RESOLUTION
RE: APPROVAL OF ADDENDUM TO INTERGOVERNMENTAL AGREEMENT BETWEEN
WELD COUNTY AND THE CITY OF FORT LUPTON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an addendum to intergovernmental agreement between
Weld County and the City of Fort Lupton has been presented to
the Board of County Commissioners in which Weld County's con-
tribution towards the paving of Weld County Road 14 (also known
as 9th Street in Fort Lupton) was increased to $32,000 .00 , and
WHEREAS, the Board of County Commissioners deems it advi-
sable to approve said addendum.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the addendum to the
intergovernmental agreement between Weld County and the City of
Fort Lupton be, and hereby is, approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 16th day of
July, A.D. , 1979 .

ADDENDUM TO INTERGOVERNMENTAL AGREEMENT
THIS ADDENDUM made this 16th day of July ,
1979 between WELD COUNTY, a body corporate and politic and a
subdivision of the State of Colorado and the CITY OF FORT LUPTON.
WHEREAS, a certain Agreement entitled Intergovernmental
Agreement was entered into between the parties hereof on the
third day of January, 1979 , under which Weld County and the
City of Fort Lupton desire to have a portion of Weld County Road
14 (also known as 9th Street in Fort Lupton) paved, and thereafter
having said road annexed to the City of Fort Lupton, and
WHEREAS, the parties hereto wish to amend such Intergovern-
mental Agreement.
NOW, THEREFORE, that Agreement, dated January 3 , 1979 and
entered into between Weld County and the City of Fort Lupton,
is hereby modified, altered and changed in the following respects
only:
By eliminating and striking out from said Agreement para-
graph 6 on and inserting in its place the following paragraph:
6) Weld County shall reimburse Fort Lupton for
the cost of only the asphalt surface lying
within Weld County, not to exceed a total
cost of $32,000 . Should the expected cost
of this asphalt surface, as shown by the
bids received for the project, exceed
$32 ,000 , then Fort Lupton and Weld County
shall re-negotiate the amount that Weld
County is to reimburse Fort Lupton. Should
the parties be unable to reach an agreement
as to the amount of Weld County' s share
within 45 days of the bids having been opened,
then this contract shall terminate without
further action or notice by either party.
IN WITNESS WHEREOF, the parties hereto have hereunto exe-
cuted this Addendum and have hereunto set their hands and seals
