CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(4) and the findings of the State Engineer dated March 24, 2017.
4) The use of ground water from this well is limited to commercial and irrigation.
5) The pumping rate of this well shall not exceed 15 GPM.
6) The average annual amount of ground water to be withdrawn shall not exceed 26.3 acre-feet.
7) Production is limited to the Laramie -Fox Hills aquifer which is located approximately 640 feet below land surface and
extends to a depth of approximately 995 feet. Plain casing must be installed and grouted to prevent the withdrawal of
ground water from other aquifers and the movement of ground water between aquifers. (NOTE: If coals and/or
carbonaceous shales are encountered in the borehole, plain casing and grout should be installed through these intervals
to exclude poor quality water from entering the well.) SEE CONDITION 16 BELOW.
8) The entire length of the hole shall be geophysically logged as required by Rule 9 of the Statewide Nontributary Ground
Water Rules prior to installing casing.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
11) This well shall be constructed more than 600 feet from any existing well, completed in the same aquifer, that is not owned
by the applicant.
12) This well shall be constructed not more than 200 feet from the location specified on this permit.
13) Pursuant to CRS 37-90-137(9)(b) and the Denver Basin Rules, no more than 98% of the nontributary ground water
withdrawn annually shall be consumed and the well owner shall demonstrate to the reasonable satisfaction of the State
Engineer that no more than 98% of the water withdrawn will be consumed.
14) This well is subject to administration by the Division Engineer in accordance with applicable decrees, statutes, rules, and
regulations.

15) Issuance of this permit hereby cancels permit no. 304501.
16) Pursuant to Construction Rule 6.2.2.1 (2 CCR 402-2), licensed or private drillers and pump installers, or authorized
individuals must provide advanced notification (at least 24 hours) to the State Engineer prior to each of the following for this
well: well construction, the initial installation of the pump, and installation of a cistern connected to the water well supply
system. Information regarding the notification process and a link to the electronic notification form can be found on the

NOTE: The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than
the 100 years upon which the amount of water in the aquifer is allocated, due to anticipated water level declines.
NOTE: To ensure a maximum productive life of this well, perforated casing should be set through the entire producing
interval of the approved zone or aquifer indicated above.
NOTE: This permit will expire on the expiration date unless the well is constructed and a pump is installed by that date. A
Well Construction and Yield Estimate Report (GWS-31) and Pump Installation and Production Equipment Test Report
(GWS-32) must be submitted to the Division of Water Resources to verify the well has been constructed and the pump has
been installed. A one-time extension of the expiration date may be available. Contact the DWR for additional information or
refer to the extension request form (GWS-64) available at: http://www.water.state.co.us

three (3) single family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the
irrigation of not more than one (1) acre of home gardens and lawns.
5) Production is limited to the Laramie -Fox Hills aquifer which is located approximately 640 feet below land surface and

non -evaporative type where the water is returned to the same stream system in which the well is located.

interval of the approved zone or aquifer indicated above.

RE: Water Well Application for Lot B, Recorded Exemption No. 1469-33-4 RECX16-0076
Dear Ms. Williams,
I have never heard Mtn. View Water Users Association referred to as a district. It is a group of people that
share a water system. It was formed approximately 60 years ago to server the local residents. At that time 3
wells were drilled, bylaws were created, and 128 certificates were sold. Each certificate represented one
residential water tap to one property. Over the years some certificates have been sold or transferred when a
house was torn down, burned, or the user had found another water source. These transfers have been few and
are rare. No new certificates have been created since the beginning of the association. The property in
question was divided off and the current owners have not been successful in acquiring one of the 128
certificates in existence. Central Weld Waters system does not come far enough south and Thornton water is
not far enough north to service the property. And due to our bylaws we are not able to serve water to any
property or house that does not have a certificate. l see the property owners really have no other option but to
drill a well. Mtn. View Water Users Association's only concern with the issuing of any well permit would be if
this would impact the production, or quality of one of our existing wells. The property in question is over 5/8 of a
mile away from our closest well and your agency would have a greater understanding of ground water,
adjacent wells, and water rights. We have seen several wells drilled at closer proximity in recent years and
have never been ask for our input in the past. So this request does seem a little odd. That being said we don't
see any reason to deny this applicant based on anything we see in the application or from any other
information that we have.

There are no employees at this bldg during the day. They come and get the trucks and leave until
quitting time. At times our contract mechanic will come to do some mechanic work. Seldom.
There is a bathroom hooked to a septic tank that we are unable to find a permit for. The seller of the
property had the water hooked up to the bldg since it's construction and we have an agreement to pay
the water bill for her mother in the house behind the garage in exchange for the very small amount of
water to occasionally flush the toilet. The water comes from her tap with water service district (mtn
view water users association,?)
We understand from Kim that no other bldgs will be approved until we have a dedicated water supply.

Mr. Walker,
Thank you for your response. For the permitting of the property Weld County has concerns with
the ability to permit all of the uses on the property without evidence that there is adequate
water. The RV Storage facility may be permitted utilizing a port a let and bottled water for
drinking with the landscape component utilizing a water wagon.
The future flex buildings, similar to the existing building to be used for any number of small
business has no evidence of water and should be removed from the application request. In the
future, should you have a permitted commercial water well or have obtained a commercial water
tap, then an amendment to the RV Storage permit may be submitted.
Please amend your narrative accordingly.

Kim,
We are going to go with porta potty and we can bring in water for drinking. Our trees will be watered
from water wagon to establish. Can we proceed with approvals based on that info.
Longer term we have contracted with Crandall drilling to drill a water well that will provide water for
future if we want to switch to that. I don't have firm start date for drilling at this time but will provide it
as soon as I have it. It appears that I may be 90 days or more.

By way of introduction I am a land use planner with Weld County who is in the process
of reviewing an application for completeness. As part of the review I am to determine
adequacy of water for a proposed RV Storage, Parking and Staging, enclosed self -
storage units and for the parking and staging of trash containers, roll -offs and vehicles
or equipment to pick up and deliver same, located on land described as Lot B,
Recorded Exemption No. 1469-33-4 RECX16-0076 being a part of the W2 SE4 Section
33, Township 1 North, Range 67 West.
Additionally the applicant is requesting to construct small workspace buildings that
would consist of a work space, small office and lavatory. .The statement in the
application states:
"The future flex buildings would be similar to the existing building with similar
construction and uses. The building would be used for any number of small business
needing a commercial/industrial use away from dense residential housing. The uses
wou Id be consistent with zoning and use restrictions placed on the development.
Weld County Environmental Health requires evidence of water for all land use
applications. For this application the applicant has identified Mountain View Water
Users as the water source. The application materials indicate that the water associated
for the business(es) is via a shared tap that has been plumbed to support the residence
and an outbuilding, with future development options to include the flex buildings..
"There is no water available at Mountain View water. We bid at auction for two taps
and were told they were sold to existing owners who have first right of refusal on all
tap sales. The building was supplied by the tap to the house and we have an
agreement to pay monthly bill from the house which was split off before our purchase
of the large parcel."
Given these statements, is it the policy of Mountain View Water Users to allow the use
of a single tap for two different uses? Per the applicant's layout plan the residence
and the outbuilding(s) both existing (1) and future buildings (4) are not on the same
parcel.

Good afternoon,
Mountain View Water is for domestic purposes only not for commercial use. Also
per bylaws there is only one house per tap. There are a few users that provide
water for farm animals. Should a tap holder want to use the water for
commercial a special request must be brought to the board for consideration.

Given the response received from MVWUA and the apparent lack of water for the
property, the Department of Public Health and Environment via Planning Services
is requesting that the application be reworked as to the proposed uses and also to
address what will be the water supply for the property. Both for potable water
and for fire suppression if required by the Fire Department. You may submit your
