While originally a Use by Right, the facility has now expanded beyond the Use by Right allowance and includes the outside storage of equipment and two modular units to be used for sleeping quarters for staff stationed in remote areas. Planning Questions 1. Explain in detail, the proposed use of the property. Noble Energy proposes to utilize the southern portion of the 80 -acre parcel for their hydraulic fracturing fresh water source, outdoor equipment storage and a facility to allow Noble employees to stay on site while working in remote areas of Weld County. The property is located in the Agricultural Zone District on a parcel of land owned by Timbro Ranch and Cattle Company located in Section 11, Township 9 North, Range 59 West. The property is located approximately 1/2 mile west of Weld County Road 119 and approximately 760' north of the right of way for Weld County Road 106. Site Security and Lighting Lighting wi II be for nighttime operations and security purposes. Light shal I not spi II onto adjacent properties and wi II be directed toward the operations. Mobile light towers on a portable trailer will be utilized when needed. Site Access The access to the facility exists through AP16-00469. The access is from the right of way from Weld County Road 106. The nearest maintained County Road is Weld County Road 119, approximately Y2 mile to the east. Tracking control exists south of the right of way for Weld County Road 106 on Weld County Road 119. It is anticipated that a maximum of 10 passenger vehicles will access the site each day. There may be up to two large trucks, including water trucks accessing the facility each day. Some drivers are third -party employees and contract directly with Noble. Ninety percent of traffic will exit to the south and then continue to the east to WCR 119. The other ten percent will exit to the south and then to the west. According to the Traffic Narrative included i n application materials, "traffic levels using the various street segments expected to serve site traffic will remain modest. Consequently, site traffic associated with the Timbro Oil and Gas facility is not expected to produce any noticeable impacts on the roadways serving this area." The facility will operate 24-7, 365 days per year. The facility will not be open to the general public. There are two 12 -hour shifts with two employees per shift. There may be up to 8 individuals utilizing the sleeping quarters. Once the sleeping quarters are deemed necessary, Noble will construct a well and septic system. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan The Weld County Comprehensive Plan has established Goals and Policies supportive of the continuance of oil and gas exploration, transportation development and agricultural development. Below is a list of specific goals that this particular application supports, followed by an explanation of how the goals are being addressed. IlTecra Tech Oil and Gas Goals and Policies • OG.Goal 2: Ensure that the extraction of of I and gas resources conserves the land and minimizes the impact on surrounding land and the existing surrounding land use. By providing a source for fresh water in the vicinity of need, Noble Energy, Inc. is reducing the number of road miles traveled by trucks hauling fresh water as the water is piped to sites. Agriculture goals and policies. A.Goal 2. Continue the commitment to viable agriculture in Weld County through mitigated protection of established (and potentially expanding) agricultural uses from other proposed new uses that would hinder the operations of the agricultural enterprises. A. Policy 2.2 "Allow commercial and industrial uses, which are directly related to or dependent upon agriculture, to locate within agricultural areas when the impact to surrounding properties is minimal or mitigated and where adequate services and infrastructure are currently available or reasonably obtainable. These commercial and industrial uses should be encouraged to locate in areas that minimize the removal of agricultural land production." The proposed facility is a use that is highly compatible with agriculture and represents a significant commitment to sustaining viable agricultural operations in Weld County. The application has also considered the reverse of this Goal by careful I y considering the i mpact of the project on adjacent properties. The faci I ity aids to the reduction of equipment needed at well pad sites. By reducing the amount of equipment needed for exploration, Noble Energy, Inc. is able to reduce their overall impact and disturbance of agricultural land. A.Goal 7. County land use regulations should protect the individual property owner's right to request a land use change. A.Pol icy 7.1. "County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable." Noble Energy, Inc. works closely with property owners in the vicinity and has a strong relationship with the property owner of the land proposed for this use. A letter to Surrounding Property Owners was mailed first class, certified and return receipt on Friday, April 28, 2017. Evidence is provided with application materials. Weld County's Right to Farm statement is supported by the application and will be placed on the Use by Special Review Plat prior to recording. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The application materials have been prepared according to the Weld County pre -application meeting held on April 6, 2017 with the exception of the addition of a third tent. Application materials have been prepared in conformance with Division 4 starting with section 23-2-200 of the Weld County Code. The property is zoned "A" Agricultural and according to the Weld County Code, of I and gas support and service facilities are a Use allowed by Special Review in the Agricultural Zone District. Wastewater facilities are considered an oil and gas support facility supporting the submittal of this application review. 2lTecr a Tech 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). The project will be compatible with the surrounding land uses. The applicant has considered the impact of the project on adjacent properties. The surrounding properties are zoned Agricultural and utilized as range land. The nearest neighbor is located 1.8 miles away to the south west. An Open House was held on May 8, 2017. No neighbors were present. Documentation of mailing and the attendance record are included i n application materials. 5. What are the hours and days of operation? The facility will operate 24-7, 365 days per year. The facility is not open to the general public. 6. List the number of full time and/or part time employees proposed to work at this site. Staffing at the facility is projected to be minimal once fully constructed. There will be up to two full-time employees at the facility per shift at all times. The number of staff is dependent upon the need. 7. If shift work is proposed include the number of employees per shift. There will be two shifts throughout the day divided between a day shift and a night shift. 8. List the number of people who wi II use this site. I ncl ude contractors, truck drivers, customers, volunteers, etc. It is anticipated that up to 10 passenger vehicles will access the site on a daily basis. On an infrequent basis, up to two I arge trucks such as water trucks will access the facility each day. 9. If this is a dairy, livestock confinement operation, kennel, etc.,list the number and type of animals. This question is not applicable. Animals are not intended to be kept on site. 10. Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) The entire surface with the exception of the 2.05 acre secondary containment area will be native or graveled. 11. How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? The facility is not open to the public and therefore, an ADA parking space is not proposed. 12. Explain the existing and proposed landscaping for the site. Landscaping is not proposed for this facility. The isolated location and complete location within a secondary containment structure is not conducive to landscaping. 13. Describe the type of fence proposed for the site. No fencing or gate is proposed for this site. Due to the remote location and the site being manned 24/7 security is not a concern. 3►lTecra Tech 14. Described the proposed screening for all parking and outdoor storage areas. If the site is located in a floodplain outdoor storage is restricted. The facility is not located in a FEM.A designated floodplain. 15. Explain any proposed reclamation procedures when termi nation of the Use by Speci al Review activity occurs. When termination of the facility occurs, the facilities will be removed and the land will be returned to its native state. Following removal of the secondary containment, soils will be tested for constituents listed in the COGCC Table 910 and any appropriate remediation on will be performed. 16. Who will provide fire protection to the site? The property is within the Pawnee Fire Protection District boundary. Describe the expected travel routes for site traffic 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) On -site traffic is expected to be minimal. An Access Permit has been issued, AP1 i6-00459. It is anticipated that a maximum of 10 passenger vehicles will access the site each day. Ninety percent of traffic will exit to the south and then continue to the east to \NCR 119. The other ten percent wi II exit to the south and then to the west. 4. Describe the time of day that you expect the highest traffic volumes from above. Heaviest traffic is expected during daylight hours. 5. Describe when the access to the site is planned. Site access will be designed as soon as this USR is approved. 6. Drainage Design: Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23-12-30 F.1. a. Does your site qualify for an exception to stormwater detention? I f so, describe i n a drainage narrative the fol I owi ng: 1. Which exception is being applied for and include supporting documentation. 2. Where the water originates if it flows onto the property from an offsite source 3. If there have been previous drainage problems with the property This site qualifies for an exemption per Section 23-12-30.F.1.a.14 of the Weld County Code. There is less than 2,000 square feet of building being installed. Detailed discussion is i ncl uded in the drainage narrative. SITetra Tech b. Does your site require a storm water detention pond? A drainage report summarizing the detention pond design with construction drawings and maintenance plan shal I be completed by a Colorado Licensed Professional Engineer and adhere to the drainage related sections of the Weld County Code. 2. The drainage report must include a certification of compliance stamped and signed by the PE which can be found on the engineering website. 3. A general drainage report guidance checklist is available on the engineering website. More complete checklists are available upon request. This site does not require a storm water detention pond. A drainage narrative has been prepared documenting the rationale for detention exemption. Environmental Health Questions 1. What is the dri nki ng water source on the property? If uti I izi ng a public water tap include a letter from the Water District, a tap or meter number, or a copy of the water bi l l . Bottled water will be provided. There may be up to 8 individuals utilizing the sleeping quarters. Once the sleeping quarters are deemed necessary, Noble will construct a well and septic system. 2. What type of sewage disposal system is on the property? If utilizing an existing septic system provide the septic permit number. If there is not septic permit due to the age of the existing septic system, apply for a septic permit through the Department of Public Health and Environment prior to submitting this application. If a new septic system will be instal led please state "a new septic system is proposed" . Only propose portable toilets if the use is consistent with the Department of Public Health and Environment's portable toilet policy. Port -a -lets with hand rani tizer will be provided. There may be up to 8 individuals utilizing the sleeping quarters. Once the sleeping quarters are deemed necessary, Noble will construct a well and septic system. 3. If storage or warehousing is proposed, what type of items will be stored? A maximum of 4 Conex container(s) will be used to store spare parts and consumables for the treatment equipment as well as miscellaneous office supplies and safety equipment. The Conex containers will be located within the vicinity of the pumping equipment. 4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on this site Storage of these materials will not occur on site. General trash and used filter bags (non e&p waste) will be gathered and disposed of. 5. If there will be fuel storage on site, indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. Three fuel tanks will be on site. 6ITecra Tech 6. If there will be washing of vehicles or equipment on site indicate how the wash water will be contained. Vehicle and equipment washing will not occur on site. 7. If there wi I I be floor drains indicate how the fluids wi I I be contained. There will be no floor drains. 8. Indicate if there will be any air emissions. (e.g. painting, oil storage, etc.) This faci I i ty falls under the same AQCC exemption as oil and gas dri Ili ng and completion activities and as a result wi II not require an APEN permit. The relevant rule reference for the AQCC exemption is Regulation 3, Part A, Section II.l .1.II. 9. Provide a design and operations plan if applicable. (e.g. composting, landfills, etc.) A Design and Operations Plan is not applicable per pre -application meeting notes. 10. Provide a nuisance management plan if applicable. List the type, size (square footage), and number of existing and proposed structures. Show and label all existing and proposed structures on the USR drawing. Label the use of the building and the square footage. 2. Explain how the existing structures will be used for this USR? 3. List the proposed use(s) of each structure. The following is a list of existing and potential new structures. The final dimensions and location of the equipment and structures will be determined upon application for a building permit, however, the general placement is included in the USR application materials. The applicant is aware of the Weld County Building Permit and Plans Examination process. The modular sleeping units are described in this application to avoid the need for a Zoning Permit for the units. The site will operate 24 hours per day, 365 days per year. Two 12 -hour shifts per day are anticipated. Site access will be provided by use of the CR 106 right-of-way west of CR 119. Up to 10 passenger vehicles and two large trucks are expected to visit the site each day. About 90 percent of these vehicles will arrive and depart the site using CR 119 to the east. The remaining 10 percent will travel west. Daily traffic will be in the range of 12 round trips per day. Site traffic expected on the primary travel route is shown below. The Facility is proposed to store fresh water for hydraulic fracturing of new oil/gas wells, outdoor equipment storage, and a facility to allow Noble employees to stay on site while working in remote locations in Weld County. The site is approximately 80 acres in size. Surrounding land uses are agricultural (ranching) and oil/gas development. As of the writing of this narrative, a USR number has not yet been assigned. Runoff on this site originates from the northwest and flows south to the property boundary. No drainage problems with the subject parcel has been reported to Noble Energy. The site is not located near a mapped FERIA floodplain. The site is proposed to have two job trailers/sleeping units (2 x 840 square feet = 15680 square feet). Based on the criteria set forth in Section 23-12-30.F.1.a.14 of the Weld County Code, this project does not require a detention pond because there is less than 2,000 square feet of new building. Trailers are set on wheels above ground and do not create impervious area. In addition to the trailers, there are winterizing tents for some equipment that is susceptible to freezing. These tents are temporarily used only in the winter time when thunderstorms (or other flood generating rainfalls are not expected to occur. The tents were not included in the estimation of new impervious area because they are not used when flooding rains are expected to occur.
