North Weld County Water District provides water and individual septic systems provide sewage disposal for each home. The 4 bedroom residence addressed as 621 O Street did have a statement of existing (SE -1700008) and inspection completed. There was not enough information provided to determine if the field is adequate however no evidence of failure was observed. The 2 bedroom residence addressed as 631 O Street also had a statement of existing (SE -1700009) and inspection completed. There was not enough information provided to determine if the field is adequate however no evidence of failure was observed. As both systems were installed prior to 1960 compliance with current regulations is not required unless the systems fail. We recommend the following appear as notes on the Change of Zone plat: 1. Water service may be obtained from North Weld County Water District. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: Change of Zone from C-3 (Commercial) Zone District to the A (Agricultural) Zone District. This project is north of and adjacent to CR 64 and is west of CR 39.5. Parcel number 080329000073 . Access is from CR 64. Access: An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division. Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance. Questions pertaining to access permits or access design shall be directed to the Public Works Department. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. When feasible, there shall be no net increase in the number of accesses to a public road. Contact Public Works to discuss your access. Roads: County Road 64 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. Traffic: Latest ADT on CR 64 was taken on 7/10/2014 which counted 1525 vpd with 25% trucks. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. County Road 64 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road which requires 140 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. (Department of Public Works) MEMORANDUM To: Diana Aungst, Planner March 21, 2017 From: Bethany Pascoe, Zoning Compliance Officer Subject: COZ17-0001 Referral Upon review of my case files and computer, I noted an active Zoning Violation (ZCV16-00137). This violation was initiated due to the presence of livestock in the Commercial Zone District. When the zoning was brought to the property owner and tenants attention, they immediately started the process of completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office; therefore, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. Approval of this application by the Board of County Commissioners would correct the outstanding violations. If this application is denied, the Department of Planning Services asks that the Board forward these cases to the County Attorney's Office for legal action through the District Court process, but to delay that legal action for 30 (thirty) days to allow the applicant time to remove any and all livestock.
