BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MARCH 22, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, March 22, 2017, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Julie A. Cozad, Chair
Commissioner Steve Moreno, Pro-Tem
Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer

El MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County
Commissioners meeting of March 20, 2017, as printed. Commissioner Conway seconded the motion,
and it carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed.
Commissioner Conway seconded the motion, and it carried unanimously.
PRESENTATIONS:
1) RECOGNITION OF SERVICES, DEPARTMENT OF PUBLIC WORKS — DON EVIG: Chair
Cozad read the certificate into the record. Jay McDonald, Director of Department of Public Works, spoke
on Mr. Evig's fourteen (14) year background with the County in Public Works, which started as a seasonal
position and turned into a regular full-time employee within a short time. Mike Livengood, Department of
Public Works, commented on his character of friendliness, and thanked him for his dedicated service to
the County. Mr. Evig extended his thanks to his peers. Each Commissioner expressed gratitude for his
service to the County, and wished him the best of luck with his future. (Clerk's Note: Paused meeting for

• COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno attended the Greeley

Downtown Development Authority (DDA) meeting where Becky Safarik, Greeley Assistant City Manager,
spoke on the groundbreaking for the new City Center to open March 31, 2017, at 9:00 a.m. Commissioner
Moreno later commented on a new coffee house in downtown Greeley. Commissioner Kirkmeyer
stated tomorrow she will be representing the County in Boulder for an oil and gas bill. She also
commented on a transportation bill, which will provide an opportunity for voters to put additional dollars
toward transportation projects. Lastly, Commissioner Kirkmeyer mentioned visiting the Greeley Museum
to do research for the 100th Anniversary of the Weld County Courthouse. a Commissioner Freeman
reported on the Airport Board Meeting. He stated that there are many new improvements, including a
redo of a major runway and the four new hangars that were built last year. a Commissioner Conway
stated last Thursday the CCI Transportation Services Committee hosted Colorado Department of
Transportation's (CDOT) Director, Shailen Bhatt, who provided an update on the transportation bills
currently moving through. Commissioner Conway attended the County Technical Services, Inc. (CTSI)
Board Meeting and stated the growing trend of large law suits against law enforcement and jails may
cause the County's fund to no longer be sustainable; however, as of right now, the funds and ratios are
in good shape. He also attended the United Way Mad Hatter Ball, which focused on homelessness.
Lastly, he stated today he is attending the Colorado Water Conservation Board Meeting to discuss the
South Platte Water. (Clerk's Note: Commissioner Conway left the meeting) a Chair Cozad attended
the Freedom Parkway Coalition (spanning from Loveland to the Kersey) meeting, and stated the coalition
is making great progress. She also attended the Johnstown's Town Board Meeting to give a summary
update of the County. She mentioned that the 125 Corridor topic was discussed, and Johnstown advised
that they are lowering their contribution amount to the corridor project, which ultimately may restrict the
project from happening. Chair Cozad stated that CDOT will re-evaluate, but she plans to meet with the
cities of Greeley, Miliken, and Evans to see if more funds can be contributed. Chair Cozad commented
on the Weld County Workforce Development Meeting, and stated Weld Works for Youth will help serve
fifty (50) youth, ages fourteen to fifteen (14-15), preparing them for the workforce. Lastly, she stated the
Employment Services' update reflects the County's unemployment rate at less than 3%, and stated that
fifty-eight (58) employers were at the Teen Job Fair, where over 800 youth attended.
BIDS:
• 1) APPROVE BID #B16000178, CAPTURE SOFTWARE FOR EMC'S APPLICATIONXTENDER
8.X — DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of
Information Technology, stated four (4) bids were received and staff requests to move approval date to
March 29, 2017. Commissioner Freeman moved to continue to March 29, 2017. The motion was
seconded by Commissioner Kirkmeyer, and it carried unanimously.
NEW BUSINESS:
• 1) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - UNION COLONY BANK,
C/O FIRST NATIONAL BANK: Christopher Woodruff, Weld County Assessor, explained the property
owner is exercising their right to have the value reassessed to what the the Board of Equalization
determined in 2016 for the amount of $2,052,835.00, which yields a tax refund in the amount of
$10,327.52. He stated staff recommends approval. The motion to approve said petition for abatement,
which was made by Commissioner Freeman, and seconded by Commissioner Kirkmeyer, carried
unanimously.
• 2) CONSIDER RENEWAL APPLICATION FOR A TAVERN LIQUOR LICENSE AND AUTHORIZE
CHAIR TO SIGN — FIERA ENTERTAINMENT, LLC, DBA EL CAPORAL: Frank Haug, Assistant County
Attorney, stated this is a renewal for El Caporal, and there were no concerns from the Health Department
or Sheriff's Office. Mr. Haug stated there was an issue, in the past, with an individual purchasing liquor
who is not on the Liquor License. Mr. Haug stated that the applicant has been advised and will follow

proper procedures in the future. Elvira Mercado, applicant, admitted her mistake, but stated that she
understands and intends to follow the requirements in the future. Commissioner Kirkmeyer moved to
approve said renewal liquor license and authorize the Chair to sign. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
3) CONSIDER AGREEMENT FOR RELEASE OF LIABILITY FOR ACCESS TO WELD COUNTY
PROPERTIES TO PERFORM SURVEYING AND AUTHORIZE CHAIR TO SIGN - WILLIAM SHEEHAN:
Mr. Haug stated the purpose is to come onto the property to survey and locate ditches and boundaries.
Commissioner Kirkmeyer moved to approve said agreement for release of liability and authorize the Chair
to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:35 a.m.
