RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR17-0043, FOR MINERAL RESOURCE DEVELOPMENT INCLUDING ASPHALT
AND CONCRETE BATCH PLANTS, MATERIALS PROCESSING (CRUSHING AND
SCREENING), MATERIAL STOCK PILES, AN OFFICE, A SHOP, AND OUTDOOR
TRUCK AND EMPLOYEE PARKING IN THE A (AGRICULTURAL) ZONE DISTRICT -
CACTUS HILL RANCH COMPANY, CIO SIMON CONTRACTORS, INC.
A public hearing was conducted on October 25, 2017, at 10:00 a.m., with the following present:

Commissioner Steve Moreno, Pro-Tem
Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer - EXCUSED

The following business was transacted:
I hereby certify that pursuant to a notice dated September 15, 2017, and duly published
October 20, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request
of Cactus Hill Ranch Company, do Simon Contractors, Inc., for a Site Specific Development Plan
and Use by Special Review Permit, USR17-0043, for Mineral Resource Development including
Asphalt and Concrete Batch Plants, materials processing (crushing and screening), material stock
piles, an office, a shop, and outdoor truck and employee parking in the A (Agricultural) Zone
District. Bob Choate, Assistant County Attorney, made this a matter of record.
El Chair Cozad allowed Sue Lake to come forward prior to public input. She requested a
hearing device.
Chair Cozad reviewed, for the applicant and the public, the procedures to follow should this
case result in a tie vote due to four Commissioners being present and one Commissioner
excused.

Kim Ogle, Department of Planning Services, stated the applicant is requesting a continuance
to November 8, 2017, to allow time to schedule a community meeting to address the concerns of
the neighbors within one mile.
Anne Best Johnson offered to hold a second surrounding property owner (SPO) open house
early next week and extend the invitation to those within one mile of the site.

▪ Linda Tufts, SPO, stated her concern with the neighborhood meeting is that there are several
in attendance whose residences fall outside the one mile notification area. Chair Cozad
encouraged those in attendance to speak to the applicant's representative to ensure they are
invited.
m Laura Doyle, SPO, stated she agrees with the continuance and spoke on behalf of two other
property owners that want to be in attendance. She further requested the applicant stop using her
address for their delivery items, as she is a nurse and has been woken up 21 days in a row for
deliveries that are for the applicant.
Christian Schulte, attorney, representing an adjacent landowner, requested clarification
regarding the date and the time.
TA Tom Moore, K&M Company, stated he has a farm adjacent to the site and he appreciates
the continuance to allow all five Commissioners to be present and he hopes the neighbors will be
present again for the continuance.
Laura Doyle, SPO, spoke again and requested the traffic study be reconsidered based on
an increase of oil and gas traffic.
▪ Wendell Brown, SPO, stated he will be out of town for the next meeting and he wants it on
the record that he is present today and he is opposed.
▪ Mr. Schulte spoke again and stated his client, Mr. Moore, has a scheduling conflict and
would request a date outside November 8-13.
After further discussion, and a brief recess, the Board agreed to continue the matter to
Monday, November 6, 2017, at 10:00 a.m.
CI Commissioner Conway moved to continue the request of Cactus Hill Ranch Company, c/o
Simon Contractors, Inc., for a Site Specific Development Plan and Use by Special Review Permit,
USR17-0043, for Mineral Resource Development including Asphalt and Concrete Batch Plants,
materials processing (crushing and screening), material stock piles, an office, a shop, and outdoor
truck and employee parking in the A (Agricultural) Zone District, to Monday, November 6, 2017,
at 10:00 a.m., to allow time for a second meeting with surrounding property owners. The motion
was seconded by Commissioner Moreno, and it carried unanimously. There being no further
discussion, the hearing was completed at 11:18 a.m.
