HomeMy WebLinkAbout20170399.tiffHEARING CERTIFICATION DOCKET NO. 2017-11 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR16-0043, FOR A KENNEL (UP TO 45 DOGS, SIX MONTHS OF AGE OR OLDER TO INCLUDE DOGGIE DAYCARE, BOARDING, TRAINING AND GROOMING) IN THE A (AGRICULTURAL) ZONE DISTRICT — WILLIAM AND RACKEL WARD A public hearing was conducted on February 22, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: • I hereby certify that pursuant to a notice dated January 20, 2017, and duly published January 25, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of William and Rackel Ward, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0043, for a Kennel (up to 45 dogs, six months of age or older to include doggie daycare, boarding, training and grooming) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Chair Cozad reviewed, for the public, the procedures to follow should this case result in a tie vote due to four Commissioners being present and one Commissioner excused. • Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the four (4) acre site located within in the floodplain of Lone Tree Creek, and is within the three (3) mile referral area of the Town of Eaton, which responded with no concerns. He described the kennels and operations, stating there will be an outside play area, the area will accommodate six (6) parking spaces, and there will be no outside storage. He stated thirteen (13) referrals were sent out to agencies with five (5) responding. He displayed images and entered the favorable recommendation of the Planning Commission into the record as written. _ = Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements, and stated an Access Permit, AP16-00594, utilizing two access points on CR 43 has been approved. He indicated the site will generate five (5) daily round trips and neither tracking control, nor an Improvements Agreement be required. CC N..ClAO/mm),Pl✓CHES), HLCBF'), CI -6C C TS/ Sr.) 2017-0399 O8/O 3/17 PL2458 HEARING CERTIFICATION - WILLIAM AND RACKEL WARD (USR16-0043) PAGE 2 Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements and stated the entire USR is encumbered by the Lone Tree Creek floodplain, and if there are any substantial improvements made, they will need to obtain a Flood Hazard permit. She reviewed the relevant Conditions of Approval (COA) and Development Standards (DS) related to engineering. • Ben Frissell, Department of Public Health and Environment, stated he was present on behalf of Lauren Light, he reviewed the water and sewer provisions and indicated water is supplied by the North Weld County Water District. He explained the existing septic system was permitted for four (4) bedrooms and is acceptable for the use, and a portable toilet can be used for two (2) or less employees and customers or visitors that are on site less than two (2) hours a day. He stated the applicant indicated the dogs will be kept inside at night and DS#15-24 are items typical of Environmental Health. • Rackel Ward, applicant, stated she is proposing a business called Little Dogs Colorado, which is a unique small dog environment, where people can bring their small dogs for training, boarding and grooming in a safe and comfortable environment. She stated it is her vision to help dogs become good members of the community so fewer dogs end up in shelters. No public testimony was offered concerning this matter. Commissioner Cozad requested clarification to COA #1.A.6 and #7 and suggested including the language if applicable; and under DS #3 she noted the applicant is limited to three (3) additional employees. In response to Commissioner Conway, Mr. Frissell stated if the applicants were to change to a commercial business they may need to reclassify their residential septic permit to commercial; however, their current septic system is sized for an additional number of people. In response to Commissioner Freeman, Mr. Frissell stated they would be able to have six (6) additional employees and not impact the current septic system. Mr. Choate suggested having Development Standard (DS) #3 state that the amount of people on -site shall be eight residents and employees. Commissioner Freeman suggested deleting DS# 4 and removing the words "for the boarding kennel" from DS #5. The Board agreed. In response to Chair Cozad, Ms. Ward indicated she has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Freeman moved to approve the request of William and Rackel Ward, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0043, for a Kennel (up to 45 dogs, six months of age or older to include doggie daycare, boarding, training and grooming) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Conway and he commented that Ms. Ward has a beautiful place and he expressed his appreciation for the application.
