WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public hearing held on the 10th day of July, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption number 326, being the property of Fort Collins Orthopedic Association, described as the Northeast Quarter (NEQ) of Section 4 , Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: The Northeast Quarter (NM) of Section 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado except parcels of land as conveyed by deeds recorded in Book 211, Page 83, and in Book 218, Page 75, Weld County Records. Said tercel of land contains 145 acres, more or less including County Road rights-of-way as indicated on the attached plat and is'subject to any other rights-of-way or easements as recorded by instruments of record or as now existing on said described parcel of land. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove described parcel of land owned by Fort Collins Orthopedic Association, be and 780778 hereby is, exempt from the definition of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. Collopy and Douglas M. Murray , trustees of Fort Collins Orthopedic Association . for a recorded exemption. The parcel of land on which this request has been made is described as the NE* of Section 4 , T6N, R67W of the 6th p.m. , Weld County, Colorado. The property contains 145 acres of Class II , III , and IV irrigated soils. The request is to split the property into parcels of 4.078 acres and 141. 0 acres. This property is located two miles north of Windsor. As indicated by Dr. Collopy in a letter dated May 24 , 1978, this property is owned by the Fort Collins Orthopedic Associates profit sharing fund, and will be farmed by Mr. Otto Blehm who lives in the area. Mr. Blehm also farms Dr. Collopy's personal farm and resides thereon , with his residence furnished. Mr. Blehm has no use therefore for the buildings on the 4. 078 acre parcel . It is Dr. Collopy ' s belief that the property would best be handled by making a sale of the 4.078 acre parcel and the two residences to an owner who will reside on the property, take personal pride in its appearance , and maintain it properly. There are no improvements located on the 141 acre parcel . Based upon the information submitted and the adopted policies in the county, tk Department of Planning Services staff recommends the request be approved for the following reasons : 1. The proposed split conforms with the intent clause of the Recorded Exemption procedure (Section 9-2 of the Weld County Subdivision Regul- ations) , the intent clause of the Agriculture Zone District (Section 3. 3A of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the use would be compatible with the surrounding agricultural uses. As a requirement for this sale , I have agreed in writing to remove all of the debris from the property , to tear down and remove all small dilapidated buildings , to trim the trees , and to appropriately fence and gravel the premises .
