Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: Change of Zone from A (Agricultural) Zone District to the C-3 (Commercial) Zone District. This project is south of and adjacent to Highway 392 and is west of and adjacent to CR 35. Parcel number 080523000018. Access is from CR 35 and Hwy 392. Access: An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division. Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance. (This document can be found at: https://www.weldgov.com/UserFiles/Servers/Server 6/File/Departments/Public%20Works/EngineeringlW CECC°/020Manual.pdf Existing access points with change of use or new access points may or may not be granted. Questions pertaining to access permits or access design shall be directed to the Public Works Department. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. When feasible, there shall be no net increase in the number of accesses to a public road. Contact Public Works to discuss your access. Roads: County Road 35 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 392) Traffic: Latest ADT on CR 35 was taken on 6/25/2015 which counted 3017 vpd with 12% trucks. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. County Road 35 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road which requires 140 feet of right-of-way at full buildout. Bradley Keirnes Follow up Flagged It looks like there is an existing access off of CR 35. They need to just submit an access permit requesting that the access be upgraded to a commercial access point. CR 35 is an arterial roadway. Morgan & Evan, we will need to note on the access permit that the access is less than 660 feet away from SH 392 but that the parcel itself does not have the frontage to meet the spacing requirement so we are approving the access based upon a hardship. North Weld County Water District provides water and a shared septic system provides sewage disposal for both homes. As there is no septic permit on record for the existing homes a statement of existing and inspection is required. If the septic tank is in poor condition and no longer water -tight or constructed of an unapproved material or the system is failing, the system will be required to be brought into compliance with current regulations. We recommend that the following requirement be met prior to allowing the plat to be recorded: 1. The septic system serving the two homes shall have a statement of existing and inspection completed. In the event the system is found to be inadequate, the system must be brought into compliance with current OWTS regulations or a new OWTS shall be installed. We recommend the following appear as notes on the Change of Zone plat: 1. Water service may be obtained from North Weld County Water District. 2. The parcel is currently not served by a municipal sanitary sewer system. The submitted material does not appear to qualify as a "subdivision" as defined in 5 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The subject application seeks to change the zoning for a 7.49 -acre parcel from agricultural to commercial (C-3). The application listed the NWCWD (North Weld County Water District) as the water utility provider and included a letter from the NWCWD verifying that they provide domestic water service to the property. The application indicates that water is currently supplied by an existing well. This office does not have records of any permitted or decreed well located on the subject property. This office has concerns that the future use of the well after the requested change of zone may be different than the historic use of the well. Therefore, if the applicant wishes to maintain the use of the well, we request that the owner register the well with this office in order to clarify and document the allowable use of the well. If the well will not be used, then it is recommended that the well be properly plugged and abandoned in order to prevent contamination of the aquifer. The property has an existing detention pond for drainage. The applicant should be aware that, pursuant to Colorado Senate Bill 15-212, detention facilities must meet specific criteria to prevent them from being administered by the Office of the State Engineer as detailed in 5 37-92- 602(8), C.R.S. The detention pond must be operated solely for storm water management and be subject to oversight by a governmental entity (i.e., required as part of a permitting process). Further, it must release or infiltrate at least 97 percent of all of the water from a rainfall event that is equal to or less than a five-year storm within 72 hours of the end the rainfall event. This violation was initiated due to the placement of a considerable amount of fill materials and CDOT storage without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office; therefore, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. Approval of this application by the Board of County Commissioners would correct the outstanding violations. If this application is denied, the Department of Planning Services asks that the Board forward these cases to the County Attorney's Office for legal action through the District Court process, but to delay that legal action for 30 (thirty) days to allow the applicant time to return the property to the original state and remove CDOT storage. First, as stated in the application, our canal borders the property on the south. The New Cache La Poudre Irrigating Company has a statutory responsibility to operate and maintain the canal. The ditch company has been in existence since 1870 and has a prescriptive easement. This activity usually includes weed control, excavation of the canal, weed burning, water delivery, etc. The canal road and adjoining area are utilized for these purposes. Some of these activities occur on an irregular basis depending on need. Access along the canal must be maintained in order to perform our tasks. An easement agreement may have been entered into by New Cache and Ridgeview Farm, LLC back in 2005-2006 that delineates the easement. Whether it addressed this parcel is a question also, since it may have only addressed the property below the canal. If it did not address the property above the canal, New Cache requests that in lieu of the prescriptive easement (which cannot be platted due to County policy) that the applicant enter into an agreement with the company to define the easement utilizing the terms of the aforementioned agreement. Secondly, the application mentions stormwater drainage. New Cache has historically taken the stormwater from the parcel when it was an agricultural parcel. Now that the use is changing, the stormwater system need to be addressed in terms of quantity released and quality of the water released. I did not see any mention of quantification of the stormwater. If in the future, water and sanitary sewer service are requested to the property, then annexation into the City of Greeley will be required prior to the City of Greeley providing utility service. The City of Greeley does not currently provide utility services to the subject property. ❑ Advisory. The City of Greeley and North Weld County Water District (NWCWD) have adopted a Water Service Agreement for providing water in this area. Please note that if water service is requested then the City of Greeley will decide if water will be provided by the City of Greeley or NWCWD in accordance with the executed Water Service Agreement dated February 5th, 2013. ❑ City of Greeley's 2035 Comprehensive Transportation Plan indicates that Highway 392 will be a 2 -lane major arterial roadway requiring a 150 foot total public right of way (75 foot half right of way), and that Weld County Road 35 (35th Avenue) will be a 4 -lane minor arterial roadway requiring a 120 foot total public right of way (60 foot half right of way). Please ensure that the site map calls out the future south half of the right of way for Highway 392 and the future west half of the right of way for 35th Avenue, and that all proposed structures (buildings and paved areas) are set back a minimum of 25 feet from the future right of way lines.
