RESOLUTION RE: APPROVE PETITION FOR VACATION OF A PORTION OF COUNTY ROAD RIGHT- OF-WAY - ROSE HOJIO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Rose Hojio, 4698 Kiowa Drive, Greeley, Colorado 80634, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of the right-of-way adjacent to Parcel No. 095926200024, south of Kiowa Drive, being more fully described as follows: West 30 feet of Subdivision Exemption, SE -645; being a portion of the NE1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado, as further described in Exhibits B and C. WHEREAS, a hearing before the Board was held on the 6th day of November, 2017, at which time the Board deemed it advisable to continue said matter to November 20, 2017, to allow further time for consideration by the City of Evans, and WHEREAS, the Department of Public Works and the City of Evans have recommended denial of said request, and WHEREAS, on November 20, 2017, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by the applicant, staff, and the public, and WHEREAS, the Board modified the requested petition to be described as vacation of the right-of-way adjacent to Parcel No. 095926200024, south of Kiowa Drive, being more fully described as follows: West 30 feet of Subdivision Exemption, SE -645, except for the south 1.0 foot; being a portion of the NE1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado, totaling 259 feet of the 300 feet petitioned for, and as further described in Exhibits B and C. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition from Rose Hojio to vacate a portion of County Road Right -of - Way, be, and hereby is, approved, as modified by the Board to the area described as the vacation of the right-of-way adjacent to Parcel No. 095926200024, south of Kiowa Drive, being more fully described as follows: West 30 feet of Subdivision Exemption, SE -645, except for the south 1.0 foot; being a portion of the NE1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado, totaling 259 feet of the 300 feet petitioned for, and as further described in Exhibits B and C, retaining upon the described land a utility easement for purposes of existing and future utilities. BE IT FURTHER RESOLVED by the Board that the portion of right-of-way described in Exhibit C, be, and hereby is, vacated, effective upon recording of a survey showing the new property boundaries and the recording of this resolution. BE IT FURTHER RESOLVED by the Board that any persons owning dedicated and recorded easements and rights -of -way for the use of the vacated right-of-way, if any, shall not be affected by the right-of-way vacation authorized herein. BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral interests it may possess in the area of the vacated right-of-way and that the vacation authorized herein shall in no away affect such mineral interests. BE IT FURTHER RESOLVED by the Board that a permanent utility easement shall be retained for existing and future utilities. The City of Evans does not support the request to vacate the right-of-way as proposed for the following reasons: 1) The Subdivision Exemption Plat, SE -645, as approved and recorded under recordation Number 2703911, on July 1/1999, acknowledged the existing 30 -ft County Road ROW lying along the east 30 -ft of the West Line SW 1/4 Sec. 26, T5N, R66W. In addition the Subdivision Exemption included an additional 20 -ft Road ROW Reservation in addition to the existing 30 - ft County Road Easement. The Subdivision Exemption plat makes a reference to the 30' County Road ROW (Undeveloped) in the "BEFORE" Exhibit and then identifies the same area as a 30' County Road Easement on the "AFTER" exhibit. From the information provided on the Subdivision Exemption Plat, it appears that the County required the existing 30 -ft easement parallel to the West Line of the SW 1/4 Sec. 24, T%N, R66W to remain which requiring an additional 20 -ft for future road right-of-way. In addition, it appears from the exemption plat, that Kiowa Drive was extended east to west along the North portion of the property, providing a 60 -ft right-of-way for Kiowa Drive, to provide public access to the properties lying east of the subject property. Since Kiowa Drive is not labeled as an Easement, we assume that this is a road right-of-way dedication. The City of Evans believes that retaining this easement in question as a "Future" roadway connection provides a critical public safety function by providing a North -South connection between 37th Street and 49th Street. Maintaining this future road linkage improves traffic flow and reduces delays for residents and well as Police and Fire Services in the area. This linkage is recognized on the Weld County Transportation plan as a right -of way connection. 2) Secondly, the City currently has an 8 -inch water line located within this public easement which provides water service to the Arrowhead Subdivision. In addition to the existing 8 - inch water line, there is a 30 -inch stormwater outfall from the Nevilles Crossing subdivision to the Ashcroft Draw drainage. Both of these utility lines will need to retain easements necessary for each of the utility lines. The City of Evans would respectfully request that both the 30 -ft north -south easement plus the additional 20 -right-of-way reserve area be maintained and that the City and County look for an opportunity to construct the road segment from Kiowa Drive south to 47th Avenue. This is along the alignment of what would be CR 33 but is more commonly known as 47th Avenue. The applicants have indicated that they have been maintaining the vacant right of way. The entire 30' of public right of way falls within the county parcel conveyed to Rose Hojio by deed recorded at Reception #4001718. The parcel can also be identified as the 4 Quarter Land Company parcel on Subdivision Exemption SE -645, being a portion of the NE1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M. , Weld County Colorado recorded 07/01/1999. The SE plat shows the 30' County Road easement along with a 20' reservation for future right of way. General Information The applicant's property is situated between two old Weld County Subdivisions that are now surrounded by the City of Evans. Specifically, the property is bound on the north by a county parcel and the Tuscany Annexation (Evans), to the west by the Arrow Head Subdivision (Weld County), to the south by Neville's Crossing Subdivision (Evans) and West Hill N Park Subdivision (Weld County) and to the West by Recorded Exemptions 3996 and 3997. Weld County maintains the roads in the Arrowhead and West Hill N Park Subdivision. County maintenance is on a 7- 10 year maintenance schedule. The right of way provides connectivity between the Arrowhead and Hill N Park subdivision however no physical road exists. If a physical connection between the two subdivisions is built, it may require additional county maintenance. The applicant has indicated that there are utilities located in the right of way. The right of way provides for opportunities for future connectivity and the extension of 47th Avenue as well as providing an emergency access if needed. The City of Evans Master Transportation Plan identifies the connection going to the east and therefore Public Works feels that input form of City of Evans is needed before a fmal determination is made. Existing County Road Right of Way Based on the information found we have determined the following: • 30' of right of way exists along the west 30' of Section 26, Township 5 North, Range 66 West of the 6' P.M. per the 1889 Resolution. • The public road right of way in the Arrowhead and Hill N Park Subdivisions have been dedicated to the County per the subdivision process. • The public for right of way for 47TH Avenue (50' right of way) within the Hill N Park Subdivision terminates at the intersection of 47th Avenue and Mesa Verde Drive and does not extend north to the section corner. When Evan annexed Nevilles crossing they also annexed all the right of way for 47th that was dedicated to the County in Hill N Park Subdivision as well as the sliver north of the Hill N Park Subdivision boundary which means the board will need the consent of Evans to vacate. Frank please let us know what exactly that means. Do we need Evan to pass a formal resolution or is an email to staff adequate. Is that something that we just wait to see what their referral states or should the applicants pursue that first. I do not mind reaching out to Evans staff to ask if you would like. I have attached Evan's Master Transportation Plan and you can see that their plan actually does not identify the connection of 47th as we all discussed but instead shows it going to the east across the applicants property. This doesn't surprise me given the site constraints. Those types of improvements are not cost effective for a developer unless there is a significant benefit and that doesn't seem to really exist given the existing development. PW will revise our referral to provide more information and discuss internally what this means to us from a maintenance standpoint. It sounds like we do not have an IGA from a land use perspective and I will double check that we don't one related to maintenance of roads as well and include that in the referral. The Evan Master Transportation plan would indicate we maintain may see additional traffic and we need to be sure we can address our impacts. We will work on revising the referral next week and we will provide our recommendation. I was thinking that the mailing list looked pretty long so I took a look at the notification requirements and our interpretation is that the notification is only those persons owning land adjacent to the ROW to be vacated. I think we need to know for sure whether the parcel touches Evans. Either way, we need to let Evans know and get their position. I think that we ought to probably take a week or so to see if we can hammer out the parcels, the annexation, etc. And then we need to just schedule it for a hearing. Bruce reminded me that this is essentially a hearing like any other hearing in front of the board, meaning that we shouldn't discuss it with them ahead of time, and we should essentially give a recommendation to the board about whether we think it is good or bad, but that it is really on the applicant to present to the board why it is appropriate. The right of way is located along the west 30' of Section 26, Township 5 North, Range 66 West of the 6tl' P.M. and is approximately 7,800 square feet (0.179 ac). This is along the alignment of what would be CR 33 but is more commonly known as 47th Avenue. The applicants have indicated that they have been maintaining the vacant right of way. The entire 30' of public right of way falls within the county parcel conveyed to Rose Hojio by deed recorded at Reception #4001718. The parcel can also be identified as the 4 Quarter Land Company parcel on Subdivision Exemption SE -645, being a portion of the NE1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M. , Weld County Colorado recorded 07/01/1999. The SE plat shows the 30' County Road easement along with a 20' reservation for future right of way. General Information The applicant's property is situated between two old Weld County Subdivisions that are now surrounded by the City of Evans. Specifically, the property is bound on the north by a county parcel and the Tuscany Annexation (Evans), to the west by the Arrow Head Subdivision (Weld County), to the south by Neville's Crossing Subdivision (Evans) and West Hill N Park Subdivision (Weld County) and to the West by Recorded Exemptions 3996 and 3997. Weld County maintains the roads in the Arrowhead and West Hill N Park Subdivision. The maintenance is on a 7-10 year maintenance schedule. The right of way provides connectivity between the Arrowhead and Hill N Park subdivision however no physical road exists. If a physical connection between the two subdivisions is built, it may require additional county maintenance. There are utilities located in the right of way. The right of way provides for opportunities for future connectivity and the extension of 47th Avenue as well as providing an emergency access if needed. Existing County Road Right of Way Based on the information found we have determined the following: • 30' of right of way exists along the west 30' of Section 26, Township 5 North, Range 66 West of the 6t P.M. per the 1889 Resolution. • The public road right of way in the Arrowhead and Hill N Park Subdivisions have been dedicated to the County per the subdivision process. • The public for right of way for 47TH Avenue (50' right of way) within the Hill N Park Subdivision terminates at the intersection of 47th Avenue and Mesa Verde Drive and does not extend north to the section corner. CITY OF EVANS RESPONSE Fred Starr, Director of the Evans Public Works Department, submitted the below comments on Monday, November 13, 2017: The City of Evans does not support the request to vacate the right-of-way as proposed for the following reasons: Retaining this easement in question as a "Future" roadway connection provides a critical public safety function by providing a North -South connection between 37th Street and 49th Street. Maintaining this future road linkage improves traffic flow and reduces delays for residents and well as Police and Fire Services in the area. The City currently has an 8 -inch water line located within this public easement which provides water service to the Arrowhead Subdivision. In addition to the existing 8 -inch water line, there is a 30 -inch stormwater outfall from the Nevilles Crossing subdivision to the Ashcroft Draw drainage. Both of these utility lines will need to retain easements necessary for each of the utility lines. The City of Evans would respectfully request that both the 30 -ft north -south easement plus the additional 24 -right-of-way reserve area be maintained and that the City and County look for an opportunity to construct the road segment from Kiowa Drive south to 47th Avenue. PUBLIC WORKS RESPONSE 30' of right-of-way exists along the west 30' of Section 26, Township 5 North, Range 66 West of the 6th P.M., per the 1889 Resolution. The public road right-of-way in the Arrowhead and Hill N' Park Subdivisions have been dedicated to the County per the subdivision process. The public road right-of-way for 47th Avenue (50' right-of-way) within the Hill N' Park Subdivision terminates at the intersection of 47th Avenue and Mesa Verde Drive and does not extend north to the section corner. West Hill N' Park 5th Filing does not include the dedication for the extension 47th Avenue; however, there is about 170' feet underlying right-of-way (30') by Resolution. The public road right-of-way in the Neville's Crossing has been dedicated and is maintained by the City of Evans. The total area of the right-of-way to be vacated is approximately 7,800 sq. ft.( 0.179 acre) The Public Works CIP 5 Year Plan does not identify any improvements to be made in this area. I wanted to get a hold of you to make sure you are aware of some of the things that will need to be done and then also some of the limitations of the vacation. You will need to get a survey of the new property boundaries, including the 1 foot gap between the south boundary line and the vacated portion of the property. The survey does not need to show things like the house, driveways, etc. However, we do need a metes and bounds description of the land that you are asked to vacate. You will need to contact a surveyor to do that, and we can work with them if needed. That way it is clear specifically what was vacated. You can submit that survey to the clerk to the board's office. There is a provision in the statute, 43-2-302(1)(a) which states that if the vacated portion abuts a subdivision, as this does, then the subdivision would have the land basically incorporated as part of the subdivision. From a practical perspective, this means that neither you nor the subdivision can build anything on this portion of vacated land, but also absent some condemnation or other affirmative action on the part of Evans, there would also be no road that could be built on the property. So the land would remain as it is now unless Evans did something. Once we get the survey, we can record the documents, and then there will be a clear record showing the action the board has taken.
