RY. 77 AND THE COUNTY OF WELD AGREEMENT , Made and entered into this 15th. day of June, 1930 , by and between the L; CHICAGO , BURLINGTON & .UINCY RAILROAD COMPANY, a corporation created under the laws of the State of Illinois , hereinafter called the "first party" , and WELD COUNTY, COLORADO , by Wm. k. Carlson, J. S. Ogilvie and :.. Clark, Board of Commissioners of said County, herein- after called the "second party" : 188 WITITESSET H: ( 1 ) TIM , for and in consideration -of the sum of One Dollar ( 1.00) , receipt whereof is hereby acknowledged , and upon the conditions hereinafter' set forth; the first party herein grants unto the second party license to construct , maintain and use a public highway upon the premises of the first party near Krauss , Weld 44ounty, Colorado , described as follows , to-wit : For the use of the right of way on the west side of and not within 15' of the center line of the main railroad track as the same is now located and operated over and across Sec . 28 . -7 As shown in red on blue print attached No .1332-19 , identified by the signature of F. ( 2 ) The Railroad Company reserves unto itself at all times during the term of this license , the right to Ike said premises, or to license the use of said premises , for sewers, water mains, conduits , and other underground construction ( except culverts or bridges to be constructed thereon as a part of said highway) , and also for telephone , telegraph, and power and light transmission wires , and all other kinds of aerial construction , to- gether with the supports therefor , and for all other purposes, including the use of the sur- face of said premises , not inconsistent with the maintenance and use by the second tE rty of said public highway threover. • ( 3) The said highway shall be constructed and maintained by the second party at its sole cost and expense , and the second party shall be charged with all duty and obligaton as to the due and proper construction , maintenance and use of said highway , it being under- stood and agreed that the first party does not warrant its premises to be in a suitable condition for the use herein granted; and that the second party shall release and protect , indemnify and save harmless the first party from all claims , demands, suits , judgments , costs and expenses for loss, damage or injurty to the person or property of any person or persons , whomsoever, in any manner arising from, or growing out of, the construction, maintenance, existende or use of said highway on the said premises of the first party and to whatsoever cause . (4 ) It is further understood and agreed that if at any time in the future any change in the use of its said premises by the first party shall in its judgment make such action necessary, the first party shall have the right , upon six months ' notice in writing to the second party, to terminate this license , and that upon the expiration of said notice period, all the rights and privileges herein granted to the second party shall cease and determine. ( 5 ) This license shall be binding upon the successors or assigns of the parties hereto. WHEREAS , Heretofore and on the twentieth day of November, 1929 , a contract was entered into between the Board of County Commissioners of Weld County, and The Standard Oil Company of Colorado , Inc . , whereby certain rights were granted to said Standard Oil Company of Colorado , Inc . , for the construction of a pipe line along certain highways in Weld County, Colorado , and, WHEREAS , It was provided in said contract that , in the event said pipe lines were not laid within six months from the date of contract , then all rights and privileges granted to said Standard Oil Company of Colorado , Inc. , should cease and terminate and the license granted be- come null and void, and ViEEREAS , said Standard Oil Company of Colorado , Inc . , has not laid said pipe line to this date . THIS AGREEMENT, Made and entered into this 9th day of July, 19: 0, by and between COLORADO-WYOMING GAS COTPANY, A CORPORATION' organized and ekistihk u:ride"r and by virture of the laws of the State of Delaware , of the first part , and THE BOARD OF COUNTY COMMISSIONERS of WELD COUNTY, COLORADO , of the second part , WITNESSETE: V1 REAS , the party of the first part is about to construct a pipe line from a point in Weld County about three ( 3) miles North of the Town of Johnstown , Colorado , thence in a Northerly direction two ( 2) miles to the old GREELEY-LOVELk D HIGHWAY, thence East along said Highway to the City of Greeley, in Weld County, Colorado . AND WEEIEAS , according to the plans and specifications under which said construction is to be made , the party of the first part desires to lay said pipe line , in , under and along and across certain county highways and bridges in the County of Weld. AND WHEREAS , The party of the second part is willing to permit the use of said highways for said pipe line , subject to certain terms and conditions as hereinafter set forth. NOW, THEREFORE , in consideration of the premises and of the covenants and conditions to be by the party of the first part kept and performed as hereinafter set forth, the party of the second part does hereby grant unto the party of the first part a license to lay, construct and maintain _a pipe line in, under and along each and ev.Jry- county highway and bridge crossed or intersected by said pipe line in Weld County, Colorado, as the same appears upon the map or plat attached hereto , made a part hereof by reference and marked Exhibit "A" , the route of line of said pipe line appearing in red thereon. As consideration of the grant of the aforesaid license , party of the first part agrees that said pipe line shall be buried at least three ( 3) feet below the surface of said roads. The party of the first part further agrees that at any time hereafter the grade of any highway or bridge burdened with said pipe line is changed, it will change and relay said pipe line at its own expense to the depth and distance aforesaid. That it will at all times main- tain said pipe line and repair all leaks and damages at its own expense ; and further, that if, by reason of any leak or damage to the pipe line , damage to the road or any bridge is sustained, pa party of the first part will repair and replace the road and bridges in the same condition that the road and bridges were in prior to said leak or break. If at any time any county highway shall be established and constructed, or if at any time any present county highway shall be hereafter widened and such highways shall be affected by said pipe line , then and in such event the party of the first part agrees to relay and re- construct said pipe line to meet with the approval of the County Engineer. The party of the first part further agrees to indemnify and save harmless the county of Weld from any claims or damages arising by reason of the laying or maintenance of said pipe line . It is further agreed that the laying of said pipe line and the maintenance thereof along said county highway and bridges shall be subject to the approval of the County Engineer. It is understood and agreed that this agreement and all the terms and conditions thereof may be assigned by the party of the first part , and upon such assignment each and all of the terms and conditions hereof shall be binding upon such assignee. WHEREAS , The State Game and Fish Commissioner of The state of Colorado has , by agreement with the County Commissioners of Weld County, agreed to advance the sum of One Hundred ($100 .00 ) Dollars, and the County Commissioners have agreed to advance the sum of Two Hundred (0200.00 ) Dollars to the Greeley Chapter, No. 21 of the Isaac Walton League for the purpose of paying a bounty of five ( 5 ) cents a head for the eradication and extermination of magpies in the County of Weld, and, W7 : „ 4,;4rhe Board does now declare the magpies to be a pest , and does hereby determine that said magpies are cuasing depredation upon live stock and poultry in Weld County, Colorado , NOW, THEREFORE, IT IS T ^EBY ORDERED, that Weld county advance and pay the sum of Two Hundred ($200.00 ) Dollars to Greeley Chapter No. 21 , of The Isaac Walton League in co- operation with the State Game and Fish Department , as aforesaid , which sums of money shall be used by said League in payment of bounties not in excess of five cents per head for the killing, extermination and eradication of magpies in Weld County, Colorado . W:.ERal.S , The improvement of County Highways and the reduced costs and increased efficiency of automobiles during the past few years has greatly rer?_uced the expense of travel, . and WHEREAS , Certain County Officers are by statute allowed actual traveling expense fo,r each mile necessarily traveled in__ the performance of their duties not in excess of fifteen cents per mile , and, 1 . WHEREAS , The Board of County Commissioners are of the opinion that the actual: traveling expense of such officers is not in excess of ten cents per mile . NOW , THEREFORE, BE IT RESOLVED, That on and after August 1, 1930, the mileage expense allowed to the Sheriff, County Assessor, County Superintendent of Schools , County Coroner, Members of the Board of County Commissioners and all other County Officers and their deputies and assistants under the statutes shall be audited and paid at the rate of ten cents per mile for each mile actually and necessarily traveled by such officers in . the performance of their duties . The Lessor reserves the right to take possession of all or any portion of the leased premises whenever the use thereof may become necessary of expedient , in the judgment of the Lessor, for railroad purposes , including the location of public or private warehouses, elevators or other structures with the design to facilitate and promote traffic , or for, or in connection with, drilling for or mining of oil , gas, coal or other minerals of whatsoever nature underlying the leased premises by the Lessor or by others with its permission; PROVIDED, however, that in the event the Lessor elects to take possession of all or any portion of the leased preriees in accordance with this reservation, it shall first serve upon the Lessee ninety ( 90) days' written notice of such election. 4. The Lessor reserves the right to cross the leased premises with such railroad tracks as may be required for its convenience or purposes in such manner as not unreasonably to interfere with their use as a public highway. In the event the Lessor shall place tracks upon the leased pre~dses in accordance with this reservation, it shall, upon completion of such tracks, restore the highway across the same to its former state of usefulness. b. The Lessee shall not use the leased premises or permit them to be used except for the usual and ordinary purposes of a street or highway, and it is expressly understood. and agreed that such purposes shall not be deemed to include the use by the Lessee , or by others, of the leased premises for railroad or traction purposes or for the construction or maintenance of electric power transmission lines. e . This lease is subject to all outstanding superior rights ( including those in favor of telegraph and telephone companies , and leases to abutting property owners and others) and the right of renewals and extensions of the same ; and it is understood that nothing in this lease contained shall be construed as a covenant to put the Lessee into possession or to protect the Lessee in the peaceable possession of said premises. 7. No special assessments for establishing or improving the highway located upon the leased premises are to be made against the adjacent railroad right of way of the Lessor, and the Lessee agrees to protect the Lessor against and save it harmless from such special assessments. 8. For the purpose of protecting the reversionary interests of the Lessor against the assertion of adverse rights, the Lessee agrees to prevent encroachments upon the leased premises , and to this end will, at its own expense , take all necessary action , including as far as practicable the building of its ditches on and the borrowine of earth from the outer margin of said leased premises. H : 'I}L RSAS , a written agreement dated July b , 1927 was , on or about that date , entered into by and between the parties hereto ( the said party of the second part being therein designated by the name "The County of Weld, in the State of Colorado" and also by the designation "Industry" ) , which said agreement provided for the construction of a certain spur track for the use of the Industry in or near the City of Greeley, in said 'held County; and to cover the cost of which the Industry deposited the sum of '1141.47, with the Railway Company; and 'WHER_IPLS , said agreement contained the following provision, appearing therein as paragraph (3 ) of Article II , with reference to the repayment of said sum, or a part thereof, to the Industry by the Railway- Company, to-wit: "( 3) To repay to the Industry the actual cost of the construction of that portion of said trackage shown by the red line or lines on said Exhibit A, at the rate of two (, 2.00) dollars per car of freight shipped in or out , to or from the Industry, over said trackage from which a revenue of not less than fifteen (i;15.00) dollars per car, other than switching charges , is derived by the Railway Company , during the period of two ( 2) years from the date of the completion of said trackage , unless the aggregate amount of such repayments , at the rate aforesaid, shall sooner equal the amount to be thus repaid to the Industry , whereupon such payments shall cease ; settlements covering such payments shall be made semi- annually, and the amounts thereof shall be determined by means of statements to be furnished by the Industry to the General Auditor of the Railway Company and verified by said General auditor, containing such information as may be required by said General Auditor in order to determine the amounts of such repayments; provided that in the event a sufficient number of cars, at the rate afore-said, shall not be shipped in or out over said trackage during said period, to permit the repayment of the cost of the construction of said portion thereof, the balance shall be retained by the Railway Company without recourse by the Industry. The termination of this agreement before the expiration of said period shall not give the Industry any right of reimbursement for any balance advanced but not than repaid in the manner hereinbefore provided."
