The property is currently occupied by two homes, which are in turn occupied by members of an extended family. The property is currently constrained by the terms of a Zoning Permit for a Second Single Family Dwelling issued in 2015. Terms 3,4, and 5 of that permit all constrain the owners from renting either home. One of the current dwellings is occupied by an older couple who wish to sell and downsize, as they feel they can no longer contribute to the maintenance of the property. These terms are potentially negatively affecting the resale, even to the other party, who may need the rental income for one of the homes to be able to effect a purchase. We wish to obtain permission to be able to rent either of the other homes to non - family. 2. This request is consistent with Weld County Code, Chapter 22 as it is does not involve changing the fundamental use of the land. The acreage is being used a small ranchette, and such use is intended to continue. When this property was purchased, one of the home was being rented and no such restrictions on that activity were divulged to the buyers. As such, it was always assumed that at some point one or the other of the parties might need rental income in order to remain on the property. The current restrictions arose when improvements were made to one of the homes, in conjunction with the attendant construction permitting process. At this point both pre-existing homes have undergone substantial improvements and there is no intent to create any further homes on the property, or to change its basic use. 3. This request is consistent with Weld County Code, Chapter 23 for the same reasons stated in the response to number 2 above. 4. The property is boundaried by similar properties. The 20 acres to the south is owned by the owners of this property and is currently used as an extension of the ranchette. There is a small dairy located on the other side of CR 55, about 1/2 -mile from this property. This is hard to estimate, as it is just family use — perhaps six vehicle trips per day in and out of the property. Both of the houses on the property are there, the most recent being built in the early 1980s. The change proposed in this request involves no movement of dirt, no changes in contours, no addition or subtraction of retention ponds, no proposed additional structures, and no impact to the the irrigation ditch that borders the north property line. There is no proposed addition of roadways or other access points to the property. The two homes on the property are currently occupied by two families and the proposed change would not alter that. Therefore, there is no anticipation of an increased amount of traffic coming on or off the property, nor any other anticipated traffic -related changes. Per code section 23-12-30 F.1(a) (8) there is no increase to the imperviousness of the site. The requested variance only involves the ability for one of the home to be occupied by someone other than a family member or caretaker. The property itself is a flat acreage surrounded by other flat acreages. What slight grade there is would run from West to East. In a heavy rain water can accumulate in the region of the Quonset hut, where it appears the water table is a bit closer to the surface. A french drain and sump pump have been placed in that area to move the water eastward toward the area used as pasture, as needed. The Bailey Lateral Ditch runs on the north side of the property from the west to the east. Other than the irrigation ditch which is actually not on the property, we are not aware of any water actually running through or off of the property going in any direction.
