RESOLUTION
RE: AMENDMENT TO SECTION 3 . 14 OF THE WELD COUNTY ZONING RESOLUTION
REQUIRING ADDITIONAL FRONTYARD SETBACK IN ALL ZONE DISTRICTS .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested withthe authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado conducted a public hearing in its Chambers on the first
floor of the Weld County Centennial Center on April 19 , 1978 for
the purpose of considering e proposed amendment to Section 3 . 14
of the Weld County Zoning Resolution requiring additional front-
yard setback in all zone districts to meet the future right-of-
way needs as shown in the Weld County Throughfare Plan, and
WHEREAS , the Board considered the recommendations of the Weld
County Planning Commission and the statements of the Weld County
Department of Planning Services Staff in this matter, and
WHEREAS , the Board finds that it is in the best interests of
Weld County to adopt the proposed amendment to Section 3 . 14 of the
Weld County Zoning Resolution, as submitted by the Weld County Plan-
ning Commission.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that Section 3 . 14 of the Weld County
Zoning Resolution is hereby amended as shown in the certified copy
of the amended Section 3 . 14 , attached hereto and incorporated as a
part hereof by this reference.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 19th day of
April , A.D. , 1978 .

Amend Section 3 . 14 of the Weld County Zoning Resolution by
adding as a reference (5) after the column identified as the
"Minimum Front Yard Setback" and adding a new footnote (5)
to the text .
(5) The front yard setback shall be measured from the ad-
jacent edge of the right-of-way line of the abutting
public road. If the abutting public road is not desig-
nated to he upgraded to a higher classification as
defined by the Weld County Thoroughfare Plan , the
front yard setback shall be measured from the existing
right-of-way line of the public road. If the abutting
public road is designated to be upgraded to a higher
classification as defined by the Weld County Thorough-
fare Plan necessitating additional right-of-way , then
the setback shall be measured from the future right-
of-way line.
The future right-of-way line is determined by adding
the distance of the additional needed right-of-way to
the existing right-of-way line.
The following is a list of the right-of-way needed for
road designations as defined in the Weld County Thor-
oughfare Plan :
a. Arterial or Rural Arterial - 100 ' ROW
b. Expressway - 130' ROW
c. Rural Expressway - 200 ' ROW
d . Freeway - 250.' ROW
The future right-of-way line (measured from the center-
line of the road) is determined by dividing the needed
right-of-way as defined above in half .
