DODSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated November 20, 2013, the Board did approve the request of E.L. Dodson, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0043, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (oilfield service company laydown yard, office, and repair and maintenance shop for oil and gas equipment) in the A (Agricultural) Zone District, on the following described real estate, to -wit: Lots A and B of Recorded Exemption, RE -4214; being part of the N1/2 SE1/4 of Section 32, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owner, E.L. Dodson, 18305 County Road 29, Platteville, CO 80651, to partially vacate Use by Special Review Permit, USR13-0043, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall submit a revised plat, titled "Partial Vacation of Use by Special Review Permit, USR13-0043, conforming to Section 23-2-260.D of the Weld County Code. REQUEST: USR13-0043 includes both Lot A and Lot B of RE -4214. The current owner is proposing to sell Lot A to his son. Lot B is proposed to sell to another party (Nathan Naill) to operate an oil and gas support business on Lot B within the parameters of the approved USR13-0043. The number of employees and vehicle trips are consistent with USR13-0043. However the vehicles accessing the site will be larger. Public Works determined some additional tracking control will be needed (cattle guard and road base). This is indicated on the partial vacation plat. STAFF RECOMMENDATION: Staff recommends approval of the partial vacation request with the additional tracking control delineated on the partial vacation plat. 2017-1635 P L VIA/ May 5, 2017 To Whom This May Concern: As owners of the two properties 18331 and 18305 County Road 29, Lots A and B Exemption No. 1057-32-4 RE 4214 SE 'A of Section 32, T4N, R66W, 6` PM that encompass USR 13-0043 recorded on 8/31/2016 we have agreed to vacate Lot A from the USR. Our son who is occupying Lot A is buying the property from us and will be using for his residence. He will not be operating a business from the property and does not need the USR. We have given permission to the Buyer of Lot B Nathan D Naill to move the USR to Lot B only. Access Permit Application.pdf I am ok with the change in type of vehicles. I would like them to install some tracking control and to get an updated access permit. I attached an access permit to the email. We will not charge for the updated access permit. The following is an example of the tracking control we would like: • Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled asphalt or road base. • Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft of asphalt. *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. I had a staff question: 1 This info. Came in after our staff meeting. This gentleman is looking at purchasing the USR13-0043 property. Vehicle trips line up (30 round trips per day) but he will have some larger vehicles (12 dump trucks and water trucks) - where the previous USR only had pick-up trucks coming to the site. There is an existing access permit AP13-00145. There is no limit on the plat for types of equipment. I think he is probably OK but wanted to make sure no access permit requirements... with the larger vehicles...
