HomeMy WebLinkAbout20170317RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 30, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 30, 2017, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer (Clerk's Note: Commissioner Conway arrived at 9:05 a.m.) Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of January 25, 2017, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on January 25, 2017, as follows: 1) USR16-0035 — Otto and Karen Luhrs. Commissioner Kirkmeyer seconded the motion, which carried unanimously. El AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • PUBLIC INPUT: No public input was given. BIDS: El 1) APPROVE BID #B1700026, TANDEM AXLE TRUCKS (QTY. 5) - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, stated staff is requesting an extension of the approval for an additional week. Commissioner Kirkmeyer moved to continue said matter to February 6, 2017. The motion was seconded by Commissioner Conway, and it carried unanimously. O@/ 13/00 7 Minutes, January 30, 2017 Page 1 2017-0317 BC0016 2) PRESENT BID #B1700038, TRAFFIC AND PAINT BEADS - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek presented the eight bids (8) received and stated staff will bring back a recommendation on February 13, 2017. OLD BUSINESS: 1) CONSIDER APPLICATION OF TAPPIST MUNKS, LLC, DBA OUTWORLD BREWING, FOR BREW PUB LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN (CON'T FROM 11/28/16): Frank Haug, Assistant County Attorney, reviewed the application, presented slides and stated there are no concerns. There are no concerns from the Sheriff's Office, or other staff, the only concern currently is with the parking lot. Mr. Haug stated the applicant has plans to expand in the future but the issues with the parking lot will need to be cleared up before that can occur. Mr. Haug explained in order to be compliant they will need to obtain a Certificate of Occupancy and the Retail Food License. a Brian Fuller, applicant, agreed with Mr. Haug about the process of the application and he stated the establishment will not open until late April or May. a In response to Commissioner Kirkmeyer, Mr. Haug proposed conditional language to state: "this shall be contingent upon successful issuance of a Certificate of Occupancy and Retail Food Establishment License." Commissioner Kirkmeyer moved to amend the resolution, which was, seconded by Commissioner Moreno, and the motion carried unanimously. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the application and authorize Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. NEW BUSINESS: • 1) CONSIDER CONTRACT ID #926 MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN - IT'S MY VERY OWN: Judy Griego, Director of Human Services Department, presented the memorandum of understanding with It's My Very Own, which provides bags that contain age appropriate toys and items for children who have been displaced from their homes. The new agreement has a rental fee for the space which the County will be reimbursing. Commissioner Conway stated there is a new owner and they will be reimbursed for renting space in at the Fort Lupton Family Resource Center. Commissioner Conway moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. • 2) CONSIDER CONTRACT ID #951 2017 ANNUAL PROGRAM PLAN FOR CHILD SUPPORT SERVICES (CSS) AND AUTHORIZE DIRECTOR OF THE DEPARTMENT OF HUMAN SERVICES TO SIGN: Ms. Griego reviewed the terms of the annual program plan for child support. Commissioner Kirkmeyer moved to approve said 2017 Annual Program Plan and authorize the Director of the Department of Human Services to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. • 3) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR THE PAYMENT OF FEDERAL MINERAL LEASE FUNDS FOR VARIOUS ROAD IMPROVEMENT PROJECTS AND AUTHORIZE CHAIR TO SIGN: Don Warden, Director of Budget and Finance, reviewed the details of the Intergovernmental Agreement to receive Federal Mineral Lease Funding and stated this and the following item on the Agenda are related. The first agreement is for various County Road projects as listed on Exhibit A for the amount of $1,000,000.00. Commissioner Freeman moved to approve said Intergovernmental Agreement. Seconded by Commissioner Moreno, the motion carried unanimously. El 4) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR THE PAYMENT OF FEDERAL MINERAL LEASE FUNDS FOR WATER TESTING AND AUTHORIZE CHAIR TO SIGN: Mr. Warden Minutes, January 30, 2017 Page 2 2017-0317 BC0016 presented the agreement for the amount of $50,000.00 which will allow a continuance of water testing for residents with water wells in areas of energy development. In response to Commissioner Conway, Mr. Warden stated there are less people every year that request to have their water tested. Commissioner Conway moved to approve said Intergovernmental Agreement and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 5) CONSIDER AFFIRMING WELD COUNTY'S COMMITMENT AND INTENT TO PARTICIPATE IN THE RECOMMENDATION OF TRUSTEES TO THE BOARD OF TRUSTEES OF THE HIGH PLAINS LIBRARY DISTRICT, AND RESCINDING ANY PREVIOUS PURPORTED DELEGATION OF SUCH AUTHORITY: Bob Choate, Assistant County Attorney, stated this is related to the trial that will begin soon concerning the dispute brought by the High Plains Library District. The High Plains District is claiming the County delegated authority to the District in 2005 and 2006 to recommend trustees going forward. The Resolution states there was no such delegation and, if there was, it has been rescinded. He stated this resolution has been approved by all the other defendants, except for the Town of Ault, which is scheduled to approve at a Special Meeting. Commissioner Kirkmeyer moved to approve said Resolution. The motion, which was seconded by Commissioner Freeman, carried unanimously. Commissioner Kirkmeyer thanked Mr. Choate for his hard work on this. Mr. Choate stated the first day of the trial will be February 6, 2017. El 6) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN — MICHAEL PEREZ: Commissioner Conway moved to approve said appointment of Michael Perez, Deputy District Attorney. Seconded by Commissioner Moreno, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
