PIPELINE APPROXIMATELY ONE (1) MILE LONG (TWO 12 -INCH NATURAL GAS
PIPELINES ORIGINATING AT THE CROSSROADS COMPRESSOR STATION
[USR17-0023] AND TERMINATING AT THE MEWBOURN 160 PIPELINE [USR12-0006])
IN THE A (AGRICULTURAL) ZONE DISTRICT — DCP OPERATING COMPANY, LP
A public hearing was conducted on December 6, 2017, at 10:00 a.m., with the following present:

The following business was transacted:
la I hereby certify that pursuant to a notice dated November 3, 2017, and duly published
November 8, 2017, in the Greeley Tribune, a public hearing was conducted to consider the
request of DCP Operating Company, LP, for a Site Specific Development Plan and Use by Special
Review Permit, USR17-0048, for a greater than 12 -inch high pressure natural gas pipeline
approximately one (1) mile long (two 12 -inch natural gas pipelines originating at the Crossroads
Compressor Station [USR17-0023] and terminating at the Mewbourn 160 Pipeline [USR12-0006])
in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter
of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated the proposed pipelines will each be approximately .35 miles in length and are co -located
within one easement right-of-way and start at the Crossroads Booster Station and terminate at
the Mewbourn Pipeline. He reviewed the pipeline construction and the applicant's commitment to
reseed and regrade the construction area after completion. Mr. Ogle stated the proposal contains
additional equipment to include two (2) launchers at the Crossroads Booster Station and two (2)
receivers at the Mewbourn 160 Pipeline location. He reviewed the total land impact and stated
the pipeline route is being constructed on land owned by the applicant. Mr. Ogle reported no
concerns from the Colorado Parks and Wildlife or History Colorado. He reviewed the Emergency
and Safety Plan and stated the pipeline is being designed and constructed to meet the Colorado
Department of Transportation (CDOT) requirements. Mr. Ogle reported ten (10) referrals were
sent out and three (3) responses were received with comments taken into consideration in the

recommendation. He displayed a site map and entered the favorable recommendation of the
Planning Commission into the record as written.
• Evan Pinkham, Department of Public Works representative, provided a brief overview of the
transportation plans and requirements, stating the pipelines do not cross any county roadways.
He stated the Department of Public Works is requiring an Improvements Agreement for the
construction period without collateral, the applicant will need to submit a Right -of -Way Permit
and/or a Special Transport Permit, if required, and it will need to be determined if the applicant
needs a temporary construction Access Permit or a permanent Access Permit. In response to
Chair Cozad, Mr. Pinkham stated the Improvements Agreement language crafted by Mr. Choate
at the prior pipeline hearing would be acceptable for all pipelines moving forward.
Hayley Balzano, Planning Services Engineer representative, presented the drainage and
grading requirements, stating pipelines are excepted from the requirements for a drainage report
and detention pond design. She reviewed the Development Standards relevant to Engineering.
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions, stating portable toilets are acceptable along the construction route. She stated
Development Standards (DS) #10-15 address Environmental Health items.
IR Patrick Groom, Attorney, represented the applicant and stated this pipeline is part of the
larger Mewbourn project and includes the Crossroads Compressor Station and the reason there
are two (2) pipelines is so that one line will deliver gas to the Mewbourn 160 pipeline which will
deliver the gas to the Mewbourn Processing Plant and the other pipeline will deliver gas to the
Mewbourn 160 line and then deliver the gas to the O'Connor Processing Plant. He confirmed the
location of these pipelines are completely on land owned by the applicant and there are no
separate easement agreements. He asserted that although there is no objection to an
Improvements Agreement because it is a construction site with the same access as the
Crossroads Compressor Station, he is unsure if it is necessary because there are already tracking
control methods in place and the additional truck traffic will only be to deliver pipe to the location.
In response to Chair Cozad, Mr. Groom stated there is no Improvements Agreement for the
Crossroads USR.
ef No public testimony was offered concerning this matter.
• The Board agreed to delete Condition of Approval (COA) #1.A due to the project being
entirely on the applicant's land. Commissioner Freeman confirmed with staff and suggested
deleting (COA) #1.B. Commissioner Kirkmeyer suggested deleting COA #1.C.5, and Chair Cozad
added the deletion of COA #1.C.9 and 10, and amending COA #1.C.8 by adding the Access
Permit number. Commissioner Kirkmeyer recommended deleting COA #5.C and amending COA
#5.A to eliminate the words, "...for construction of non -pipeline items such as structures, parking
lots, laydown yards, et cetera, ..." . Ms. Balzano stated it is acceptable to remove COA #5.A
entirely. Ms. Light recommended adding the words, during construction to Development
Standards (DS) #10, 11 and 12. Commissioner Kirkmeyer reminded the Board to delete the
words, "...,such as County Road 49..."from DS #7. The Board agreed to all the aforementioned
amendments.

Chair Cozad reviewed the changes for the applicant.
In response to Chair Cozad, Mr. Groom, on behalf of DCP Operating Company, LP, indicated
they have reviewed, and agree to abide by, the Conditions of Approval and Development
Standards, as amended.
Commissioner Kirkmeyer moved to approve the request of DCP Operating Company, LP,
for a Site Specific Development Plan and Use by Special Review Permit, USR17-0048, for a
greater than 12 -inch high pressure natural gas pipeline approximately one (1) mile long (two
12 -inch natural gas pipelines originating at the Crossroads Compressor Station [USR17- 0023]
and terminating at the Mewbourn 160 Pipeline [USR12-0006]) in the A (Agricultural) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended and entered into the record.
The motion was seconded by Commissioner Conway, and it carried unanimously. There being
no further discussion, the hearing was completed at 11:36 a.m.
This Certification was approved on the 11th day of December, 2017.
