ALLOWED BY RIGHT IN THE I-1 (INDUSTRIAL) ZONE DISTRICT (SPECIFICALLY,
ANY USE OF A RESEARCH, REPAIRING, MANUFACTURING, FABRICATING,
PROCESSING, ASSEMBLING OR STORAGE NATURE PROVIDED THAT THE USE IS
ENCLOSED AND SCREENED PER SECTION 23-3-310.B.1) IN THE C-3 (BUSINESS
COMMERICAL) ZONE DISTRICT — TROY AND JUDY HEFNER
A public hearing was conducted on April 5, 2017, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 1, 2017, and duly published March 6,
2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Troy and
Judy Hefner, for a Site Specific Development Plan and Use by Special Review Permit,
USR16-0026, for Commercial Junkyard or Salvage Yard and Uses Allowed by Right in the I-1
(Industrial) Zone District (specially, any use of a research, repairing, manufacturing, fabricating,
processing, assembling or storage nature, provided that the use is enclosed and screened per
Section 23-3-310.B.1) in the C-3 (Business Commercial) Zone District. Bob Choate, Assistant
County Attorney, made this a matter of record. (Clerk's Note: Commissioner Moreno was present
at 10:02 am)
El Michael Hall, Department of Planning Services, presented a brief summary of the proposal
and explained the specific details about the uses on the site. He gave the hours of operations for
the existing businesses on the parcel. He reported the violations, ZVC16-0025 and ZVC16-0024
on Lots 8 and 9, are due to the expansion of the existing storage area onto Lot 9, without
completing the necessary permits. Anadarko responded to the mineral owner notification and has
no concerns. There were seventeen (17) referrals sent out and eleven (11) responses were
received which have been addressed by the Conditions of Approval. Mr. Hall stated the site is
located within a three (3) mile referral area of the City of Northglenn, the Town of Erie, the City of

Dacono and the City and County of Broomfield. He displayed photographs of the site and entered
the favorable recommendation of the Planning Commission into the record as written.
Janet Lundquist, Department of Public Works, provided a brief overview of the transportation
plans and requirements. Ms. Lundquist stated that CR 6 is owned and maintained by the City of
Broomfield, and staff has requested the applicant work with the City of Broomfield to get the
improved access permits at the location, if required.
• Hayley Balzano, Planning Services Engineer representative, presented the drainage and
grading requirements. She stated this is located in a Geologic Hazard Overlay District and staff
received a report that there are potentially open mine sites on Lots 7 and 8, therefore, the
applicant submitted a complete Geological Hazard Development Permit. She explained the USR
map will show the Geologic Hazard Area, drainage features, flow areas and traffic and parking.
Ms. Balzano referred to Development Standards #26, 27, and 28, concerning maintenance of
historical flow patterns and run-off amounts.
Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions. He reported water is provided by the Central Weld County Water District (CWCWD)
and an existing commercial septic system serves the property for the proposed three (3)
employees. He stated if there is a residence on the property the applicants will be required to
install a separate residential septic system and this will need to be done prior to issuance of the
Certificate of Occupancy.
El In response to Commissioner Kirkmeyer, Mr. Hall stated the caretaker building or security
living quarters will be located on Lot 7, by the main entrance. He clarified since this will be
Accessory Use by Right, the requirements will be grouped into Development Standards.
• Judy Hefner, applicant, explained the project and how the lots and businesses are divided
on the site. Ms. Hefner detailed the Landscaping Plan, which will include decorative rock and
metal fencing and explained they will add a decorative area outside along the road by the sign.
The fence will act as screening for the parking area from the road. She stated they want
landscaping along CR 6 to make it look nice and will maintain the weeds regularly. She made
known that they will be removing "Affordable" from their name due to a conflict with another
neighboring business.
No public testimony was offered concerning this matter.
• In response to Chair Cozad, Ms. Hefner indicated they had reviewed, and agree to abide
by, the Conditions of Approval and Development Standards, as amended and entered in to the
record.
Ei Commissioner Kirkmeyer stated she is agreement with the low maintenance landscaping,
as described along the entrances, and wants the applicants to make sure that they meet the 15
percent requirement. Commissioner Kirkmeyer clarified that in the Conditions of Approval stated
the requirements for a sign and the Caretaker/security quarters will be located on Lot 7.
Ms. Hefner stated this plan isn't in the immediate future as the part of the plans. Mr. Hall explained

that Development Standards #11 and #22 indicate any future development on Lot 7 will require
an additional water tap.
• In response to Chair Cozad, Ms. Hefner explained they met with a representative of the
Mountain View Fire Protection District to discuss the requirement and she talked with CWCWD
confirming enough pressure to install a fire hydrant. Chair Cozad stated she would like to view an
aerial map of the cul-de-sac
• In response to Chair Cozad, Mr. Hall addressed her concerns about the cul-de-sac on Lot 8
and the material and parking requirements.
• Ms. Lundquist stated the entry way and length of 1,000 feet is adequate so the cul-de-sac is
not necessary for this site.
Commissioner Kirkmeyer moved to approve the request of Troy and Judy Hefner for a Site
Specific Development Plan and Use by Special Review Permit, USR16-0026, for a Commercial
Junkyard or Salvage Yard and Uses Allowed by Right in the I-1 (Industrial) Zone District (specially,
any use of a research, repairing, manufacturing, fabricating, processing, assembling or storage
nature, provided that the use is enclosed and screened per Section 23-3-310.B.1) in the C-3
(Business Commercial) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as entered
into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:33 a.m.
This Certification was approved on the 10th day of April, 2017.
