Weld County staff has received a request from Peter Martz representing ALF Todd Creek
Village North LLC for a refund in their application fees. The applicant submitted a PUD
Change of Zone application in April 2012 and two Service Plans in 2012. Staff set up the
cases and set them out for referral and then was contacted by William Tucker, the
President of ALF Todd Creek Village North ALF LLC in May 2012 to hold in abeyance
the service plans and change of zone applications.
The applicant has paid $1,000.00 in application fees for the service plans and
$106,470.00 in application fees for the Change of Zone.
Options for the board:
1) Refund the applicant 100% of the application fees.
2) Refund the applicant a portion of the application fees minus staff time spent setting up
the cases and time spent on writing referrals.
3) Don't refund any of the application fees.
Recommendation to the board:
Refund the applicant a portion of the application fees minus staff time spent setting up
the cases and time spent on writing referrals.
