A public hearing was conducted on April 26, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman - EXCUSED Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Stephanie Frederick Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle The following business was transacted: I hereby certify that pursuant to a notice dated January 20, 2017, and duly published January 25, 2017, in the Greeley Tribune, a public hearing was conducted on March 8, 2017, to consider the request of Bramming Family Trust and John G. Bramming Trust II, c/o Mary Alice Bramming, Trustee, c/o Hunt Brothers Properties, Inc./ Asphalt Specialties Co., Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR16-0041, for a Mineral Resource Development Facilities including an Asphalt Batch Plant; Asphalt and Concrete Recycling Operations; any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (heavy equipment maintenance shop, administrative office building, quality control lab, liquid asphalt storage, company fueling station and outdoor truck and equipment parking, staging and storage and raw and processed material storage when screened from public rights -of -way and adjacent properties) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. (USR16-0041) PAGE 2 deemed it appropriate to continue the matter to March 22, 2017, and again to April 26, 2017, to allow Asphalt Specialties Co. Inc., adequate time to meet with the FRICO Ditch Company and schedule a community meeting with the neighbors. Bob Choate, Assistant County Attorney, made this a matter of record. • Kim Ogle, Department of Planning Services, stated the applicant conducted an Open House on April 19, 2017, to hear the surrounding neighbors' concerns, and now the applicant would like to have additional time to address the concerns and issues with the Farmers Reservoir and Irrigation Company (FRICO). El Rob Laird, representative of Asphalt Specialties Company, Inc., read a letter requesting a continuance to allow more time, in order to fully address the concerns from the surrounding neighbors as well as host an additional open house to present to the neighbors how their concerns were addressed. He expressed the importance of being a good corporate neighbor. Mr. Laird would like the citizens to know Asphalt Specialties Company, Inc., takes pride in being a family owned and operated business and they plan to be a responsible neighbor. • In response to Chair Cozad, Mr. Laird stated continuing the hearing to August 2, 2017, would give them enough time to conduct another meeting and address the concerns. • No public testimony was offered concerning this matter. • Commissioner Kirkmeyer suggested contacting the Kirkmeyer family to request use of their property to hold the future neighborhood meetings. She asked Mr. Laird to explain what concerns FRICO ditch has. • Mr. Laird stated they are working with FRICO to change the design of the ditch and have submitted some initial designs for the crossing over Bull Canal. El Chair Cozad thanked him for working with the neighbors • Commissioner Conway expressed his appreciation of Mr. Laird wanting to work with the neighbors. Mr. Laird stated this is a long-term commitment for the company and it is important to work with the neighbors. Commissioner Conway moved to approve the request to continue a Site Specific Development Plan and Use by Special Review Permit, USR16-0041, for Mineral Resource Development Facilities including an Asphalt Batch Plant; Asphalt and Concrete Recycling Operations; any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (heavy equipment maintenance shop, administrative office building, quality control lab, liquid asphalt storage, company fueling station and outdoor truck and equipment parking, staging and storage and raw and processed material storage when 2017-1027 PL2460 HEARING CERTIFICATION - BRAMMING FAMILY TRUST AND JOHN G. There being no further discussion, the hearing was completed at 10:14 a.m. This Certification was approved on the 1st day of May, 2017.
