RESOLUTION
RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 34 : 78 :3 FOR HORSE
STABLES AND A SINGLE FAMILY RESIDENCE ON A TRACT OF LAND
LOCATED IN PART OF SECTION 15 , TOWNSHIP 1 NORTH, RANGE 68
WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 8th day of May, 1978 at the
hour of 9 :oo o ' clock a.m. for the purpose of hearing the applica-
tion of Robert Meddles for the granting of a Conditional Use Permit
for horse stables and a single family residence on the following
described real estate, to-wit :
Beginning at a point on the West Sec. line of Sec. 15,
T 1 N, R 68 W of the 6th P.M. which is 3,305.44 feet
North of the Southwest corner of Sec. 15; thence North
along the West Sec. line 661.13 feet; thence S 89°59' E
2,689.03 feet; thence S 44°24'E, 7.58 feet; thence S
0°13'52" W, 660.23 feet; thence N 89°53'15" W, 2,692.34
feet to the point of beginning. Except the West 30 feet.
All being in Sec. 15, T 1 N, R 68 W of the 6th P.M. , Weld
County, Colorado.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of
the Conditional Use Permit for horse stables and a single family
residence, and
WHEREAS, Section 3 . 3.D. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural District on the grant of
a Conditional Use Permit by the Board of County Commissioners , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits and
evidence presented in this matter, and having been fully informed
and satisfied that the request for a Conditional Use Permit for
horse stables and a single family residence on the hereinabove

described real estate, complies with all of the conditions as set
out in Section 3 . 3 .D. (2) of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of Robert
Meddles for a Conditional Use Permit for horse stables and a single
family residence on the hereinabove described tract of land, be,
and hereby is, granted, subject to the development standards con-
tained in the Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the reasons for approval contained in
the Planning Commission Recommendations dated May 2 , 1978 be, and
hereby are., incorporated as the findings of fact of the Board of
County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
May, A.D. , 1978 .

1. It is the opinion of the Planning Commission that this request

P.C . RECOMMENDATION
May 2 , 1978
"The Planning Commission and Board of County Commissioners
shall consider the following in making their determination
in approving or denying a Conditional Use Permit :
Compatibility with the surrounding area, harmony with the
character of the neighborhood and existing agricultural
uses , need for the proposed use, its effect upon the
immediate area, its effect on future development of the
area and the health, safety, and welfare of the inhabitants
of the area and the County. "
This determination is based upon the following:
A. This request is to establish an agriculturally related
enterprise in the Agricultural Zone District in an area
where the surrounding land uses are predominantly agricultural.
B. The addition of one single-family residence and horse
training stable and facilities on the property in question
will be compatible with the surrounding agricultural uses.
C. The Dacono area Fire Protection District has indicated that
they have no objections to this request ,
D. The Boulder Valley Soil Conservation District has
indicated that in reviewing this request no conflict with
their interests were found.
E. The Colorado Geological Survey has no objection to the
approval of this request . They indicated that the geologic
conditions are generally suitable for the proposed land use.
F. The Weld County Engineering Department has indicated that
they have no problems with this request .
G. The Town of Erie Planning Commission has indicated that they
have no objections to this request .
H. The Weld County Health Department has indicated they have
no problems with this request provided the applicant complies
with their recommendation as outlined in their letter dated
April 6, 1978.
I. The applicant has submitted a petition form signed by seven
of the surrounding property owners in support of the request .
To date, none of the other property owners in the area have
indicated any opposition to the request .
In addition, the Planning Commission recommendation for approval is
subject to the following conditions:
A. The following note as found on the CUP plat being deleted:
"No permanent structures or landscaping to be located
within 25 feet of the community ditch R.O.W. "
This note has been amended and incorporated into the
Development Standards .

B. The attached Development Standards being recommended
and approved for the CUP area.
C. No building or electrical permits for any structure
shall be issued on the CUP area until the Development
Standards for the CUP have been placed on the CUP plat
and said plat has been recorded in the Weld County
D. The second sentence of Development Standard #2 being
deleted.
Meddles - CUP
DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel shall be
the facilities as shown for the selling, breeding, training
and boarding of horses; a single-family residence; and all
uses permitted by right under Section 3. 3 B. of the Weld
County Zoning Resolution.
2 . The maximum number of horses to be cared for on the property
shall be twenty (20) .
3. There shall be no discharge of wates into any streams , other
bodies of water, or adjacent drainage systems without
obtaining a waste water discharge permit from the Colorado
Department of Health.
4. The 50 foot Community Canal right-of-way shall not be used
as a pedestrian or horse path.
5. No bridge or crossing shall be constructed across the 50
foot Community Canal right-of-way on the hereon described
property.
6. No permanent structures , landscaping, or any use shall be
located or permitted on the 50 foot Community Canal right-
of-way as shown on the plat .
7. The sewage disposal system shall conform with all applicable
Weld County and State Health Standards and Regulations .
8. All accesses shall have the approval of the Weld County
Engineer' s Department .
9. The CUP area shall be maintained in such a manner so as to
prevent soil erosion , fugitive dust , and the growth of
noxious weeds .
10. The CUP shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the CUP
by the Planning Commission and Board of County Commissioners
before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the
plans and/or Development Standards shall be filed in the
Office of the Department of Planning Services.
Comments :
The Farmers Reservoir and Irrigation Company has indicated in
a letter dated April 5, 1978, a number of concerns regarding
this request . All of the concerns have been addressed in the
Development Standards. -Tom Fisher, Superintendent of the
Farmers Reservoir and Irrigation Company , has indicated that
he is satisfied that the concerns have been addressed and
answered in the proposed Development -Standards.

The Weld County Planning Commission held a scheduled meeting on
May 2, 1978 , at 1 : 30 p.m. in the Weld County Centennial Center County
Commissioners Hearing Room, 915 10th Street , Greeley, Colorado.

SUBJECT: Open Cut Mining Permit for Gravel Pit
APPEARANCE : Tom Connell , Carl Hill , Robert Mathias
DISCUSSION: Tom Connell , attorney for Best-Way Paving Company , first
briefly stated that they have submitted all required plans, maps , etc.
for consideration by the Planning staff and the members of the Planning
Commission . Iie then introduced Carl Hill , President of Rest-Way Paving
Company, who gave a short presentation to the Planning Commission on
the purpose of the application and why they are requesting the permit .
Best-Way desires to expand their operation to include an additional 45
acres . He stated that this is a unique piece of ground in that they can
extract the maximum amount of gravel from the site and all the material
can be mined. Mr . Hill also stated that they have changed one item in
regard to the berm and the fence on the southwest portion of the site .
Two of the area' residents along that side of the property expressed that
they would rather not have a berm. They like the view to the east that
they now have, so Best-Way has proposed to replace the privacy fence
with a chain link fence . There being no questions or discussion at this
time, Tom Bonn read the staff ' s recommendation for approval and the
Operations Standards . Jerry Kiefer then asked for clarification of the
of the recommendation by the City of Greeley and the Planning staff ' s
recommendatin regarding a berm and a privacy fence as opposed to a 100'
setback. The Planning staff felt a berm and privacy fence would have
a greater effect on buffering the operation from the existing residentia
uses rather than the 100' setback . Irma White also asked for clarificat

Department responded. He stated he sees no problem at this time.
Chairman Carlson then opened the floor for audience participation.
At this time Larry Wikholm, representing H.O.P.E. (Homeowners Opposed
to Pit Expansion ) , a group of surrounding property owners , again
expressed his opposition to the gravel pit and asked Dick I:eirnes of
the Greeley Planning Commission to comment on the proposal . Mr. Keirne
stated that the City of Greeley Planning staff recommendation was for
a 200 ' setback from 4th Street and the City Planning Commission
recommendationed a 100' setback be provided. Discussion followed
among the Planning Commission members regarding the berm. Ruth Sens ,
Chairman of II.O.P.E. , then presented to the Planning Commission other
requests other than what the Planning staff recommended regarding
buffering and area protection , maintenance of the buffers , the existing
plant site , reclamation and monitoring and enforcement . Kay Norton,
Assistant County Attorney , responded to the comment regarding monitoring
and enforcement by stating that this would be unlawful delegation . Tom
Hellerich , attorney representing Mr. and Mrs. Ray Larson , expressed that
there should be a setback , especially with regard to the Larson ' s
property . He also stated the Larson ' s oppose a chain link fence along
the west side of the property. They are in favor of a 6 ' privacy fence
as recommended by the Planning staff and also a 6 ' berm. Mrs. White
asked for clarification again as to where the berm would be located on
the west side of the property. Discussion followed . At this time
Robert Mathias of R. V. Lord and Associates showed the Planning Commissi
an overlay which showed the property as it exists now and then how it
would look with the berm and trees . Discussion followed regarding
maintenance of the berm. Vicki Reed then read the motion by the City
of Greeley Planning Commission regarding the 100 ' setback. Ray Larson
expressed some concern as to how high the berm would go on his property
line on the west side. His property extends 4 ' higher than Best-Way' s
property . Mrs . Ray Larson also expressed a great deal of concern in
opposition to the proposal by Best-Way. The Larson ' s presently own
eight lots which abutts Best-way ' s property . Donna Jackson stated she
felt the trees proposed to be planted should he 6 ' high nursery stock .
Chairman Carlson then asked about the irrigation ditch and how far it
is away from property lines and how much fill will be needed there.
Discussion followed. Bette Kountz asked what size trees would be plante
when they are planted . Discussion followed.
MOTION: Be it therefore resolved to continue the meeting to May 16 ,
1978, to receive further input regarding the setback on the west side,
height and quality of trees and type of fencing and where it is going
to be located on the property . Motion by Percy Hiatt , seconded by
Irma White. A vote of "aye" by Chuck Carlson , Ben Nix, Percy Hiatt ,
Jerry Kiefer, Irma White , and Bette Kountz. Marge Yost cast a vote
of absention . Motion carried.

LOCATION: 2 - miles east of Nunn
SUBJECT: Amend SUP-277_ : 74 : 34 by expanding acreage for gravel pit
APPEARANCE : Joe Intermill
DISCUSSION: Mr. Intermill explained to the Planning Commission members
that the gravel pit for SUP-271 is on property owned by Mr. and Mrs .
Lynn Shipps. The Colorado Division of Highways have an option to
purchase material from the Shipps as the need arises for the maintenance
repair and construction of highways in the area. The SUP they now have
is for 5. 1 acres which was obtained in March of 1975 and they now want
to enlarge the area to 9. 4 acres. They did not realize at the time they
took out the SUP in 1975 that they needed to include a plant and stock
pile area and now need more room to work. There is also a possibility
that several years from now they may want to enlarge and remove more
material , which is the reasons for their request . lie stated that materi
hauled from the area will normally be on a private road owned by the own
to County Road 98 and then hauled west of U.S . 85 . Gravel is being;
removed at this time from the creek bed area. A reclamation plan will t
utilized if needed. Expansion will take effect immediately . There hein
no questions at this time, Chuck Cunliffe read the staff ' s recommendatic
for approval of this expansion . No further discussion .
MOTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners based on the staff ' s recommendation . Motion by
Percy Hiatt , seconded by Ben Nix. A vote of "aye" by Chuck Carlson ,
Jerry Kiefer, Ben . Nix, Percy Hiatt , Bette Kountz, Irma White, and Marge
YOst . Motion carried.

DISCUSSION: Mr. Woods stated that they propose a borrow piton the
Eichner property . It will be used for highway construction. for banking .
Present use of the area is a wheat farm. The mining plan is to remove •
the top 8" of soil and stock pile it , then excavate the material to an
average depth of approximately 7' ' at a 15 to 1 slope. The material
will be hauled down County Road 4 for 1 . 1 mile to I-76 where the propose
project is . The reclamation plan after excavation is basically to

the rig . h , tion of the Soil Conservation Service. The staff contacte
Mr. Wood with regard to concern about dust on County Road 4 . Mr. Wood
indicated they will take measures to control the dust with water or
emulsified asphalt . Mrs . Yost questioned as to how many homes were alon
County Road 4. Mr . Wood responded there were five. Some discussion
followed regarding the scheduling involved to haul the bulk out . Chuck
Cunliffe then read the staff ' s recommendation for approval. No further
discussion .

DISCUSSION: Mr. Meddles stated that their intentions are to have a
horse ranch in the business of selling, breeding, and training horses .
When the operation is fully developed, they anticipate having 20 horse
on the property. Of the 40 acres involved, three acres would be used
for buildings, seven acres would he used for pasture and the remaining
30 acres would be used primarily for raising alfalfa and grain. He
also said he does not feel the operation would he detrimental to the
air or water or noise levels . Also, the existing roads are in good
condition . Disposal of waste will be spread on the acreage . Bedding
will be straw and cleaned daily or more if necessary . There being no
questions at this time, Chuck Cunliffe read the staff ' s recommendation
for approval of this request and the Development Standards . Mr . Carlsor
asked if the applicant was aware or notified of possible ground sub-
sidence in the area. Chuck Cunliffe said the Colorado Geological Surve}
reviewed the application and have no problems with it . Mr . Meddles sho'
Mr. Carlson a map he had which showed that there would be no problem
with subsidence. Mrs . White was concerned with Development Standard #2
and why it specified a certain number and kind of horse . She felt it
should read simply 20 horses . Mr. Cunliffe stated that the applicant
had submitted it to read specified numbers and kind of animals. Mr.
Cunliffe said this could he deleted from the Development Standards . M
Hiatt commended Mr. Meddles for his facts and figures regarding the
application .
MOTION: Be it therefore resolved to recommend approval based on the
staff ' s recommendation with the deletion of the last sentence in
Development Standards #2 which reads , "This will include one stalliorp ;
2 brood mares ; 2 horses in training and 15 boarding horses. " Motion/ by
Irma White , seconded by Jerry Kiefer. A vote of "aye" by Chuck Carlson

DISCUSSION: Mr. Valdez is requesting to split Lot 4 of Scott ' s Acres
and share it with Mr. Ignacio Vasquez . Tom Honn further explained that
the property is presented owned by Mr. and Mrs . Valdez and Mr. and Mrs .
Vasquez . It was divided in 1969 under the former regulations . The
purpose of the replat is to clarify the ownership and properly describe
within the subdivision plat the lots which exist as of 1969, but have
never effectively been identified on the subdivision plat itself.
He then read the staff ' s recommendation for approval of the request . MI
Carlson asked Mr. Valdez if he was aware that the property was over the
Boulder Valley coal field. Mr . Valdez said he was aware of this . Mr.
Carlson recommended the applicant invesitage this further before buildir

1. It is the opinion of the Department of Planning Services staff
that this request is in conformance with the Weld County
Comprehensive Plan and the intent clause of the Agricultural
Zone District , Section 3. 3 .A. of the Weld County Zoning Resolution
since it is promoting an agricultural related use in an area
where agriculture is the predominant land use. Further, this
request is using the land as a higher and better use than it
has been used in the past .
2. It is the opinion of the Department of Planning Services staff
that this request is in compliance with the provisions of Section
3.. 3.D(2 ) of the Weld County Zoning Resolution which states :

This determination is based upon the following:

where the surrounding land uses are predominantly agricultural .
B. The addition of one single-family residence and horse
training stable and facilities on the property in question
will be compatible with the surrounding agricultural uses.
C. The Dacono area Fire Protection District has indicated that

D. The Boulder Valley Soil Conservation District has
indicated that in reviewing this request no conflict
with their interests were found.
E. The Colorado Geological Survey has no objection to
the approval of this request . They indicated that the
geologic conditions are generally suitable for the
proposed land use.
F. The Weld County Engineering Department has indicated
that they have no problems with this request .
G. The Town of Erie Planning Commission has indicated that
they have no objections to this request .
H. The Weld County Health Department has indicated they
have no problems with this request provided the
applicant complies with their recommendation as out-
lined in their letter dated April 6 , 1978.
I . The applicant has submitted a petition form signed by
seven of the surrounding property owners in support
of the request . To date, none of the other property
owners in the area have indicated any opposition to
the request .
In addition, the staff' s recommendation for approval is subject
to the following conditions:
A. The following note as found on the CUP plat being
deleted:
"No permanent structures or landscaping to be
located within 25 feet of the community ditch
R.O.W. "
This note has been amended and incorporated into the
Development Standards .
B. The attached Development Standards being recommended
and approved for the CUP area.
C. No building or electrical permits for any structure
shall be issued on the CUP area until the Development
Standards for the CUP have been placed on the CUP plat
and said plat has been recorded in the Weld County
Clerk and Recorder' s Office.

DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel shall be
the facilities as shown for the selling, breeding, training
and boarding of horses; a single-family residence; and all
uses permitted by right under Section 3. 3 B. of the Weld
County Zoning Resolution.
2. The maximum number of horses to be cared for on the property
shall be twenty (20) .
3. There shall be no discharge of wates into any streams , other
bodies of water, or adjacent drainage systems without
obtaining a waste water discharge permit from the Colorado
Department of Health.
4. The 50 foot Community Canal right-of-way shall not be used
as a pedestrian or horse path.
5. No bridge or crossing shall be constructed across the 50
foot Community Canal right-of-way on the hereon described
property.
6. No permanent structures , landscaping, or any use shall be
located or permitted on the 50 foot Community Canal right-
of-way as shown on the plat .
7. The sewage disposal system shall conform with all applicable
Weld County and State Health Standards and Regulations .
8. All accesses shall have the approval of the Weld County
Engineer' s Department .
9. The CUP area shall be maintained in such a manner so as to
prevent soil erosion , fugitive dust , and the growth of
noxious weeds .
10. The CUP shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the CUP
by the Planning Commission and Board of County Commissioners
before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the

The Farmers Reservoir and Irrigation Company has indicated in
a letter dated April 5, 1978, a number of concerns regarding
this request . All of the concerns have been addressed in the
Development Standards. Tom Fisher, Superintendent of the

he is satisfied that the concerns have been addressed and

(e) Our intentions are to have a ranch specializing in:
selling; breeding; training and boarding of horses: .
The maximum number of horses to be cared for on the
property would be 20. This would include : one
stallion; 2 brood mares ; 2 horses in training and
15 board horses . The stallion, broodmares and, on
occasion, one horse that is in training will belong
to the applicants .
When the ranch is fully developed, we anticipate
having on the property : a Port-A-Stall type build-
ing with attached runs to accomodate 20 horses ; a
breaking and training ring (50 ' in diameter) ; a
training arena (150 ' x 75' ) ; accomodations for hay
storage (approximately 25 ton) ; a small building
attached to the horse barn for tack and veteranary
supplies and a house for the owners to reside in .
The buildings and training rings would use approxi-
mately 3 acres of ground. About 7 acres would be
used for pasture for brood mares and foals and the
remaining 30 acres would be used primarily for
raising alfalfa and grain.
The stable and other buildings would occupy about
4, 000 square feet ; the breaking and training rings
about 12, 000 square feet and the house and yard
about 71000 square feet, making a total of approxi-
mately a acre with an additional 2z acres for roads
and storage , runs and landscaping.
As stated previously, thirty acres would be used
to raise alfalfa and grain . Previous crops raised
on this location have been: wheat, barley, corn
and alfalfa . The crops grown on this forty acres
for 1977 were barley and alfalfa .
The property, when fully developed, would have an
investment at today 's prices of $135, 000 in buildings,
land and equipment ($45, 000 in operational buildings
and equipment ; $50, 000 in land and $40, 000 in the
residence .
The ranch would be run and managed by Bob and Jan
Meddles and our daughter Laurie . This would afford
our daughter, who has been riding, showing and
competing with horses for nine years, an opportunity
to pursue a career in horse training, breeding and
boarding management . Currently , she is enrolled in
Arvada West High School in Jefferson County . She has
been diagnosed as having some learning disability in
the academic area - however she has a natural apptitude
and a strong desire in working with, training and other
activities related to horses . The counselors at Arvada
West High feel that she has no disability in learning
this type of activity . In cooperation with the school ,
she is working at Golden Mesa (a boarding, training
and riding facility) with a well known trainer , Ms . Dion
Dana , in an apprenticeship type program for school credit .
We will be hiring some part-time student help occasionally .

counselors as to her ability in this area . This
business is also desired for the applicants as an
activity they wish to pursue after retirement from
their present occupations .

When the property is fully operational, the above
would represent a conservative estimate of return .
We see no reason why the operation of this ranch
should have an adverse effect on the air , water,
odor and noise levels - nor would it create any
glare . We intend to do as much planting as is
necessary to provide a wind-break around the area
used for barns, training rings, house and yard .
This wind-break will also, of course, afford privacy .
There should be no fire hazard as the buildings,
except for the house, will be metal and the house
will be mostly brick and built to meet the existing
fire codes . See section (1) (f) as to the effect
on odor level and section (1) (g) regarding water .
Per the recommendations of the Soil Conservation
Service in Longmont, we will be planting the following:
For windbreak: Russian Olives - about 10 ' east of
road and approximately 3z ' apart - 12 ' to 16 ' east of
Russian Olives - Rocky Mountain Juniper - approximately
8 ' apart . For pasture grass: mixture of alfalfa, or-
chard grass and smooth brome . For lawn: Fairway wheat
grass .

(f) Stall bedding will be straw and animal waste will
be removed from the stalls each day . Bedding straw
will be removed from the stalls and replaced with
fresh straw twice a week or more often if needed.
The straw and animal waste will be distributed by
a spreader over the acerage to be utilized as fer-
tilizer . The soil conservation office in Longmont
has indicated this type of disposal would be very
practical and beneficial in enriching the soil .
Domestic waste material will be disposed of through
the use of a septic tank and leaching field.

(g) Water will be by domestic tap and the maximum
usage would be 12, 000 gallons per month plus
domestic use for a family of 4. The Left Hand
Water Supply Co . (see attached letter for request
for tap) has stated in their letter that they
can furnish the amount of water needed for 100%
operation for the stables and domestic use .
Other than domestic use , there would be only
two other water outlets and these would be
located in the barn .
(h) The existing roads in the area are very good and
no improvements will be required .

X40-C Wiley-Colby complex, This mapping unit is made up of about 60%
3-5% slope Wiley soil and about 30% Colby soil with abou
10% inclusion. The Wiley soil has moderately
slow permeability, medium surface runoff and
a moderate erosion hazard. There is a mod-.
erate shrink-swell potential and low strength
The Colby soil has good potential for urban
development. This soil exhibits moderate to
rapid surface runoff, moderate permeability
and a moderate erosion hazard. This soil

CAPABILITY GROUPS OF SOILS
•
Capability classification is the grouping of soils to show, in a general vel. ,
their suitability for most kinds of farming. It is a practical classtficut:K1
based on limitations of the soils , the risk of damage when they are usrj , avid
the way they respond to treatment . The soils are classified according to
degree and kind of permanent limitation, but without consideration of major
and generally expensive landforming that would change the slope , depth, or
other characteristics of the soils; and without consideration of possible but
unlikely major reclamation projects.

The Farrers Reservoir and Irrigation Coimany would like to object
to the above referenced case until the following concerns are satisfied
in writing to The Farriers Reservoir and Irrigation Corpany:
1. It is noted on the Conditional Use Permit that
"No permanent structures or landscaping to be
located within 25 feet of the ConmLmity Ditch
right-of-way". We, The Faiucrs Reservoir and
Irrigation Company, can not allow any use of
the 25 foot, permanent or tenporary.
2. There will not be allowed any run-off into the
Community Ditch, especially waste (manure,
sewage, etc) run-off.
3. The Community Canal right-of-way will not be
used as a pedestrian or horse path.
4. It appears that the landowner will or does
own land on both sides of the Community Canal.
It does not indicate on the nap that a bridge
is being planned, but to side step any future
problens, The Farmers Reservoir and Irrigation
Company will not grant permission for a crossing , ,. o Q-,
