HomeMy WebLinkAbout790437.tiff RESOLUTION RE: APPROVAL OF EXEMPTION FROM SUPPLEMENTARY REGULATIONS CON- CERNING GEOLOGIC HAZARDS - JAKE BORUNDA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jake Borunda has applied to the Board of County Commissioners of Weld County, Colorado for a recorded exemption concerning the following described property: That part of the Southwest Quarter of Sec- tion 24, Township 2 North, Range 68 West of the 6th P.M. , County of Weld, State of Colorado, described as follows: Commencing at the Southwest corner of said Section 24, running thence East 1640 feet along the South line of said Section 24 to the TRUE POINT OF BEGINNING; thence North perpendicular to said South line a distance of 1320 feet; thence East parallel with said South line a distance of 330 feet; thence South perpendicular to said South line a distance of 1320 feet to a point of said South line; thence West 330 feet along said South line to the TRUE POINT OF BEGINNING. The abovedescribed parcel contains a gross acreage of 10 . 0 acres more or less . The abovedescribed parcel is subject to a 30 . 00 foot wide reservation for County Road along the Southerly side thereof. WHEREAS, Mr. Borunda has submitted maps showing the loca- tion of Lots A and B in relation to the Geologic Hazard Area, and WHEREAS, the Geologic Hazard Area overlaps Lot A. Said Lot A contains a residence and the regulations concern only future structures, and WHEREAS, Mr. Borunda has requested an exemption from the supplementary regulations concerning Geologic Hazards , and WHEREAS, the Department of Planning Services has recom- mended that said request be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the request of Jake Borunda for an exemption from the supplementary regulations con- cerning Geologic Hazards be, and hereby is , approved provided 790437 that the applicant amends the recorded exemption plat to show the Geologic Hazard Area on the Vicinity Map prior to recording the plat. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 6th day of June, A.D. , 1979 . G Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE : Weld County Supplementary Regulations Concerning Geologic Hazards Dear Couuuissioners : The attached plat , letters and maps are in reference to a request by Mr. Jake Borunda for exemption from the Weld County Supplementary Regulations Concerning Geologic Hazards . The property may be des- cribed as Pt . SW4 Section 24, T2N, R68W of the 6th P. M. , Weld County, Colorado . The property is located 1/2 mile west of the Town of Firestone on Weld County Road 18 . Mr. Borunda has applied to the Board of County Coumiissioners for a recorded exemption to split a 10 acre parcel into two 5 . 0 acre parcels . Lot .A contains a residence. Mr. Borunda wishes to sell Lot A and build a new residence on Lot B. Mr. Borunda has submitted maps showing the location of Lots A and B in relation to the Geologic Hazard Area. From the maps it is clear that the Geologic Hazard Area overlaps Lot A. However , Lot A already contains a residence and the regulations concern only future structures . Mr. Dave Shelton, Engineering Geologist , Colorado Geological Survey, has submitted a letter describing his investiga- tion of the hazard. The Colorado Geological Survey feels that a very reasonable margin of safety exists between the mine shaft and the eastern lot of the subdivision and that they have no objections to this request for a recorded exemption. a ,IL Board of County Commissioners Page 2 June 6, 1979 Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons : 1. The applicant has adequately demonstrated that the location of Lot B is nct within the Geologic Hazard Area. 2 . While Lot A is located within the Geologic Hazard Area, the structure i.s existing and the regulations do not govern existing structures . 3 . The Colorado Geological Survey has no objection to this request for exemption from the Geologic Hazard Regulations . The Department of Planning Services ' approval is conditional upon the applicant amending the recorded exemption plat to show the Geologic Hazard Area on the Vicinity Map prior to recording the plat. Based on the information we were able to find concerning the coal mines in the area, we believe that there is no reason to deny this application. We understand that the western lot which is closer to the mining already has a structure on the southern end of it. The western side of the eastern lot is approximately 250 ft from the nearest known mining. This mining consists of a shaft called the Evan Jones and there is no report of any production from this shaft. The Davies, misspelled on our maps as Davis, is reported to have had 30,000 tons of production. The only maps located which show these mines were on microfilm obtained from the U.S. Bureau of Mines. Although the data are poor we feel a very reasonable margin of safety exists between the reported Evan Jones shaft and the eastern lot of the subdivision.
