RE: PUBLIC TRANSPORTATION AGREEMENT BETWEEN THE COUNTY OF WELD,
STATE OF COLORADO, AND THE TOWN OF WINDSOR, COLORADO.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of
administering the affairs of Weld County, Colorado, and,
WHEREAS, it has come to the attention of the Board that
there is a need for an agreement between the County of Weld and
the Town of Windsor to provide public transportation services to
Windsor residents, and,
WHEREAS, an agreement has been submitted whereby Weld County
will furnish to the Town of Windsor certain transportation
services as set forth specifically in said agreement, and,
WHEREAS, the Board has determined the execution of said
agreement would be in the best interest of the County and to
accept said agreement, a copy of which is attached hereto for
ready reference and made a part hereof as is fully set forth
at this point.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said agreement as
submitted providing for transportation services a copy of which
is attached hereto and made a part hereof by reference, be and
hereby is approved.
BE IT FURTHER RESOLVED, that the Board be and hereby is
authorized to execute the agreement as submitted and to make the
same effective forthwith.
The above and foregoing Resolution was on motion duly made
and seconded, adopted this 4th day ofAlt A.D. , 1976 .

AGREEMENT
THIS AGREEMENT is made and entered into this 4th day of
August , 1976 , by and between the THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO, herein-
after referred to as "Weld County" and the TOWN OF WINDSOR,
COLORADO, hereinafter referred to as "Windsor" ;
WITNESSETH:
WHEREAS, Weld County has resources and equipment to provide
limited bus service to the Town of Windsor, and
WHEREAS, the Town of Windsor is desirous of entering into
an Agreement with Weld County to obtain transportation services
from Weld County for Windsor residents , and
WHEREAS, the parties hereto are desirous of formalizing an
Agreement which will operate to the benefit of both parties in
the establishment and operation of a limited public transportation
system for the use of the residents of the Town of Windsor;
NOW, THEREFORE, the parties hereto agree and covenant as
follows :
1. Weld County shall supply to the Town of Windsor a bus
which has the capacity to carry at least 20 passengers for the
use of the residents of the Town of Windsor on each Monday and
Friday, commencing the first Monday following the execution
of this Agreement, and such bus shall be at the Town of Windsor
by at least 8 : 30 A.M. on each day and shall provide services to
the Town of Windsor as hereinafter defined, starting at 8 : 30 A.M.
and returning to the Shop by 4 : 30 P .M. on each Monday and Friday
thereafter until November 1 , 1976.
2 . Weld County shall provide all maintenance, gas , oil,
insurance, and all necessary equipment to operate said bus and
shall provide a qualified driver to operate said vehicle in
accordance with the laws of the State of Colorado. The bus
service as provided by this Agreement shall remain under the
exclusive control of the transportation program of
the Human Resources Division of Weld County. The Service
as provided under this Agreement shall be extended to senior
citizens and economically disadvantaged persons and shall not be
provided for the public at large.
3. The Town of Windsor shall dispatch and direct the
use of the bus through the office of the Senior Citizen
Coordinator for the Town of Windsor employed by the Weld
County Department of Human Resources .
4. The Town of Windsor shall not impose any mandatory fee
schedules for the use of the bus provided by this Agreement but
may accept voluntary contributions from those persons using the
services of the bus under this Agreement, and the Town of Windsor
may retain all income and revenue received therefrom.
5. The Town of Windsor shall pay to Weld County a maximum
of fifteen (15) cents per mile for the operation and use of
said bus which shall be computed on the basis of actual miles of
travel while the bus is within the Windsor Town limits or on
trips from Windsor to other towns and cities and the return
therefrom. The Town of Windsor shall be responsible to limit
and control its use of the bus to a maximum of 400 miles for
each month of use.
6. It is agreed between the parties that this is a
demonstration project to determine the feasibility of the
operation of a high occupancy public transportation system
for the residents of the Town of Windsor. Either party
hereto has a right to terminate this Agreement within
thirty (30) days after service is instituted upon notice

given to the other party if the operation or utilization
of the services provided herein are deficient or for any
other operational deficiencies.
IN WITNESS WHEREOF, the parties hereto have set
their hands and seals this 4th day of August
1976.
