Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: Equine and Event Center This project is approximately 4500 feet north of CR22 and is approximately 11,000 feet west of CR49. Parcel number: 130710100012 Access: The applicant shall submit a recorded copy of any agreement signed by all of the owners of the property crossed by the access. The access shall be for ingress, egress, and utilities and shall be referenced on the plat by the Weld County Clerk and Recorders Reception number. (Department of Planning Services - Engineer) Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within a Non -Urbanizing Drainage Area: or Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -URBANIZING areas. Detention Pond summarized in a Drainage Report: A drainage report and detention pond design shall be completed by a Colorado Licensed Professional Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must include a certification of compliance stamped and signed by the PE which can be found on the engineering website. General drainage report checklist is available on the engineering website. More complete checklists are available upon request. The applicant has submitted a preliminary drainage report. A review checklist on this report is available upon request. MS4: This site is not in a defined Municipal Separate Storm Sewer System (M54) area which is a more urbanized area with state mandated, higher water quality requirements Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Planning Services -Engineer) B. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL USE PERMIT FOR ANY USE PERMITTED AS A USE BY RIGHT, AN ACCESSORY USE, OR A USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS, (EVENT CENTER FOR UP TO 200 PEOPLE, ALONG WITH AN OPERATING OFFICE AND SHOP FOR TACK SALES) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR LOTS PARTS OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT. This project is north of CR 22 and is east of CR 41. Parcel number 130710100012. Access is from CR 22. Access: An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division. An Access Permit is required. For new accesses and/or change of use of an existing access, the fee and photos are required (Access permit instructions and application can be found at http:Ilwww.co.weld.co.uslDepartments/PublicWorksIPermits html.) Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance. (This document can be found at http://www.co.weld.co.us/Departments/PublicWorks/EnqineerinclandRightofWay/EnqineerinqCriteraandP olicies.html) Existing access points with change of use or new access points may or may not be granted. Questions pertaining to access permits or access design shall be directed to the Public Works Department. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. When feasible, there shall be no net increase in the number of accesses to a public road. Roads: County Road 22 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. Traffic: Latest ADT on CR 22 was taken on 10/9/2013 which counted 2004 vpd with 69% trucks. A traffic narrative was submitted with the application materials and indicated that there will be approximately 80 daily roundtrips. The expected traffic routes are eastbound and westbound CR 22 and distribution of traffic is estimated to be 60% eastbound and 40% westbound. The site will have 1 full time employee working during daylight hours. Roadways Improvements may be triggered due to traffic associated with the facility. These triggers will be included within the improvements and road maintenance agreement: A. 10 vph during peak hour turning left into the facility -left deceleration lane B. 25 vph during peak hour turning right into the facility -right deceleration lane C. 50 vph during peak hour turning right out of the facility -right acceleration lane. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. More than 10 round truck trips/day (tandem or semi -trucks) or more than 50 round passenger vehicles trips: • Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled asphalt or road base. • Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft of asphalt. *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. A development standard will be included on the recorded site plan. "The access shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking." Improvements and Road Maintenance Agreement: An Improvements Agreement between the Applicant and the County will be required for this project. Items may include the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Improvements/Road Maintenance Agreement: An example agreement is available at: http://www.co.weld.co. us/Departments/PlanningZoning/LandUseApplicationsAssistance/ApplicationAssist ance. html An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. CONDITIONS OF APPROVAL: A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this location. Road maintenance including dust control, damage repair, specified haul routes and future traffic triggers for improvements will be included. (Department of Public Works) B. The plan shall be amended to delineate the following: 1. (Department of Public Works) WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth.org MEMORANDUM TO: Chris Gathman, Planning Services FROM: Lauren Light, Environmental Health Services SUBJECT: USR16-0029 DATE: 12/8/2016 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (event center for up to 200 people, along with an operating office and shop for tack sales) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. An individual well (permit 67932-F) which is permitted for "commercial and domestic use" is located on the adjacent property owned by the applicant. The application indicates the adjacent well will be used for this USR. A shared well agreement is required if the Division of Water Resources approves the sharing of the well. The application states that new on site wastewater treatment systems will be utilized and the usage will not exceed 2,000 GPD. State review will be required if the 2,000 GPD is reached. All food vendors and food preparations must adhere to the Colorado Retail Food Establishment Rules and Regulations. Upon approval by the Division of Water Resources allowing sharing of the well, the applicant shall submit a document providing for shared well operation and maintenance by both parcels of land. The declaration shall be recorded and the recordation number indicated on the plat. A joint easement agreement shall be indicated on the plat. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. 5. Fugitive dust shall attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 6. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Onsite Wastewater Treatment Systems. 8. In the event the septic systems require a design capacity of 2,000 gallons or more of sewage per day the applicants shall adhere to the requirements of the Colorado Department of Public Health and Environment, Water Quality Control Division's (WQCD) Regulations. 9. For employees that are on site for less than 2 consecutive hours a day or 10 or less customers or visitors per day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). If not subject to these requirements, the Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically thereafter. 11. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 12. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application is for a site specific development plan and use by special use permit for an equestrian event center for up to 200 people, a riding arena, f/a mile practice track, barns and pasture for 40 horses an operating office, a shop for tack sales, gardens, and a caregiver apartment on a 15 acre parcel identified as Lot A of RE -4329. The proposed water supply is an existing well on the adjacent 29.36 acre parcel immediately west of the subject property, which currently operates under well permit no. 67932-F. No estimates of water use for the proposed project were provided. Well permit no. 67932-F was issued on March 16, 2009 pursuant to Section 37-90-137(4) and the findings of the State Engineer dated March 16, 2009 to withdrawal water from the nontributary Laramie -Fox Hills aquifer underlying a 29.4 acre parcel using an existing well. The uses of this well are limited to commercial and domestic purposes, not to exceed 3 acre- feet per year. No information was provided regarding how this well is currently used on the 29.4 acre site where it is located. The application materials mention that there are as much as 6.8 acre-feet of water available for withdrawal underlying the 29.4 acre parcel subject to permit no. 67932-F. Though this water may be located under the parcel, only the amount allowed to be withdrawn pursuant to permit no. 67932-F, 3 acre-feet per year, may be utilized until such a time as the applicant obtains a permit to withdrawal a larger amount of water from the Laramie -Fox Hills aquifer underlying the property. 1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water.state.co.us Case No. USR16-0029 Page 2 of 2 August 23, 2016 Though the currently permitted uses of the well appear to fit the proposed uses described in the application, it is unclear if the existing well permit, or a well permit with an increased withdrawal capability, could provide enough water to satisfy the proposed project. The Division of Water Resource does not administer or enforce shared well agreements. However, should the applicant share the well between the two properties, we encourage them to obtain a well sharing agreement so that each party knows their rights and responsibilities associated with the well. The application materials indicate that a storm water detention structure may be constructed as a part of this project. The applicant should be aware that, unless the structure can meet the requirements of a "storm water detention and infiltration facility" as defined in section 37-92-602(8), Colorado Revised Statutes, the structure may be subject to administration by this office. The applicant should review DWR's Administrative Statement Regarding the Management of Storm Water Detention Facilities and Post-Wildland Fire Facilities in Colorado, attached, to ensure that the notification, construction and operation of the proposed structure meets statutory and administrative requirements. The applicant is encouraged to use Colorado Stormwater Detention and Infiltration Facility Notification Portal, located at https://maperture.digitaldataservices.com/gvh/?viewer=cswdif, to meet the notification requirements. The well must operate in accordance with all terms and conditions of well permit no. 67932- F. From the information provided it is unclear if the well operated under permit no. 67932-F can supply an adequate amount under the terms and conditions of the well permit to meet the water requirements of the proposed project and any existing water commitments.
