This second residence would allaw for them to house both farm hands on the site that actively farm the site today along with their families . " There is currently water and septic pravided to the property and the existing primary residence on site . North 1Neld County UVater District pravides the water to the primary residence through meter #3244 002 and intends to supply water to the proposed secondary dwelling as stated in their letter provided in the USR application dated May 2 , 2 (117 . The existing septic system permitted on the property for the primary residence is sized far up to 4 bedrooms and is permitted under permit #SP- 1200265 . According to the Department af Public Health and Environment referral dated May 26 , 2017 a new septic system can be built on site and uvill need to be built to sceammodate the new residence if this USR is approued . B . Seetion 23 -2-224.A. 2 -- The praposed use is consistent with the intent of the A (Agricultural ) Zone Di �trict . Sectian 23-3 -40 . M . Allows for one ( 1 } single-family dwelling unit per lot other than tho�e permitted under s �ction 23-3-20 . A. ( second single -family dwelling unit) in the Agriculture (A) Zane District . The proposed � �cond re� idence will be used primarily far farm hand help for the farming aperation on site. C . Sectian 23-2 -220 . A.3 -- The uses which will be permitted will be compatible with the existing � urrounding land uses . The use and size of the lots around th � property in question are eith � r primarily single family residences on agricultural zoned parcels that range between 3 and 5 acre� in size. Or large Agricultural zoned parcel� actively being farmed that range between 70 and 3QQ acre� in size. The adjaeent land uses surrounding the +1- 145 -acre parcel , include one Use by Special Review Permit permitted through MU5R1E -0001 for a solar array faeility owned by the silicon ranch corporation directly north af the parcel . There are also six (6 ) Use by Special Review permits that have been permitted within 1 mile of the praposed site which include three ( 3 ) permitted for feed lots and dairy' s and three ( 3 ) permitted for second single family residences . The praposed USR for a secand residence primarily to be used far farmhand help is compatible with the existing surraunding residential snd agricultural land uses . The Weld County Department of Planning Services has received na responses fram the surrounding property owners in opposition to this praposed application . D . Section 23-2 -220 . A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future develapment a� projected by Chapter 22 af the Weld County Code and any other applicable code pravision� or ardinance� in efifect , or the adopted Master Plans of affected municipalities . Mineral resaurce locatians are widespread throughout the County and person maving into the�e ar�as must recognize the various impacts associated with this development. Often time� , mineral resource � ites are fixed to their geographical and geophysical locations . Moreover, these resource� are protected property right� and mineral owners should be afforded the opportunity to extract the mrneral re� ource . 18 . WELD CDUNTY' 5 RIGHT TQ FARM : Weld Caunty is one of the most productive agricultural countie� in the United States , typically ranking in the top ten caunties in the country in total market value of agricultural products sald . The rural areas of Weld County may be open and spacious , but they are intensively used for agriculture . Per� ons moving into a rural area mu �t recognize and accept there are drawbacks , including eanflicts with long -�tanding agricultural practices and a lower level of services than in town . Along with the drawbacks come the incentives which attract urban dweller� to relocate to rural areas : open views , spaciousness , wildlife , lack of city noise and con�estion , and the rural atmasphere and way of life . Withaut neighboring farms , those features which attract urban dwellers ta rural 'Weld County would quickly be gane farever . Agricultural users af the land shauld nat be expected to change their long-established agricultural practiees ta accommodate the intrusions af urban users into a rural area . Well - run agricultural actiuities will generate off-site impacts , including noise from tractors and equipment, slow-moving farm vehieles an rural roads ; dust from animal pens , field work , harvest and gravel raads ; ador from animal confinement, silage and manure ; smoke fram ditch burning ; flies and mosquitoes ; hunting and trapping activities ; shooting sports , legal hazing af nuisance wildlife ; and the use of pesticides and fertilizers in the fields , including the use af aerial spraying . It is common practice far agricultural producers ta utilize an accumulation of agricultural machinery and supplies to assist in their agricultural aperations . A cancentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County . Sectian 35- 3 . 5- 102, C . R. 5. , pravides that an agricultural operation shall not be faund to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methads or practices that are commonly ar reasonably assaciated with agrieultural productian . It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" af residential develapment . 1Nhen moving to the Caunty , property awners and residents must realize they cannot take water fram irrigatian ditches , lakes , ar other structures , unless they have an adjudicated right tc� the water . Weld Caunty cavers a land area of approximately four thausand (4 , D00 ) square miles in size (twice the size af the 5tate of Delaware ) with more than three thausand seven hundred (3 , 700 ) miles of state and county roads outside of municipalities . The sheer magnitude af the area to be served stretches available resaurces . Law enfarcement is based on respanses to camplaints mare than on patrols of the County , and the distances which must be traveled may delay all emergency responses , including law enfarcement, ambulance , and fire . Fire protection is usually provided by volunteers who must leave their jabs and families to respond to emergencies . County gravel roads , no matter how often they are bladed , will nat prc�vide the same kind of surface expected from a paved raad . Snow removal priorities mean that raads from subdivisions to arterials may not be cleared for several days after a major snowstarm . Services in rural areas , in many cases , will not be equivalent to municipal services . Rural dwellers mu �t, by necessity , be more �elf-� ufficient than urban dweller� . People are expased to different hazards in the County than in an urban or � uburban setting . Farm equipment and ail field equipment, ponds and irrigation ditche� , electrical power for pumps and center pivat aperations , high speed traffic , sandburs „ puncture vines , territorial farm dogs and livestock , and apen burning present real threats .
