RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR15-0008

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 29, 2015, the Board did approve the request of
Doug and Dawn Detienne, do West Greeley Self Storage, for a Site Specific Development Plan
and Use by Special Review Permit, USR15-0008, for a Site Specific Development and Use by
Special Review Permit for any Use Permitted as Use by Right, an Accessory Use, or a Use by
Special Review in the Commercial or Industrial Zone Districts (mini -storage and outside RV and
boat storage) provided that property is not a lot in an approved or recorded subdivision plat or
part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A
(Agricultural) Zone District, on the following described real estate, to -wit:
Subdivision Exemption, SUBX14-0024; being part of
the SE1/4 of Section 12, Township 5 North, Range
67 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, Doug and
Dawn Detienne, represented by Ryan Kacirek, Tetra Tech, 1900 South Sunset Street, Suite 1-E,
Longmont, Colorado 80501, to partially vacate Use by Special Review Permit, USR15-0008, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, conditional
upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special Review
Permit, USR15-0008", conforming to Section 23-2-260.D of the Weld
County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR15-0008, be, and hereby is, partially
vacated, with the abovementioned condition, with said plat to be titled and recorded as Partial
Vacation of Use by Special Review Permit, USR15-0008.

Partial vacation of USR15-0008 - RV Storage

The Department of Planning Services received the attached letter on January 13, 2017 from
Ryan Kacirek of Tetra Tech c/o Doug and Dawn DeTienne that request a partial vacation for
USR15-0008. The applicants have submitted a recorded exemption application to split the
parcel on which the USR15-0008 is located. USR15-0008 will remain on Lot B of RECX17-
0011 and be removed from Lot A of RECX17-0011. If this partial vacation is approved the
applicant will need to submit a revised USR map for USR15-0008 per Section 23-2-280 of the
Weld County Code.
The Department of Planning Services is recommending approval of this partial vacation.

Ms. Michelle Martin:
Tetra Tech is submitting this request for a partial vacation of USR15-0008 on behalf of Dawn DeTienne
and Doug DeTienne. Dawn DeTienne and Doug DeTienne propose to vacate a portion of parcel number
0957 12 100047 (subject property) from USR15-0008. USR15-0008 allows for development of a self -
storage facility and outside storage of boats and RVs. Currently the southern portion the USR has been
developed in accordance to the USR and is occupied by West Greeley Self Storage, a business owned
by Dawn DeTienne and Doug DeTienne. The northern portion is undeveloped and unoccupied.
In order to facilitate the partial vacation of the USR, the applicants are submitting three concurrent
applications. Concurrent applications include an amended Recorded Exemption for the property directly
to the west (parcel number 095712100049), an amended Subdivision Exemption and a recorded
exemption for the subject property. The amended Recorded exemption and the amended Subdivision
Exemption are proposed to shift a portion of the boundary line between the subject properties. Both
properties are owned by Dawn DeTienne and Doug DeTienne.
The Recorded Exemption will divide the subject property into Lot A and Lot B. Lot A will become the
northern lot and Lot B will become the southern lot. The dividing line for the Recorded Exemption falls
along a proposed access to 95th street. This access was established through the USR process in
cooperation with the City of Greeley. Lot A, as established by the proposed Recorded Exemption, will be
the portion of the property vacated from USR15-0008. The USR will remain entirely within Lot B.
The applicant is proposing to vacate Lot A from USR15-0008 to facilitate estate planning activities.
Currently the portion of the subject property established as Lot A by the Recorded Exemption is not used
by West Greeley Self Storage facility.
