WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that Etta Mae Sirios, Edward R. Sirios,
and Louis Sirios, Weld County, Colorado, are the owners of 79. 994 acres
of dry land and they desire to split off from said parcel of land a portion
containing approximately 3. 106 acres; said whole parcel of land being more
particularly described as follows, to-wit:
The West one-half of the Northwest one-quarter of Section 32,
Township 2 North, Range 61 West of the 6th Principal Meridian,
Weld County, Colorado, more particularly described as:
Beginning at the Northwest corner said Section 32; thence South
00 00'00" East on an assumed bearing along the West line said
Section 32 a distance of 2638. 95 feet to the West one-quarter
corner said Section 32; thence North 89°35'40" East along the
South line said West one-half Northwest one-quarter a distance
of 1321 . 09 feet to the Southeast corner said West one-half
Northwest one-quarter; thence North 00°01 '53" West along the —
East line said West one-half Northwest one-quarter a distance of
2639. 33 feet to the Northeast corner said West one-half North-
west one-quarter; thence South 89°34'40" West along the North
line said West one-half Northwest one-quarter a distance of
1319. 65 feet to the point of beginning. Contains 79. 994 acres
more or less, and
WHEREAS, the parties are desirous of selling approximately 3. 106
acres, more or less, of this land, and keeping approximately 76. 888 acres,
more or less, unto themselves, and
WHEREAS, it appears that to accomplish this purpose, the Sirios
family may apply for a recorded exemption from the subdivision regulations
of Weld County, as same is defined in Section 9-4 of the Weld County Sub-
division Regulations, and
WHEREAS, in addition to evidence presented by Mr. John W.
Henderson, attorney for the family, the Weld County Planning Commission
Staff has presented evidence, made representations concerning the desir-
ability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when
all of the evidence and representations are considered, good cause for
granting a variance from the minimum lot size requirements of the Weld
County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Title 30 C. R. S. 1973 and Section 9-4 A (6), Weld
County Subdivision Regulations as amended; that the Sirios family is granted
an exemption from the lot size requirements of the Weld County Zoning
Resolution.
BE IT FURTHER RESOLVED, that this exemption is allowed so that
the Sirios family may proceed to apply for a recorded exemption and the lot
size variance is conditioned on said Sirios family applying for and doing all
necessary to obtain said recorded exemption within one (1) year, and said
variance is limited to the Sirios family, and will terminate if they sell or
otherwise discontinue their interest in the above mentioned land prior to
obtaining approval for and recording the above mentioned recorded exemption.
