SUBDIVISON (S-365) TO REFLECT THE ABANDONMENT OF AN EXISTING OIL AND
GAS WELL AND TANK BATTERY - CANDELARIO AND THERESA SANCHEZ, AND
EARL AND NICOLETT DARLING, CIO EDWARD O'CONNOR
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 21st day of
August, 2017, at the hour of 9:00 a.m., in the Chambers of the Board for the purpose of hearing
the application of Candelario and Theresa Sanchez, and Earl and Nicolett Darling, c/o
Edward O'Connor, 26100 Rangeview Drive, Kersey, Colorado 80644, for a Resubdivision,
RES17-0001, for a lot line adjustment to reduce the no -build area on Lots 1, 2, and 12 of
Rangeview Ranches Subdivision (S-365) to reflect the abandonment of an existing oil
and gas well and tank battery on the following described real estate, to -wit:
Lots 1, 2, and 12 of Rangeview Ranches
Subdivision; located in part of the SW1/4 of
Section 21, Township 5 North, Range 64 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the applicant was represented by Edward O'Connor, 26100 Rangeview
Drive, Kersey, Colorado 80644 and
WHEREAS, Section 24-5-10 of the Weld County Code provides standards for review of
said Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Weld County Department of Planning Services and all of the exhibits and evidence presented in
this matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-40.B of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24-5-30.C of the Weld County Code, including
specifically:
A. Section 24-5-30.C -- The lot line revision complies with the approved
recorded final plat for Rangeview Ranches Subdivision, S-365.
B. Section 24-4-30 — The lot line revision complies with the adopted rules,
regulations and ordinances currently in force and affecting the subdivision.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Candelario and Theresa Sanchez, and Earl
and Nicolett Darling, c/o Edward O'Connor, for Resubdivision, RES17-0001, for a lot line
adjustment to reduce the no -build area on Lots 1, 2, and 12 of Rangeview Ranches
Subdivision (S-365) to reflect the abandonment of an existing oil and gas well and tank
battery on the hereinabove described parcel of land be, and hereby is, granted subject to the
following conditions:
1. Prior to recording the Resubdivision plat:
A. The plat shall be amended to include the following:
1) All plat sheets shall be labeled RES17-0001.
2) Show the approved Municipality of Kersey access on the site plan and
label with the approved access permit number, if applicable.
3) The twenty-five (25) foot setback from the abandoned wellhead shall be
indicated.
4) All recorded easements and rights -of -way shall be delineated on the plat
by book and page number or reception number.
B. The following notes shall be placed on the plat prior to recording:
1) This Resubdivision is a for a lot line adjustment to reduce the no -build
area on Lots 1, 2 and 12 of Rangeview Ranches Subdivision (S-365) to
reflect the abandonment of an existing oil and gas well and tank battery.
2) Allowed uses in Rangeview Ranches consist of E (Estate) Zone District
uses listed in the Weld County Code.
3) All streets within the subdivision are private and shall be built to County
standards and shall be maintained by the Homeowners' Association, lot
owners and/or developer.
4) Any excavation or placement of dredged or fill material, either temporary
or permanent, into the any wetlands within the subdivision, shall require
404 of the Clean Water Act.
5) The 50 -foot Emergency Access, Drainage and Utility Easement shall be
dedicated for public use to be open for such use at such time as
development occurs on property adjacent to and north of Lots 4 and 5, or
at such time as 5th Street is developed for public use.
6) The property owner shall control noxious weeds on the site.

7) The historical flow patterns and runoff amounts on the site will be
maintained.
8) Weld County is not responsible for the maintenance of on -site drainage
related features.
9) Water service may be obtained from the Central Weld County Water
District.
10) Activity or use on the surface of the ground over any part of the OWTS
must be restricted to that which shall allow the system to function as
designed and which shall not contribute to compaction of the soil or to
structural loading detrimental to the structural integrity or capability of the
component to function as designed.
11) The location of the three (3) inch Natural Gas Pipeline as annotated on
the plat is approximate. Prior to any construction, Pioneer Natural
Resources USA, Inc. (formerly Parker and Parsley) shall be notified to
provide a field locate of said pipeline. Setback distances from said
pipeline shall be furnished by the Weld County Department of Building
Inspection and Parker and Parsley Petroleum Co.
12) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld
County has some of the most abundant mineral resources, including, but
not limited to, sand and gravel, oil, natural gas, and coal. Under title 34 of
the Colorado Revised Statutes, minerals are vital resources because (a)
the State's commercial mineral deposits are essential to the state's
economy; (b) the populous counties of the state face a critical shortage of
such deposits; and (c) such deposits should be extracted according to a
rational plan, calculated to avoid waste of such deposits and cause the
least practicable disruption of the ecology and quality of life of the citizens
of the populous counties of the state. Mineral resource locations are
widespread throughout the County and person moving into these areas
must recognize the various impacts associated with this development.
Often times, mineral resource sites are fixed to their geographical and
geophysical locations. Moreover, these resources are protected property
rights and mineral owners should be afforded the opportunity to extract
the mineral resource.
13) The Weld County Right to Farm Statement, as it appears in Section 22-2-
20.J.2 of the Weld County Code, shall be placed on the map and
recognized at all times.
C. The applicant shall submit one (1) paper copy or electronic copy (.pdf) of the plat
for preliminary approval to the Weld County Department of Planning Services

D. The applicant shall create a digital file of all drawings associated with the
Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo
Coverages and Arclnfo Export files format type is .e00. The preferred format for
Images is .tif (Group 4) ... (Group 6 is not acceptable). A copy shall be submitted
to the Weld County Department of Planning Services at the time of Mylar plat
submittal.
2. Upon completion of Condition of Approval #1, the applicant shall submit a Mylar
plat along with all other documentation required as Conditions of Approval. The
Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder
by the Department of Planning Services. The plat shall be prepared in
accordance with the requirements of Section 24-5-40.B.1. of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within sixty
(60) days from the date of the Board of County Commissioners Resolution. The
applicant shall be responsible for paying the recording fee. If the Resubdivision
plat has not been recorded within sixty (60) days from the date of the Board of
County Commissioners Resolution, or within a date specified by the Board of
County Commissioners, the Board may require the landowner to appear before it
and present evidence substantiating that the Resubdivision has not been
abandoned and that the applicant possesses the willingness and ability to record
the Resubdivision plat. The Board of County Commissioners may extend the
date for recording the plat. If the Board determines that conditions supporting the
original approval of the Resubdivision plat cannot be met, the Board may, after a
public hearing, revoke the Resubdivision.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of August, A.D., 2017.

Summary: Rangeview Ranches Subdivision was approved by the Board of County Commissioners
in November 1994. The Rangeview Ranches (S-365) plat (recorded in 1995) delineates
a 200 -foot weld limit line (200' non -buildable area) that covers a portion of Lots 1, 2, 11,
12 and 13. Oil and gas equipment within the 200 -foot limit line has since been plugged,
abandoned and removed. PDC Energy plugged and abandoned the Elder 13-21 well in
December 2016. In Spring of 2017 oil and gas equipment (including tank battery) was
removed from the site. The owners of Lots 1, 2 and 12 of Rangeview Ranches are
applying to amend the Rangeview Ranches plat to remove the 200' foot well limit line.
Per the requirements of Section 23-3-440.L of the Weld County Code, a 25 -foot setback
radius from the abandoned well will be indicated on the resubdivision plat. In my
discussion with Mr. O'Connor, the owners of Lot 13 and Lot 11 did not want to participate
in this application.
THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24-5-40.B of
the Weld County Code.
2. It is the opinion of the Department of Planning Services' Staff that the application has shown
compliance with Section 24-5-30.C of the Weld County Code, as follows:
A. Section 24-5-30.C -- Which the lot line revision complies with the approved recorded final plat.
The revision complies with the approved and recorded S-365 (Rangeview Ranches) plat.
B. Section 24-4-30 - That the lot line revision complies with the adopted rules, regulations and
ordinances currently in force and affecting the subdivision. The lot line revision complies with
existing Weld County codes and regulations in force and affecting the subdivision.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon the following:

13) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in the
country in total market value of agricultural products sold. The rural areas of Weld County
may be open and spacious, but they are intensively used for agriculture. Persons moving
into a rural area must recognize and accept there are drawbacks, including conflicts with
long-standing agricultural practices and a lower level of services than in town. Along with
the drawbacks come the incentives which attract urban dwellers to relocate to rural
areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well -run agricultural activities will generate off -site impacts, including noise from tractors
and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field
work, harvest and gravel roads; odor from animal confinement, silage and manure;
smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting
sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. It is common practice for agricultural
producers to utilize an accumulation of agricultural machinery and supplies to assist in
their agricultural operations. A concentration of miscellaneous agricultural materials often
produces a visual disparity between rural and urban areas of the County. Section 35-3.5-
102, C.R.S., provides that an agricultural operation shall not be found to be a public or
private nuisance if the agricultural operation alleged to be a nuisance employs methods
or practices that are commonly or reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the way"
of residential development. When moving to the County, property owners and residents
must realize they cannot take water from irrigation ditches, lakes, or other structures,
unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of State and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is
based on responses to complaints more than on patrols of the County, and the
distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who
must leave their jobs and families to respond to emergencies. County gravel roads, no
matter how often they are bladed, will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions to
arterials may not be cleared for several days after a major snowstorm. Services in rural
areas, in many cases, will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs and livestock, and open burning present real threats.
Controlling children's activities is important, not only for their safety, but also for the
protection of the farmer's livelihood.
C. The applicant shall submit one (1) paper copy or electronic copy (.pdf) of the plat for preliminary
approval to the Weld County Department of Planning Services
D. The applicant shall create a digital file of all drawings associated with the Resubdivision

The purpose of this submission of a application is to administratively amend the
existing Rangeview Ranches Plat to reduce the "No Build" envelope depicted on the existing
plat on Lot 1, Lot 2, and Lot 12.
Copies of Warranty Deeds, Tax Status and an authorization letter for Lots 1, 2, & 12 are
included as well as a letter form PDC Energy concerning the status of the subject well. The
Owners of lot 1 & 12 signed the application and the owners of Lot 2 submitted an authorization
for Edward OConnor (Lot 12 owner) to act in their behalf on this matter.
A copy of the original Rangeview Ranches Plat is included
The amended Plat drawing is not completed as of this date but will be forwarded to the
Commission as soon as it is completed to be included in this request. 1 am anticipating

Environmental Health Services has reviewed this proposal requesting a Resubdivision

The three lots are served by Central Weld Water District and individual permitted septic
systems. Septic permit SP -9600384 is approved for 26100 Rangeview Drive, septic
permit SP -9500396 is approved for 26037 Rangeview Drive and septic permit SP -
9600066 is approved for 26139 Rangeview Drive.
The Department recommends that the following appear as notes on the resubdivision
plat:
1. Water service may be obtained from Central Weld Water District.
2. This parcel is not served by a municipal sanitary sewer system. Sewage
disposal shall be by septic systems designed in accordance with the regulations
of the Colorado Department of Public Health and Environment, Water Quality
Control Division and the Weld County Code in effect at the time of construction,
repair, replacement, or modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which
shall not contribute to compaction of the soil or to structural loading detrimental
to the structural integrity or capability of the component to function as designed.
4. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County

A percolation test was performed and it was determined that the system must be
designed by an engineer. Mr. Scneider has contacted an engineer and is waiting
for the design to be completed. However he would like his. building permit
released in advance of obtaining the septic permit so construction can begin
construction of his home. He is aware that this may cost an additional $ 35.00,
and that he may have to wait several days for the permit. He is also aware that
a septic permit must be obtained and that the septic system must pass final
inspection to receive a Certificate of Occupancy for the home. I am agreeable
to the building permit being released prior to the septic permit being issued.

Gentlemen,
This is to certify that 1 inspected the installation and construction of this
sewage disposal system on February 20, 1996. I find that the system was in-
stalled in accordance with the design dated October 12, 1995.
A 1000 gallon septic tank was installed. The bed area was over -excavated to
6-1/2 feet below the surface and relaced with 4 feet of suitable soil. A
standard leach field was then installed with a total percolation area of 960
SF. The attached sketch was prepared by the installer.

LOCATION: In the Southwest Quarter of Section 21, Township 5 North, Range
64 West of the 6th:P,M., Weld County, Colorado...,Adjoins South
side of Kersey, Colorado on Weld County Road 53.
GENERAL: Application was made to the Weld County Health Department under
the above permits. Percolation tests and soils data were taken
October 10, 1995. The evaluation shows a sandy material exists
which percolates at the rate of less than 5 minutes/inch. This
rate is too fast for "suitable soil" of 4 foot of depth and per-
colation rates of 5 m.p.i to 60 m.,p.i.
The 'engineered -design" of a sewage disposal system for this
site is to replace the "open" soil from 2-1/2 to 6-1/2 feet be-
low the surface with a suitable soil and construct a standard
30" absorption bed above the new material.
The suitable soil may be newly imported or a mix of the sandy
material with loam and/or clay materials to slow the percolation
rate to about 10 m.p.i. Percentage of materials to be determined
when imported material is determined. -Re-testing of percolation
rates should be done after first bed is in place to verify actual
rate.

Gentlemen,
This is to certify that I ` inspected the installation and construction of this
sewage disposal system on June 19, 1996. I find that the system was installed
in accordance with the design dated October 12, 1995.
A 1000 nallon septic tank was installed. The bed area was over -excavated to
6-1/2 feet below the surface and replaced with 4 feet of suitable soil. A
standard leach field was then installed with a total percolation area of 918
SE, which exceeds the 800 SF required for the 3 -bedroom home. The attached
sketch was prepared by the installer.
