URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within a Non -Urbanizing Drainage Area: Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -URBANIZING areas. Detention pond waived and a simple drainage narrative: A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for an exception to detention requirements listed below. The drainage narrative must include at the minimum: 1. Description which exception is being applied for and supporting rationale 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. Exceptions shall be supported with a drainage narrative. a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 15) Approved by a variance. The applicant has submitted a Drainage Narrative and Variance stating that the due to the existing drainage on the site, the development will not change the site runoff. The variance is signed and stamped by a Colorado Licensed Professional Engineer. The applicant has not yet signed the variance request. MS4: This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692- 3575. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. The applicant must sign the `Applicant Signature' line of the submitted Variance Request Form — For Engineers. B. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. COMMENTS: General Project Information/Location: Project description: A Site Specific Development Plan and Use by Special Review Permit for any use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or industrial zone districts (parking and storage of construction vehicles, materials and equipment along with offices associated with the construction company and a campground for five (5) spaces RV/camper spaces (for overnight stays) for employees associated with the construction company), provided that the property is not a Lot in an approved or recorded This project is east of and adjacent to CR 11 and is south of CR 6. Parcel number 146725000058. Access is from CR 11. Roads: County Road 11 owned and maintained by the Town/City (Municipality) of Broomfield. The Municipality has jurisdiction over all accesses within their jurisdiction. (Department of Public Works) G0 r1 uNTY WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www,weldhealth,org Memorandum To: Chris Gathman From: Lauren Light, Environmental Health Services Date: October 12, 2016 Re: USR76-0035 Otto and Karen Luhrs Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial zone districts (parking and storage of construction vehicles, materials and equipment along with offices associated with the construction company and a campground for five (5) spaces RV/camper spaces (for overnight stays) for employees associated with the construction company), provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. A tap from Central Weld County Water District and a septic system sized for three bedrooms and a commercial shop with 5 employees (SP -0100558) serve the existing buildings. If the applicant intends to utilize the existing septic system for additional business use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. The application indicates a new septic system will be constructed for the camping trailers. The application indicates that approximately 75 to 100 employees could access the site on a weekly basis. A portable toilet and bottled water can be used for employees who are on site for 2 consecutive hours or less and 2 or less full time employees on site. There will be washing of equipment and minor maintenance on site. There will also be used oil storage as well as a small amount of fuel storage. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S. 6. Any vehicle or equipment washing area shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. Prior to utilizing the existing septic system permitted as SP -0100558 for additional business use, the system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM To: Chris Gathman, Planner September 22, 2016 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR16-0035 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV16-00042) was noted. This violation was initiated due to the parking and storage of construction vehicles, materials and equipment along with offices associated with the construction company and the utilization of camper/trailer-RV as a dwelling unit without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This violation was initiated on May 4, 2016. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied, staff is requesting that the Board of County Commissioners refer this case to the County Attorney's Office to proceed with legal, but to delay legal action for 30 (thirty) days so that all commercial storage/parking and RV -Camper -Trailers can be removed from the property. QUALI I CENTRAL WELD COUNTY WATER DISTRICT October 3, 2016 Chris Gathman Weld County Department of Planning Services Dear Mr. Gathman, Thank you for referring project USR16-0035 to Central Weld County Water District (CWCWD) for review. Parcel # 146725000058 is currently being served with water through tap #1825. The application indicates that CWCWD water will be used for commercial activity (office, house and RV parking spots) on this property. If tap #1825 is connected to lines that provide water for commercial activity the District will have additional requirements for backflow prevention. For properties with commercial activity we may require a Reduced Pressure Zone (RPZ) backflow assembly to be installed after the meter as containment. The tap holder can contact Dean Clarkin at our office to determine the exact requirements for their property, as instructions for installation are specific to the property and a full survey of the tap holder's water usage practices for their business may be required. A water tap installation is for a specific parcel of property and in no case will a customer be permitted to extend a service line from one parcel or property to another parcel to provide additional water service. Also, the District has the right to review the annual allotment and compare it to actual usage to determine if additional raw water will be required to be transferred to the District by tap holder. The proposed use of the property is construction company offices, equipment, and materials storage. The site is expected to generate approximately 50 trips of traffic a day. The property currently has four access locations onto CR 11. There are no planned changes to the current access locations. Broomfield does not see any difficulties in approving the current access with the new use. If access changes or is modified in the future (driveway improvements, new culverts, or change in water run- off into Broomfield maintained ditches) then, a Public Private Improvement Permit will be required from Broomfield.
