HIGHLAND FARMS HOMEOWNERS ASSOCIATION
A public hearing was conducted on April 26, 2017, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 16, 2017, and duly published
March 21, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request
of Highland Farms Homeowners Association, to Amend Change of Zone, PUDZ17-0001, to replat
Tract D of Highland Farms PUD (PZ-1045) to create one (1) additional residential lot and reduce
open space on Tract D to 8.054 acres. Bob Choate, Assistant County Attorney, made this a
matter of record.
El Chair Cozad reviewed the procedures should this case result in a tie vote due to four
Commissioners being present and one Commissioner excused.
El Chris Gathman, Department of Planning Services, presented a summary of the proposal to
amend the Highland Farms Homeowners Association's Planned Unit Development (PUD);
originally approved under PZ-1045. They want to divide Tract D to create one additional
residential lot, thereby, reducing the total Common Open Space. He stated this case is being
processed in conjunction with PUDF17-0001, which will be administratively reviewed.
Mr. Gathman noted there is an existing oil and gas production facility on the site, and the proposed
residential lot will use an existing access point along Highland Way. He stated the site is located
just south of Highway 52 and approximately 600 feet east of County Road (CR) 3. He explained
the applicant meets the common open space requirement of 15% percent. The site is located
within the three (3)mile referral area of the Towns of Dacono, Erie and Frederick. Mr. Gathman
reported the water will be provided by the Left Hand Water District. A total of 19 referrals were
sent out and seven (7) were received, including a letter from the neighbor across Highway 52

requesting language be added to the PUD stating there may be a need for traffic signals in the
future. Mr. Gathman displayed photos of the site and entered the favorable recommendation of
the Planning Commission into the record as written.
Janet Lundquist, Department of Public Works, provided a brief overview of the transportation
plans and requirements. Ms. Lundquist explained there is a private road and access that is not
maintained by the County. She stated staff has requested that the applicant show proof of the
access permit and there will be no tracking control or maintenance agreement. In response to
Commissioner Conway, Ms. Lundquist stated the Colorado Department of Transportation (CDOT)
would depend on the County or other municipality's agreements to keep up with maintenance.
Hayley Balzano, Planning Services Engineer representative, presented the drainage and
grading requirements. She stated staff will recommend two (2) notes for the plat.
Fi Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions. She stated water will be provided by the Left Hand Water District and referred to
Condition of Approval (COA) #1.C.11 that basically reminds the applicant to not plant on top of
the septic system.
• Kirby Smith, Highland Farms Homeowners Association representative, explained the
reasons why the HOA wants to split the lot.
El Chris Crotzer, representative of Highland Farms Homeowners Association, iterated what
was said by Mr. Smith and stated it is important to the Association to find ways to save the
homeowners money.
• In response to Chair Cozad, Mr. Smith indicated he has reviewed, and agree to abide by,
the Conditions of Approval, as amended.
• Commissioner Kirkmeyer moved to approve the request of Highland Farms Homeowners
Association to Amend Change of Zone, PUDZ17-0001, to replat Tract D of Highland Farms PUD
(PZ-1045) to create one (1) additional residential lot and reduce open space on Tract D to 8.054
acres, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval as amended and entered in the record. The motion was seconded by
Commissioner Conway, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:30 a.m.
