EMERGENCY ORDINANCE j -/
ORDINANCE NO. 2-1976
AN ORDINANCE AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS OF WELD
COUNTY, COLORADO, TO ENTER INTO A CONTRACT FOR THE PAYMENT OF MONIES FOR
CD IMPROVEMENTS TO PORTIONS OF COUNTY-OWNED ROADS, AND THE VACATION AND
CONVEYANCE OF PORTIONS OF SUCH ROADS TO THE TON OF PLATTEVITI,F, COLORADO,
A COLORADO MUNICIPAL CORPORATION.
1. WHEREAS, the Town of Platteville, Colorado, has created a Special
Improvement District; and
11 2. WHEREAS, certain portions of said County-owned roads are included
within said Special Improvement District; and
3. WHEREAS, portions of said roads adjacent to the Town of Platteville
are owned by both the entity of Weld County, Colorado, and the entity of
Platteville, Colorado; and
4. WHEREAS, this joint ownership creates difficulty in controlling
,i3 traffic and further creates a problem in the maintenance of said portions
of roads; and
5. WHEREAS, the Town of Platteville has presented an Agreement to the
County relative to apportionment of costs to the County for the improvement
of said portions of County-awned roads, copy of said Agreement, designated
Exhibit A, is attached hereto and made a part hereof by reference; and
6. WHEREAS, the Board of County Commissioners, Weld County, Colorado,
believes it to be in the best interests of the County to enter into said
Agreement with the Town of Platteville relative to paying its fair share
of the costs for the improvements to the County-owned portions of said
roads; and
7. WHEREAS, the Town of Platteville has requested that the County of
Weld transfer and deed to the Town of Platteville those portions of County-
owned roads; and
8. WHEREAS, the Town of Platteville is agreeable that Weld County
transfer by deed to the Town of Platteville those portions of County-owned
roads as shown on Exhibit B attached hereto and made a part hereof by
reference; and
9. WHEREAS, the Town of Platteville further agrees to be responsible
for the safety control on the entire portions of said roads and shall assume
all responsibility for the safety and maintenance of same along said portions
of roads transferred to the Town of Platteville by the County of Weld;
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:
Section I. Authority of Hoard to Contract for Road Improvements.
That the Board be, and it hereby is authorized to enter into an Agreement
with the Town of Platteville relative to improvement of portions of County-
awned roads adjacent to the Town of Platteville, copy of said Agreement,
designated Exhibit A, attached hereto and made a part hereof. LCopies of
said Agreement are available upon request at the Office of the pnard of
County Commissioners, Weld County Health Building, Greeley, Colorado 80631.]

Section II. Authority of Board to Vacate and Transfer Property.
That the Board be, and it hereby is authorized to vacate and transfer
by quitclaim deed to the Town of Platteville, a Colorado municipal corpora-
tion, those portions of County-owned roads

Above referred to and set forth at length hereinbelow a

Description of Parcels:
A tract of land located in Weld County, Colorado, more particu-
larly described as follows:
The West 30 feet of the Southwest Quarter (SA) of the Northwest
Quarter (N4$a) of Section 19, Township 3 North, Range 66 West of
the 6th Principal Meridian, and the West 30 feet of the Northwest
Quarter (NV ) of the Southwest Quarter (S4 ) of Section 19, Town-
ship 3 North, Range 66 West of the 6th Principal Meridian. The
above described tract is the west 30 feet of Division Street
between Highway 66 and Goodrich Avenue adjacent to the Town of
Platteville as it now exists.
A tract of land located in Weld County, Colorado, more particularly
described as follows:
The North 30 feet of the Southwest Quarter (SWa) of the Northwest
Quarter (N't) of Section 18, Township 3 North, Range 66 West of
the 6th Principal Meridian. The above-described tract is the
south 30 feet of Goodrich Avenue between Division Street and River
Street adjacent to the Town of Platteville as it now exists.
A tract of land in Weld County, Colorado, more particularly
described as follows:
The North 30 feet of the West 160 feet of the Southwest Quarter
(SW%) of the Southeast Quarter (SE'r,) and the South 30 feet of the
West 160 feet of the Northwest Quarter (NVAo) of the Southeast
Quarter (SE" ) of Section 18, Township 3 North, Range 66 West of
the 6th Principal Meridian. The above-described tract is that
part of Reynolds Avenue east of Main Street for a distance of
160 feet adjacent to the Town of Platteville as it now exists."
Section III. Effective Date.
Pursuant to Section 3-14(6) of the Weld County Horne Rule Charter,
the Board finds and hereby declares this ordinance to be an emergency
ordinance and that its immediate passage is "necessary to the preserva-
tion or protection of public health, property, or safety," and that time
is of the essence in entering into this Agreement with the Town of Platte-
ville for payment by Weld County of Weld County's share of improvements
to portions of County-awned roads adjacent to the Town of Platteville.
The effective date of this ordinance shall be the date of its enactment.

Section IV. Safety Clause.
The Board finds, determines, and declares that in the event this
ordinance shall be interpreted to be ineffective pursuant to court deter-
mination of the pending case, entitled William S. (Bill) Garnsey, et al vs.
the Board of County Commissioners et al, then in that event the RESOLUTION
authorizing said action shall remain valid and in full force and effect.
