Dear Lauren: Here are our plans for attending to the following Weld County Public Health & Environment considerations for the above referenced USR application: Noise Varra Companies, Inc. does not plan to establish plant processing operations at this location. Most raw materials will be conveyed to an existing plant location via an established conveyor system located in the northwest corner of the project area. The direction of extraction is away and then down from surrounding residential properties. These residences, predominantly to the center and north of the permit boundary, are also well situated an additional 400 feet or greater from the access road located along the east boundary line of the permit, subsequently reducing potential concerns respective of any on -site generated noise from occasional pit run hauling. Odor Odor abatement is not considered a potential concern since Asphalt and Concrete Plant operations are not planned at this location. The applicant will work with Weld County to keep the unlikely potential for any odors emanating as a result of our operations from adversely affecting area residents. Waste (continued - next page-•) No hazardous waste will be stored at this location. Trash will be contained and disposed of in metal containers with lids, commonly 30 gal. in size, and removed from the location by Ram Waste Systems, 5704 Bueno Drive, Ft. Collins, CO 80525. 1 Dust Dust (a.k.a., air borne particulate matter) is in general managed under an approved Fugitive Dust Plan (CDH Permit 14WE1413F. Water trucks are utilized to suppress access generated dust on our haul roads. Haul trucks are moving moist material as part of extraction. Semi and tandem trucks will cover product leaving the site. All traffic generated dust is further minimized by keeping speeds to posted 15 mph or less. Use of structural fill or other suitable on -site generated materials over the native ground will further serve to reduce dust either from traffic or wind. Operations from extraction will increasingly be below ground, and plant generated dust further protected by winds and vectoring by generated product stockpiles. Water & Sanitation Bottled water will be utilized on -site along with port -o -let sanitary facilities in the parcel center within the Mineral Reserve Area. The issuance of this permit does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37-90-137 (2) and (11) on the condition that this well (gravel pit pond) is operated in accordance with the Varra Companies, Inc., Augmentation Plan approved by the Division 1 Water Court in case no. 2003CW306, which includes the Bearson Pit, Division of Reclamation, Mining & Safety ("DRMS") Permit Number M-2015-033. If this well is not operated in accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water. 4) This well is subject to administration by the Division Engineer in accordance with applicable decrees, statutes, rules, and regulations. 5) The use of ground water for the Bearson Pit, in addition to pond evaporation and dewatering at a rate of 5 MGD is limited to dust suppression and water lost with the mined product. 6) The combined average annual amount of ground water to be appropriated at the Bearson Pit shall not exceed 302.9 acre-feet, consumed by the uses described above under Condition No. 5, with the total surface area of the ground water pond(s) limited to 100 acres, or the amounts covered under a water court approved plan for augmentation or substitute water supply plan approved by the State Engineer, whichever is less. No other use of water is allowed unless a permit therefor is approved. 7) The owner shall mark the well (gravel pit pond) in a conspicuous place with well permit number(s) and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 8) A totalizing flow meter must be installed so as to measure any pumping from this gravel pit pond and maintained in good working order. Permanent records of all diversions from the gravel pit pond, tonage of mined product, and the surface area of ground water exposure shall be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 9) Pursuant to Rule 9.3.3 of the Water Well Construction Rules, ground water ponds and gravel pit wells are exempt from the minimum well construction and location standards except for contamination considerations as stated in the Rule. The owner shall take necessary means and precautions to prevent contaminants from entering the ground water pond or gravel pit well. 10) Pursuant to Rule 17.1.5 of the Water Well Construction Rules, the owner shall submit, after initiation of construction, site plan and cross section drawings showing the extent of intended excavation, the maximum depth of the pit or pond, the initial static water level, and the date of initial ground water exposure to the atmosphere. 11) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well, completed in the same aquifer, that is not owned by the applicant, excluding those wells whose owners were notified pursuant to CRS 37-90-137(2)(b)(II)(A).
