BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 4, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 4, 2017, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Julie A. Cozad, Chair
Commissioner Steve Moreno, Pro-Tem
Commissioner Sean P. Conway - EXCUSED
Commissioner Mike Freeman

• MINUTES: Commissioner Freeman moved to approve the minutes of the Board of County
Commissioners meeting of October 2, 2017, as printed. Commissioner Moreno seconded the motion,
and it carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of
Hearings conducted on October 2, 2017, as follows: 1) Hearing to allow public input on the performance
of Weld County in carrying out the Wattenberg Water System Improvement Project which was financed
with federal Community Development Block Grant funds. Commissioner Kirkmeyer seconded the
motion, which carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PROCLAMATIONS:
1) DOMESTIC VIOLENCE AWARENESS MONTH - OCTOBER, 2017: Chair Cozad read the
proclamation for the record. Carol Patch, A Woman's Place Executive Director, stated A Woman's Place
was created approximately 40 years ago by community members and, unfortunately, as the population
continues to grow, so does the need for protective services. She thanked the Board and all of the partners
involved for the collaborative efforts on behalf of victims of violence. Commissioner Moreno thanked
them for their work, and stated that although it is a sad day that we must recognize this need, he is

thankful for the work that is being done. Commissioner Kirkmeyer agreed and expressed her appreciation
for the help and compassion that is offered to victims when they are struggling the most. Commissioner
Freeman agreed and stated that although fear can make it difficult to make the call, he is thankful there
is a place for victims to reach out. Chair Cozad stated violence is a horrific situation for anyone to go
through, so she appreciates the opportunity to share in the effort to increase knowledge and build
awareness in the community. (Clerk's Note: The meeting was paused for a photo opportunity.)
El PUBLIC INPUT: No public input was given.
COMMISSIONER COORDINATOR REPORTS: Commissioner Freeman stated last Thursday he
spoke at the Pierce Senior Center concerning the Commission on Aging and Senior Law Day, and he
also received positive feedback concerning the UNC senior meal service. El Commissioner Moreno
stated he, Commissioner Kirkmeyer and the Workforce Development team attended the Remarkable
Greeley event last Thursday, as well as various local community representatives, and they heard from
quality guest speakers who encouraged actively listening to ideas from local citizens. He reported that
at the recent Airport Authority meeting, he and Commissioner Freeman joined a roundtable discussion
with representatives from the Federal Reserve and banking industry regarding continued growth in Weld
County and across the state. Lastly, he discussed the preliminary budget of the Frederick Urban Renewal
Authority. eiCommissioner Kirkmeyer reported last Thursday, 200 gas monitors were distributed in
Erie, and she received feedback of continued support and appreciation of the program, with more than
100 residents signing up for the next delivery. Monday she visited the Fort Lupton Senior Center and
discussed the County budget, roads, and ongoing programs, with positive feedback in return. She also
met with the Towns of LaSalle and Evans to discuss the U.S. Highway 85 project in coordination with
CDOT and the Union Pacific Railroad Company. Lastly, she and Commissioner Moreno spoke at the
Habitat for Humanity event in Hudson where the recipient, Veteran James Hamm, shared the story of his
experience during war while overseas. She stated it was an impactful event and she expressed her
gratitude for the sacrifice of both him and his wife. a Chair Cozad thanked the Front Range Fire and
Rescue for hosting the distribution of approximately 140 gas monitors to households in Milliken,
Johnstown, and the surrounding area. She noted the final distribution event will be in Mead, after which
residents can come to the Greeley Planning office and obtain monitors through the end of October. She
reported the Fair Board elected new officers and work continues to plan and fundraise for the upcoming
100th Anniversary of the Fair. Chair Cozad also commented on the numerous tragic events that have
been taking place locally, across the nation and around the world. She attended a Break the Silence
event, hosted by Keiser, addressing the issues of mental and behavioral health that affect many aspects
of society. She also thanked the Public Works staff, specifically, Jay McDonald, Tiffane Johnson, Don
Dunker, Cameron Parrott, and Clay Kimmi, and the contractor of the CR 47 project (from CR 60.5 to
State Highway 392) for their great presentation and public engagement at the community meeting. She
noted they will be circulating newsletters and promoting online information as the project progresses.
Commissioner Freeman added he helped distribute 100 monitors to citizens from Eaton, Ault and
Pierce, and he is glad to participate in a program that helps people feel safer in their homes. Chair Cozad
agreed the entire Board has received a positive and grateful public response.
NEW BUSINESS:
1) CONSIDER CONTRACT ID #1480 LICENSE EXPANSION AGREEMENT AND VERIFICATION
FORM FOR PEOPLESOFT SOFTWARE AND AUTHORIZE CHAIR TO SIGN - ORACLE AMERICA,
INC.: Barbara Connolly, Controller, explained the County currently has 1,500 licenses; however, they
reported 1,522 employees, therefore, this agreement will purchase an additional 200 licenses, for the
amount of $21,886.80. Commissioner Moreno moved to approve said agreement and authorize the
Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously.

El 2) CONSIDER FILING OF PROCEEDING IN EMINENT DOMAIN, PURSUANT TO SECTION
38-1-101, C.R.S., AGAINST THE CORPORATION OF THE PRESIDING BISHOP OF THE CHURCH
OF JESUS CHRIST OF LATTER-DAY SAINTS: Bob Choate, Assistant County Attorney, requested
authorization to pursue condemnation on certain property along the CR 47 project. He explained the
land owner is working with their attorneys, and he does not anticipate an answer until late October, at the
earliest. Mr. Choate stated the parties have also discussed entering into a License Agreement to allow
use of the right-of-way during the interim, with the provision that it cannot be revoked any time prior to
the Court's determination. He noted, if the matter can be resolved, then Court action may not be
necessary. Chair Cozad confirmed neither the property owner, nor a representative, were present.
Commissioner Kirkmeyer moved to approve authorizing the County Attorney's Office to proceed with
filing in Eminent Domain. Commissioner Moreno seconded the motion. Commissioner Kirkmeyer
commended Mr. Choate for his review of the matter and for providing sound legal council on behalf of
the County. She also recognized the negotiation efforts of Tiffane Johnson, Deaprtment of Public Works,
while working on this project.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:29 a.m.
