The Colorado Department of Public Health and Environment, Hazardous Materials and Waste
Management Division (the "Division") has conducted a review of Financial Assurance compliance for
Heartland Biogas, LLC. The Financial Assurance Submittal was reviewed for compliance with Section
1.8 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 (the "Regulations").
The submittal included a rider for Surety Bond # K08981048, dated January 13, 2017, received by the
Division January 17, 2017. As a result from the Division's review and analysis, the Division hereby
approves Heartland Biogas, LLC's financial submittal as the financial mechanism for closure and post -
closure care costs of the Heartland Biogas facility.
Please note that Heartland Biogas, LLC must adjust annually for inflation. The inflationary update
information can be found online at https://www.colorado.Qov/pacific/cdphe/solid-waste-financial-
assurance. The next update will be due in January 2018. Heartland Biogas LLC's revised cost estimate
will be due in February of 2020.
The Division is authorized to bill for its financial assurance review pursuant to Section 1.7 of the
Regulations, and an invoice will be transmitted under separate cover.
