IIID' A regular meeting of the Weld County Planning Commission was held in the Weld County
Administration Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to
order by Chair, Bruce Sparrow, at 12:30 pm.
Roll Call.
Present: Bruce Johnson, Bruce Sparrow, Gene Stille, Jordan Jemiola, Joyce Smock, Michael Wailes,
Terry Cross, Tom Cope.
Absent: Cherilyn Barringer

REQUEST: A Major Amendment to MUSR15-0019 (A Minor Amendment to Site Specific Development
Plan and Use By Special Review Permit 2nd AMUSR-1405) to include
additional parking, additional expansion of the existing milk processing plant
along with three (3) additional future processing buildings, expansion of
existing plant support buildings along with future plant support buildings, and
more than the number of cargo containers allowed as a use by right per legal
lot or parcel in the A (Agricultural) Zone District.
Note: The original 4MJUSR16-03-1405 application that was submitted in June
2016 has been modified to include one (1) additional processing building
(350,000 square feet maximum size) and the boundary of the permit has been
expanded to include two additional parcels (Lot C and D of RECX16-0091).

LOCATION: South of and adjacent to State Highway 66 and approximately 2,500 feet east of CR 13.

recommendation and comments into the record. Mr. Gathman noted that no letters or correspondence
were received from surrounding property owners. The Department of Planning Services recommends
approval of this application with the attached conditions of approval and development standards.

on -site dust control, and the Waste Handling Plan.
Anne Johnson, Tetra Tech, 1900 South Sunset, Longmont, Colorado, stated that Aurora Organic
Dairy is proposing an expansion to their existing dairy operation. The applicants plan to increase the
land area to provide room for plant expansion, employee parking, maintenance shop and CNG/fueling
station. Ms. Johnson stated that it is a 24 hour, 7 days per week operation and added that at full build -
out there may be up to 425 full-time employees and 275 trucks accessing the site.
Commissioner Smock asked if all the milk is produced on site. John Butler, 8406 Spiniker Bay Drive,
Windsor, Colorado, stated that the milk processed on site comes from dairy farms in the panhandle of
Texas as well as Northeastern Colorado.
Commissioner Cope asked for an explanation of the drainage on site. Jeff Butson, Tetra Tech, 1900
South Sunset Street, Longmont, Colorado stated that drainage flows to the south and will go into a
storm sewer or channel and taken to the river, depending on how build -out progresses. Mr. Cope
mentioned that he was surprised that there is no requirement of a detention pond given the size of
roofs on site. Ms. Balzano said that there are some exceptions allowed in the code and in this case
the parcel is connected to the actual floodplain channel therefore it meets the list of exceptions.
Commissioner Smock asked to provide a description of how the access will work. Ms. Johnson stated
that there will be two deceleration lanes. One deceleration lane will be coming from the west,
approaching the east. She added that there will be a westbound deceleration lane, coming from the
east. Gene Capola, 9323 Ermandale Drive, Lonetree, Colorado, stated that there will also be a left
and right turn lane. He added that the right turn lane will be on the south side of the street and the left
turn lane, as you are going west, will be in the center of the road. Commissioner Cope asked where
the majority of traffic will be coming from/going to. Mr. Capola said they will be coming and going from
the west of the site.
The Chair asked if there was anyone in the audience who wished to speak for or against this
application. No one wished to speak.
The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.
Motion: Forward Case 4MJUSR16-03-1405 to the Board of County Commissioners along with the
Conditions of Approval and Development Standards with the Planning Commissions recommendation
of approval, Moved by Jordan Jemiola, Seconded by Bruce Johnson.
Vote: Motion carried by unanimous roll call vote (summary: Yes = 8).

REQUEST: A Site Specific Development Plan and 2nd Amended Use by Special Review Permit No.
USR-1360 for Mineral Resource Development Facilities including a Concrete
Batch Plant and a request to remove Development Standard No. 22 (Use by
Special Review Permit #1360 will be considered invalid fifteen (15) years from
the date of the Board of County Commissioners resolution. Should the owners
of the Batch Plant wish to continue operating, they must be approved for a
Planned Unit Development) in the A (Agricultural) Zone District
LEGAL DESCRIPTION: PART N2NE4 SECTION 9, T2N, R68W LOT A REC EXEMPT RE -4659 of the
6th P.M., Weld County, Colorado.
LOCATION: SOUTH OF AND ADJACENT TO HWY 119; WEST OF AND ADJACENT TO CR 7.
Kim Ogle, Planning Services, presented Case 2MJUSR16-03-1360, reading the recommendation
and comments into the record. Mr. Ogle noted that the current facility was approved for a concrete
ready -mix batch plant operation in 2002 by the Board of County Commissioners for the Western
Mobile application. The request was to operate from this location for a period of 15 years and if the
facility would operate for a longer term a Planned Unit Development application would be required.
This requirement was stated in Development Standard 22. Based on this standard, Martin Marietta
Materials, successor to Western Mobile must be approved for either a Planned Unit Development prior
to April 24, 2017 or to request that Development Standard 22 be removed from the Resolution. Mr.
Ogle stated that Martin Marietta is not making any other changes to their operations other than
requesting that Development Standard 22 be removed. The Department of Planning Services
recommends approval of this application with the attached conditions of approval and development
standards.

Commissioner Smock asked why this development standard was put into place. Mr. Ogle said that at
the time Western Mobile was operating across the street and that was when County Road 7 was going
to come across and it was going to be in the way of that improvement. St. Vrain Parks was going to
expand and acquire the lands north of Highway 119. Western Mobile said that they will move across
the street and would like to be there 15 years to make it worth their while. In 2011 Western Mobile
sold their asset to Martin Marietta.
N" Julie Mikulas, Martin Marietta Materials, 1800 North Taft Hill Road, Fort Collins, Colorado, stated
that Western Mobile and Lafarge worked to permit this location in 2002. They are not requesting any
changes to the permit other than removal of Development Standard 22. In regard to Fredericks
referral, she stated that she has discussed all the concerns in Fredericks letter with their planning staff
and will continue working with them. She added that they will be submitting a letter to them and are
confident they will have an agreement prior to the Board of County Commissioner hearing.
Commissioner Smock asked the applicants if they are considering annexation into Frederick. Ms.
Mikulas replied that they are not interested at this time in annexation.

LOCATION: NORTH OF CR 8; APPROXIMATELY 7500 FEET EAST OF CR 31.

comments into the record. The Department of Planning Services recommends approval of this
application with the attached conditions of approval and development standards.

Tim Allen, Advantage Engineers, 891 14th Street, Denver, Colorado, stated that Ecosite is working
on a build -to -suit plan for T -Mobile across the country. A large portion of this work is in the central
United States. Currently, they are working on 24 sites across the State of Colorado, including a
number of sites located in Weld County. These sites will bring in actual coverage. Based on the
coverage map there is currently no T -Mobile coverage in the area and this tower would fill in the gap
for customers.
Commissioner Smock asked about renting the tower to other carriers. Mr. Allen said that this tower will
be 170 foot high and can hold four to five additional carriers as well as ample ground space for any of
their equipment.
The Chair asked if there was anyone in the audience who wished to speak for or against this
application. No one wished to speak.
D" Mr. Allen referred to Condition of Approval 1.A.4 and added that they typically have a 20 foot
easement with a 12 foot road. He requested a waiver from the 30 foot access and utility easement as
the property owners has livestock corrals that they will be going through and they would like to limit the
disruption of the use of his property. Additionally, he requested that since they are recording a USR
mylar they would prefer to have the easement recording and mylar recording done jointly at that time.
He added that the Reception Number for the easement would be included on the mylar.
The Chair asked if staff was in favor of the applicants request. Mr. Ogle said that they would be in
favor of the 20 foot minimum access and the Reception Number for the recorded easement included
on the USR mylar.
Bob Choate, County Attorney, noted that the second sentence in Condition of Approval 1.A.4 "The
Reception number associated with this easement shall be shown and labeled" indicates that there is a
separate easement document that is recorded previous to the plat. He stated that if the applicant just
wants to create that easement via the plat, then the second sentence may be removed.
Motion: Amend Condition of Approval 1.A.4 to read "Show and label a 20 ft minimum access and
utility easement to provide legal access to the parcel on the site plan", Moved by Jordan Jemiola,
Seconded by Bruce Johnson. Motion carried unanimously.
The Chair asked the applicant if they have read through the amended Development Standards and
Conditions of Approval and if they are in agreement with those. The applicant replied that they are in
agreement.
Motion: Forward Case USR16-0039 to the Board of County Commissioners along with the
amended Conditions of Approval and Development Standards with the Planning Commissions
recommendation of approval, Moved by Bruce Johnson, Seconded by Terry Cross.
