HomeMy WebLinkAbout20171907.tiffHEARING CERTIFICATION DOCKET NO. 2017-56 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0011, FOR ONE SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - MICHEAL AND BROOKE MORELOCK A public hearing was conducted on July 5, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: le I hereby certify that pursuant to a notice dated June 2, 2017, and duly published June 7, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Michael and Brooke Morelock, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0011, for one Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. ta Michael Hall, Department of Planning Services, presented a brief summary of the proposal and stated the second dwelling is to be used for a home for the applicant's parents which is supported in the Weld County Code by Section 22-2-20.F.3 (A.Policy 6.6) regarding multigenerational quarters. He reviewed the parcel acreage and location in relation to the subdivision and reported no correspondence from surrounding property owners. Mr. Hall stated 13 referrals were sent out with six (6) responses indicating no concerns or with comments that have been considered. He reported the site to be within the three (3) mile referral area of the Towns of Hudson and Lochbuie, the City of Brighton, and Adams County, and he reviewed the referral responses from the aforementioned jurisdictions. Mr. Hall reviewed the site location in relation to relevant county roads, stated it is not within any Intergovernmental Agreement Area nor any overlay districts and the area is predominantly agricultural and rural residential. He reviewed other USRs in the vicinity and described the site layout. Mr. Hall displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. c: cm 1ln1m), PF.C H6), HLCLL),CT$CTS) ' f /I7 2017-1907 PL2482 HEARING CERTIFICATION - MICHEAL AND BROOKE MORELOCK (USR17-0011) PAGE 2 El Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, #AP17-00142, which stipulates to utilize the existing accesses. He reported no requirement for tracking control or an Improvements Agreement, and in response to Commissioners Conway and Kirkmeyer, he reviewed the average daily traffic counts. • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating water is provided by a permitted and shared well for both homes, the existing home has an existing septic system sized and permitted properly, and the new home will have a separate septic system. She reported Development Standards (DS) #3-7 as typical Environmental Health items and stated no concerns. • Micheal Morelock, applicant, stated he is a Marine Corp Veteran and chose to relocate to Colorado and since then has had extended family follow including his parents. He explained he is currently a police officer and his wife is a nurse and they are hoping to build a second home on their property for his parents to be able to assist in their care and also utilize their help with their school age children. No public testimony was offered concerning this matter. • In response to Chair Cozad, Mr. Morelock indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards. • In response to Commissioner Kirkmeyer, both Mr. Choate and Ms. Light explained Chapter 14, Article I, to be related to littering. Commissioner Kirkmeyer recommended deleting DS #3, 4, 9, 10, and changing DS #7 to read, "The property owner shall comply with all applicable rules and regulations of the Weld County Code." The Board agreed with these changes and deletions. • In response to Chair Cozad, Mr. Morelock indicated he agrees to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Kirkmeyer moved to approve the request of Micheal and Brooke Morelock, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0011, for one Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. The Commissioners expressed their appreciation for Mr. Morelock's service in both the military and as a police officer and commended him for caring for his parents.
