EQUIPMENT FOR THE ARISTOCRAT RANCHETTES SUBDIVISION) IN THE
A (AGRICULTURAL) ZONE DISTRICT - ARISTOCRAT RANCHETTES WATER
PROJECT, INC.
A public hearing was conducted on May 24, 2017, at 10:00 a.m., with the following present:

The following business was transacted:
VI I hereby certify that pursuant to a notice dated April 13, 2017, and duly published April 19,
2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Aristocrat
Ranchettes Water Project, Inc., for a Site Specific Development Plan and Use by Special Review
Permit, USR17-0005, for Uses similar to the Uses listed in Section 23-3-40 as Uses by Special
Review as long as the Use complies with the general intent of the A (Agricultural) Zone District
and Accessory buildings with Gross Floor Area larger than the four percent (4%) of the total lot
area, per building on lots in an approved or recorded subdivision plat or part of a map or plan filed
prior to adoption of any regulations controlling subdivisions (proposed 2,400 -square -foot building
for storage of water system and community equipment for the Aristocrat Ranchettes Subdivision)
in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record.
le Chair Cozad reviewed the procedures to follow should this case result in a tie vote due to
four Commissioners being present and Commissioner Conway excused.

• Chris Gathman, Department of Planning Services, presented a summary of the proposal to
construct an accessory building for water and equipment storage without the appropriate permits.
He noted there is a current Zoning Violation under ZCV16-00143, due the placement of a structure
without the appropriate permits. Mr. Gathman stated the site is located within the three (3) mile
referral area of the City of Fort Lupton and eleven referrals (11) were sent out and seven (7)
responses were received. He displayed the photographs of the building and surrounding site,
pointed out the structures that will be removed before the new structure is built and entered the
favorable recommendation of the Planning Commission into the record as written.
Evan Pinkham, Public Works Department representative, provided a brief overview of the
transportation plans and requirements. He noted there is an existing access permitted under
AP17-00141, which is for the use of the existing access point on Dale Avenue. He stated this is
a gravel road, which is designated on the Weld County Road Classification Plan as a local road
and staff will not require tracking control, nor an Improvements Agreement.
• Hayley Balzano, Planning Services Engineer representative, presented the drainage and
grading requirements. She explained this site is exempt from a detention pond, and drainage
design because the total area is less than an acre.
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions. She stated since this is a storage building, the applicant may utilize the adjacent
community building for restrooms which has a permitted septic system for 30 people. The
Development Standards (DS) 6 through 13 address Environmental Health items.
In response to Chair Cozad, Harold Leggett, applicant representative, stated the building will
be to store pipe, fittings and other equipment out of the weather.
• No public testimony was offered concerning this matter.
• In response to Chair Cozad, Mr. Leggett indicated he has reviewed, and agrees to abide
by, the Conditions of Approval and Development Standards.
• Commissioner Kirkmeyer recommended removing Condition of Approval #1.A.10 concerning
the entrance gate setback, and the Board agreed.
Commissioner Kirkmeyer moved to approve the request of Aristocrat Ranchettes Water
Project, Inc., for a Site Specific Development Plan and Use by Special Review Permit,
USR17-0005, for Uses similar to the Uses listed in Section 23-3-40 as Uses by Special Review
as long as the Use complies with the general intent of the A (Agricultural) Zone District and
Accessory buildings with Gross Floor Area larger than the four percent (4%) of the total lot area,
per building on lots in an approved or recorded subdivision plat or part of a map or plan filed prior
to adoption of any regulations controlling subdivisions (proposed 2,400 -square -foot building for
storage of water system and community equipment for the Aristocrat Ranchettes Subdivision) in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as entered

into the record and amended. The motion was seconded by Commissioner Moreno, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:51 a.m.
This Certification was approved on the 31st day of May, 2017.
