Box 2038 Greeley, CO 80632 Phone: (970) 475-2400 Court Use Only IN THE MATTER OF THE MILLIKEN FIRE PROTECTION DISTRICT Case No. 63 CV 15512 Division: NOTICE OF HEARING ON PETITION AND PLAN FOR DISSOLUTION PUBLIC NOTICE IS HEREBY GIVEN that there were filed with the Weld County District Colorado, a Petition and Plan for Dissolution of the Milliken Fire Protection District ("District") and related documents for the dissolution of the District. NOTICE IS FURTHER GIVEN that the Court has set a hearing on the question of dissolution, which hearing is to be held on June 1, 2017, at 8:45 a.m., in Courtroom 1, at the Weld County Courthouse, 901 9th Ave., Greeley, Colorado. The purpose of the Court hearing shall be to consider the sufficiency of the Petition and Plan for Dissolution ("Petition") and the adequacy of the applicable financial and service provisions of the Intergovernmental Services and Pre-Inclusion/Dissolution Agreement entered into between the District, Johnstown Fire Protection District ("Johnstown") and the Front Range Fire Rescue Authority ("Agreement"), regarding the continuation of the District's services and disposition of the District's assets. The Agreement and Petition are available for inspection at the Court. Pursuant to § 32-1-702(3)(c), the Agreement at ¶ 5.6 provides the plan for dissolution based on the outstanding bond of the District and provides that the District will designate certain Directors who will remain in office for purposes of discharging the outstanding bonded indebtedness. Pursuant to § 32-1-702(4)(b)(I), the Agreement at ¶ 5.7 provides that Johnstown will 1 continue to provide fire protection and rescue services to the District service area. The Agreement and Petition denote that all property located within the boundaries of the District will be included within the boundaries of Johnstown, upon approval of the eligible electors of the District. The existing services of the District will be provided by Johnstown. All assets and easements of the District will be transferred to Johnstown. In accordance with the procedures set forth in Part 7, Article 1, Title 32, C.R.S., any interested party may appear at the hearing and be heard on the sufficiency of the Petition for Dissolution or on the adequacy of the applicable financial and service provisions of the Agreement and Plan for Dissolution.
