RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 88 - MERKLEIN TRUST,
ET AL.
�t WHEREAS, the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home
Cn
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has reviewed the request of Merklein Trust, et al. , for
and exemption from the definitions of "subdivision" and "subdivided
en
land" in Section 30-28-101 (10) , CRS 1973, as amended, and Section
C.;1
2-1 of the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that Merk-
lein Trust, et al. , are the owners of certain parcels of land
located in part of the Southwest Quarter of Section 4, Township
5 North, Range 67 West of the 6th P.M. , Weld County, Colorado.
The applicants desire to add 8.959 acres to and existing 6. 152
acre parcel. This request will move the property line into a
better alignment with the natural division of the property and
will not encroach on the farmable land. No additional parcels
will be created. The legal description of the resulting tract
of land is as follows:
A tract of land located in the South Half of
the Southwest Quarter of Section 4, Township
5 North, Range 67 West of the 6th Principal
Meridian, Weld County, Colorado and being more
particularly described as follows:
Beginning at the Southwest corner of said Section
4, and considering the South line of the Southwest
Quarter of said Section 4 to bear South 89°07' 32"
East, with all other bearings contained herein
relative thereto;
Thence South 89°07 ' 32" East along the South line
of said Southwest Quarter, 1580. 73 feet;
Thence North 42°34 ' 24" West, 1173. 00 feet to a
point on the Southerly existing Right-of-Way of
the Great Western Railroad Company;
Thence along said Southerly Right-of-Way line
by the following two courses:
South 38°57 ' 38" West, 406. 00 feet;
along the arc of a curve to the right having
a radius of 1984. 86 feet and a chord that bears
South 49°03 ' 14" West, 695. 70 feet to a point
on the West line of the Southwest Quarter of
said Section 4;
Thence South 05°12 ' 23" West along said West line,
68 . 35 feet to the Point of Beginning.
Said tract of land contains 15. 111 acres.

The abovedescribed parcel shall be considered a single lot.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the abovedescribed par-
cel of land be, and hereby is, declared to be exempt from the
definitions of "subdivision" and "subdivided land" as set forth
in Section 30-28-191 (10) , CRS 1973, as amended, and Section 2-1
of the Weld County Zoning Regulations, and
BE IT FURTHER RESOLVED by the Board that the resulting par-
cel of land as described above be, and hereby is, considered to
be a single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
June, A.D. , 1979.

The owners of the following described property have requested an
exemption from Section 2-1 of the Weld County Subdivision Regu-
lations adopted August 30, 1972, which defines the term subdivi-
sion:
Pt . SW* Section 4, T5N, R67W
The Planning Department has reviewed this request and recommends
that the request be approved for the following reasons:

COMMENTS:

parcel. Several natural gullies exist in the southwest corner of
the property which divides the cultivated land from the non-farmable
land. The request will move the property line into a better alignment
with the natural division of the property (i.e. gullies) and will not
encroach on the farmable land. No additional parcels will be created.

closure error. The property was reconstructed and a new legal
prepared by McRae & Short, Inc. and agreed to by all interested
parties. Prior to re-recording the "corrected" deed, the part-
ies involved agreed to exchange an additional 8.959 Acres. This
Subdivision Exemption is to combine these two parcels into one
tract containing 15.111 Acres. To simplify the recording pro-
cedure, the First Tract (as transferred) will be deeded back to
the Estate and then the Estate will deed the total 15.111 Acres
to the Glassgow's. This procedure will eliminate the need to
correct the erroneous description.

Co-Personal Representative of the Estate of Ada M . Merklein , Deceased , Grantor ,
to Nevin E . Glassgow and Annette L . Classgow , Grantee , whose address is 1210

WHEREAS , the above named decedent in her lifetime made and executed her
Last Will and Testament dated March 9 , 1972 , which Will was duly admitted to
informal probate on October 2 , 1978 , by the District Court in and for the
County of Weld and State of Colorado , Probate No . P-14417 ; and
WHEREAS , Grantor was duly appointed Personal Representative of said
Estate on October 2 , 1978 and is now qualified and acting in said capacity ;
