Dear Ms. Aungst,
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information under RECX17-0013, the applicant is proposing to
amend Lots A and B of the Recorded Exemption No. RE -4599. Based on the proposed
amendement Lot A will increase in size from 2.38 acres to 6.94 acres and Lot B will decrease
in size from 47.04 acres to 42.48 acres.
Under USR17-003, the Applicant is seeking a site specific development plan and use by special
review permit for a use permitted as a use by right, an accessory use or a use by special
review in the commercial or industrial zone districts (office and storage facility for a seed
dealership and indoor and outdoor storage of RVs, boats, construction equipment, commercial
vehicles, trailers and semi -trucks) for the new Lot A of RECX17-0013.
The proposed water supply for the new Lot A will be a water tap from Central Weld County
Water District ("CWCWD") and for the new Lot B will be a proposed well. According to our
records there are no permitted wells for these two lots. The application material for both
applications included a letter from CWCWD dated January 6, 2017 that indicates that water
service can be made available to the part of the SW1/4 of Section 12, Township 4 North,

Range 66 West of the 6th P.M., Lot A of RE -4599 so long as the requirements of CWCWD,
Northern Colorado Water Conservancy District and U.S. Bureau of Reclamation are satisfied.
CWCWD most recently provided this office with information about their water supplies in
September of 2012. Based on this information, the CWCWD is considered to have an adequate
water supply. The ability of the applicant to obtain a well permit for Lot B of RECX17-0013
will be determined at the time a well permit application is submitted to this office.
