS, it has come to the attention of the parties that
there is an error in the replacement paragraph of paragraph 27 ,
page 2 of said agreement, and
WHEREAS, an Amendment to the Supplemental Agreement has been
presented to the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners deems it advisable
to approve said Amendment to the Supplemental Agreement to Sani-
tary Landfill Contract.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Amendment to Supple-
mental Agreement to Sanitary Landfill Contract be, and hereby is,
approved and further the Chairman of said Board is hereby authorized
to sign the same.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
September, A.D. , 1979.

AMENDMENT TO SUPPLEMENTAL AGREEMENT
TO
SANITARY LANDFILL CONTRACT
AMENDMENT TO SUPPLEMENTAL AGREEMENT, made and entered into
this 10th day of September , 1979, by and between WELD
COUNTY, COLORADO, hereinafter referred to as "County" and COLORADO
LANDFILL, INC. , a Colorado corporation, hereinafter referred to
as "Landfill."
WHEREAS, a certain agreement entitled Supplemental Agreement
to Sanitary Landfill Contract was entered into between the parties
hereof on the 25th day of July, 1979, and
WHEREAS, it has come to the attention of the parties that
there is an error in the replacement paragraph of paragraph 27,
page 2 of said agreement.
NOW, THEREFORE, that Agreement dated the 25th day of July,
1979 and entered into between Weld County, Colorado and Colorado
Landfill, Inc. shall be, and hereby is , corrected and changed in
the following respects only:
By eliminating and striking out in the replacement para-
graph to paragraph 27 on page 9 of the Sanitary Landfill Contract
such paragraph appearing on page 2 of the Supplemental Agreement
to Sanitary Landfill Contract the word "$4000, 000. 00" and
inserting in its place "$400, 000. 00" so that such paragraph shall
state as follows :
"Landfill" shall furnish the "county" a certifi-
cate evidencing that it has and in force liability
insurance with the following minimum amounts :
$150, 000. 00 liability per person, $400, 000. 00
per accident, and $25, 000. 00 property damage,
for the period of this Agreement. In addition,
to insure performance of this contract, "Land-
fill" shall give a License of Performance Bond
or mutually acceptable letter of credit in the
amount of Fifty Thousand Dollars ($50, 000. 00)
guaranteeing that "Landfill" will meet the re-
quirements of this Agreement. It is agreed that
the liability insurance requirements can be
reviewed annually at the same time the rate
structure is reviewed. "
IN WITNESS WHEREOF, the parties hereto have hereunto exe-
cuted this Amendment to Supplemental Agreement and have hereunto
set their hands and seals the day and year first above written.

IN-FURTHERANCE CERTIFICATE
1 . That the Board of County Commissioners of
Weld County , Colorado , constitutes the governing authority
exercising jurisdiction over the subject matter herein .
2 . That Colorado Landfill , Inc . has notified
the Board of County Commissioners of Weld County , Colorado ,
that it intends to close certain landfill and dump sites ,
to upgrade equipment and facilities , and to designate a regional
Erie-Fort Lupton landfill site in order to comply with the
contract dated June 6 , 1979 , between Weld County , Colorado ,
and Colorado Landfill , Inc . , and the Resource Conservation and
Recovery Act of 1976 ( P . L . 94-580) .
3 . That Colorado Landfill , Inc . is the only certified
operator to operate dumps and landfills in Weld County , Colorado .
4 . That certification of the Erie-Fort Lupton landfill ,
continued operation of the Greeley-Milliken site , upgrading of
equipment and sites and closing existing area landfills is in
furtherance of the purpose of preventing , reducing , abating and
controlling air and water pollution or contamination by removing ,
disposing , and storing pollutants on property used for the collection ,
storage , treatment , packing and final disposal of solid wastes ,
all in order to comply with local , county , and state regulations ,
including the Recourse Conservation and Recovery Act of 1976 .
This does not modify the responsibility of Colorado Landfill , Inc .
to comply with all applicable local , state and federal regulations ,
nor shall this certification be construed as a permit or
certification from the Board of County Commissioners of Weld
County , Colorado , to construct or to operate the facilities .
5 . That certification is given solely and only for
the purpose of certifications required under Section 1 . 103—
( 2 ) ( 1 ) ( b) of Federal Income Tax Regulations , (26 CFR Part 1 ) ,
and shall not be construed to be a certification or permit
with respect to any other local , state or federal law , statute ,
ordinance or regulation .
IN WITNESS WHEREOF , this certificate is officially
signed at Greeley , Colorado , this 5th day of September
19 79 .
