Arvada, CO 80002 303-424-6262 www,hillpot.com AGREEMENT BETWEEN HILL INDUSTRIES LLC AND WELD COUNTY FOR THE EARLY RELEASE OF BUILDING PERMIT NIN17-0023 THIS AGREEMENT ("Agreement") is made and entered into this / 7 day of 2017, by the County of Weld, State of Colorado, acting through the Weld County Department of Planning Services (collectively referred to as the "County"), and Hill Industries LLC ("Applicant") whose address is 6301 Ralston Road, Arvada, CO 80004. RECITALS WHEREAS, the Applicant is the owner of real property described as Lots A and B of RE -t58; being part of the NE4 SW4 Section 4, T5N, R65W ("Property") and WHEREAS, the Applicant has applied for A Change of Zone from I-3 (Industrial) to C-3 (Business Commercial) (COZ17-0004) and an Amendment to Site Plan Review PR -210 and SPR- 250 to include a new building for a maintenance shop for the truck fleet located on the site (SPR1 6- 0010]; and WHEREAS, the Department. of Planning Services accepted the land use application for CO 17-0004 and PR 16-OO 10 on March 6, 2017 and July 13, 2016, and WHEREAS, , the Weld County Planning Commission will reviewed COZ17-0004 on May 16, 2017, and forward its recommendation to the Board of County Commissioners, and WHEREAS, the Weld County Board of County Commission reviewed CO I7-0004 on June 14, 2017, and WHEREAS, a standard condition of the Change of Zone and Site Plan Review is that no building or electrical permits may be issued on the property until the Change of Zone and Site Plan Review maps is ready to be recorded in the office of the Weld County Clerk and Recorder, and WHEREAS, the Applicant, has applied for a building permit to install a core & shell - 2,750 sf structural steel commercial building on slab under building permit number CMl 17, 0023, and WHEREAS, the Applicant is requesting that building permit Cl' N17-0023 be issued prior to submittal of the Co 17x0004 and. PR 16-OO 1 O maps for recording. NOW, THEREFORE, in consideration of the foregoing, the County consents to the release of building permit CMN 17-0 023 and in exchange, the Applicant agrees to comply with the following terms and conditions: Page 1 of 3 1. The above recitals are incorporated herein by reference as though set forth herein verbatim. 2. The Applicant shall obtain the necessary building permits and approvals from the Weld County Department of Building Services prior to commencing work. 3. Staging of parking trucks on the travel lanes of the public roads adjacent to the Property is prohibited. Nuisance conditions, including, but not limited to, mud and puddles on roads, are to be prevented and immediately addressed by the Applicant, at the Applicant's expense, to the County's reasonable satisfaction. 4. The p' . plicant shall be responsible, at the Applicant's sole expense, for dust controlling, excavating, repairing, or patching any damage resulting from ingress or egress from the Property to adjacent roadways. The County shall be consulted prior to any work being p � conducted on any County road. The type and method of repair will be determined by County using commercially reasonable standards and must be performed and completed to the County's reasonable satisfaction. 5. The Applicant shall be responsible, at the Applicant's sole expense, for obtaining a Grading Permit prior to commencement of earthwork greater than one (1) acre. 6. County permission given to the Applicant through this Agreement to occupy the Property is for the sole limited purpose of installing a core & shell — 2,750 sf structural steel commercial building on slab per building permit number CI` I 17-OO23. 7, Building permit C 17-0023 shall not be finaled until the conditions of approval have been completed and the map has been submitted for recording. 8. In the event CO 17-0004 is not a roved b , the Board of County Commissioners (B000 or the final mph ,} is not submitted for recording within one hundred and. twenty (120) da s of the BOCC hearing for COZ17-0004 this MMrcemwit shall terminate and the A. plicant shall have thirty (30) days to remove all buildings, equipments and im rovements of any kind that do not conform to the Weld County Code and to return the Pro erg to the condition it was inprior to the execution of this Agreement. As new land uses evolve, established and associated infrastructures are allowed to continue to operate without adding excessive constraints. With the economic growth, the land use policies should be structured to encourage economic prosperity and growth. They are proving the agricultural community with fuel, lubricants, antifreeze, oils and propane. This is helping both them and the Ag community thrive for a better tomorrow. Urban development is characterized as a designated space for retail, residence, offices and other uses that are primarily located near major roadways. This location is located on HWY 263 and less than a mile from Highway 85. These urban development areas rely on a mix or commercial, industrial, residential and civic land uses to increase the growth and prosperity of the area. This company is a filling station that sells fuel and lubricants to the general public and to the agricultural community as well. They have accounts with Ag businesses as well as trucking, excavating and other companies alike, bulk fuel sales, as well as the general public. UD Goal 1 urban development nodes: This land is located 2300' from the intersection of Highway 85 and Highway 263 and 1000' east of this development node. Lawns and landscaping require soils on which turf and ornamental trees and shrubs can be established and maintained. Golf fairways are subject to heavy foot traffic and some light vehicular traffic. Cutting or filling may be required. The ratings are based on the use of soil material at the site, which may have been altered by some land smoothing. Irrigation may or may not be needed and is not a criterion in rating. The ratings are based on the soil properties that affect plant growth and trafficability after vegetation is established. In planning for lawns, landscaping, or golf fairways, onsite assessment of the height, duration, intensity, and frequency of flooding is essential. The ratings are both verbal and numerical. Rating class terms indicate the extent to which the soils are limited by all of the soil features that affect the specified use. "Not limited" indicates that the soil has features that are very favorable for the specified use. Good performance and very low maintenance can be expected. "Somewhat limited" indicates that the soil has features that are moderately favorable for the specified use. The limitations can be overcome or minimized by special planning, design, or installation. Description: Unpaved local roads and streets are those roads and streets that carry traffic year round but have a graded surface of local soil material or aggregate. The roads and streets consist of (1) the underlying local soil material, either cut or fill, which is called "the sub -grade"; (2) the surface, which may be the same as the subgrade or may have aggrate such as crushed limestone added. They are graded to shed water, and conventional drainage measures are provided. These roads and streets are built mainly from the soil at the site. Soil interpretations for local roads and streets are used as a tool in evaluating soil suitability and identifying soil limitations for the practice. Soil properties and qualities that affect local roads and streets are those that influence the ease of excavation and grading and the traffic -supporting capacity. The surface layer of most soils is generally preferred for topsoil because of its content of organic matter. Organic matter greatly increases the absorption and retention of moisture and nutrients for plant growth. The upper 40 inches of a soil is evaluated for use as topsoil. Also evaluated is the reclamation potential of the borrow area. Normal compaction, minor processing, and other standard construction practices are assumed. The soils are rated "good," "fair," or "poor" as potential sources of topsoil.
