RE: DENIAL OF RECORDED EXEMPTION NO. 371 - MRS . ELVIRA IHNEN, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on January 22 , 1979 , at a regularly scheduled meet-
ing of the Board of County Commissioners , the Board heard the
request of Elvira Ihnen, et al. , for Recorded Exemption No. 371
on a parcel of land described below, and
WHEREAS, the Board of County Commissioners heard the recom-
mendation for denial of Recorded Exemption No. 371 made by the
staff of the Department of Planning Services, and heard the state-
ments of the representatives of Elvira Ihnen, et al. , and
WHEREAS , the Board of County Commissioners has determined
that the division into two parcels of a certain parcel of land,
as shown on the plat known as Recorded Exemption No. 371, being
the property of Elvira Ihnen, et al . , located on a parcel of land
in part of the Northwest Quarter of Section 6 , Township 4 North,
Range 68 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :

would come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , as set out in Section 30-
28-101 (10) (d) , CRS 1973 , as amended, and Section 2-lA of the
Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular proposed division of land is
not compatible with the purposes of the Weld County Subdivision
Regulations and the Weld County Comprehensive Plan, as set forth
in the recommendations of the Department of Planning Services
dated December 11, 1978 which recommendations are incorporated
by this reference as a part hereof.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for
Recorded Exemption No. 371 made by Elvira Ihnen, et al. , be and
hereby is, denied for the reasons set forth above.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
January, A.D. , 1979.

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a recorded exemption by Mrs. Elvira Ihnen, et al . The property is
described as Pt . NW4 Section 6, T4N, R68W of the 6th P. M. , Weld County,
Colorado . This property is located at the southeast corner of the inter-
section of Weld County Road 1 and Colorado Highway 60. The property con-
tains approximately 70 acres of Class I and II irrigated soils . The re-
quest is to split the property into parcels of 2. 5 acres and 67. 5 acres.
On December 11 , 1978, the Board of County Commissioners approved a re-
quest by Mrs . Elvira Ihnen for a lot size variance so that she could
make application for this recorded exemption. At the time they made the
decision on that request , the Department of Planning Services staff sub-
mitted a letter of recommendation for denial to the Board. A copy of
the letter for denial is included in the attached packet . Nothing has
been received by our office that would change our recommendation of
denial for this request as outlined in the letter to the Board of County
Commissioners dated December 11 , 1978.
However , if the Board approves this request , it should be pointed out
that the Colorado Division of Highways has requested the applicant to
provide an additional 30 feet of right-of-way on the south side of the
centerline of Highway 60 by reservation or dedication as local regula-
tions rmit .

Dear Commissioners:
The attached letter and related materials are in reference to a re-
quest for a lot size variance from Mrs. Elvira Ihnen, etal. The pro-
perty on which this request has been made is described as Pt. NW*,
Section 6, T4N, R68W of the 6th P. M. , Weld County, Colorado. This
property is located at the southeast corner of the intersection of
Weld County Road 1 and Colorado Highway 60. The property contains
approximately 72 -acres of Class I and II irrigated soils. The re-
quest is to obtain a variance from the minimum lot size requirement ,
Section 9-4 A. (6) , so that she may make application to apply for a
recorded exemption.
If this lot size variance is granted, Mrs. Ihnen will proceed with
her application to divide :the property into two parcels. Mrs. Ihnen
wishes to sell approximately 2-1/2 acres more or less, which includes
no improvements. The balance of the property will be retained by Mrs.
Ihnen. She has indicated in an letter dated November 3, 1978, that
the reason for wanting to sell a small part of her property is for
economical reasons. The applicants where severly limited on crop in-
come this year due to two hail storms and hail and water damage to
the existing house and other existing farm buildings.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be denied for the following reasons:

1. The proposed request does not comply with the Weld County Compre-
hensive Plan because it would promote non-agricultural use of
agricultural land and it would encourage urban encroachment on
rural land use.
2. This request is not in conformance with the intent clause of the
Agricultural Zone District (Section 3. 3 A of the Weld County Zoning
Resolution) which states:
"Intent - The intent in establishing the A-Agricultural
Zone District is to allow all agricultural and related
uses in those areas in which agriculture is and should
continue to be the predominant land use. This district
is intended to discourage encroachment of imcompatible
uses upon the agricultural land in the district , to
encourage agricultural uses as the highest and best use
of the land in the district as compared with other uses.
in conflict therewith, and to provide for the orderly
expansion of urban growth in conformance with the Weld
County Comprehensive Plan"
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
,. _ expansion of urban growth, and it would be promoting the division
of prime agricultural land into smaller, less economic parcel sizes.
3. This request is not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) . Said clause states:
"The intent in establishing the Recorded Exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby non-productive agri-
cultural lands may be developed for higher or more pro-
ductive uses, in-so-far as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposes. (Rev. 4/17/74)"
The parcel contains only one set of improvements and is considered
to be prime agricultural land. The split would allow an extra set
of improvements to be built on the 72 acre parcel and therefore,
create an urban encroachment which would be noncompatible with the
Agricultural District.

4. The minimum lot size in the irrigated Agricultural District is 80
acres. The intent is to maintain large enough tracts for farm
purposes and to assist in the encouragement of agricultural uses
as the highest and best use of the land. This request is in vio-
lation of that intent. It is the opinion of the Department of
Planning Services Staff that the County should not encourage
further division of this property but work towards preserving the
best use of the land, which is agriculture and agricultural
related uses.
The Department of Planning Services Staff concurs that a financial hard-
ship does exist, however, it is unproven that the granting of this re-
ques ill relieve the present financial burdens.

We are requesting this exemption because we would like to sell a small parcel at the
South end of our property bordering the Home Supply Ditch. Our reason for wanting
to sell this property is economical. We were severely limited on crop income this
year due to two hailstorms and hail and water damage to the house and hail damage

We have reviewed the application from Mrs. Elvira Ihnen, et al . ,
for a lot size variance. Our records show that the existing right
of way on State Highway 60 is 60 feet, 30 feet each side of the center-
line. To meet projected needs, a total of 120 feet will be needed,
and we ask that half of this need be protected on the south side of
the highway centerline by reservation, setback, or dedication (preferably
the latter) as local zoning laws and regulations permit.
