The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Special Review Permit, USR17-0050 for a
greater than 12 -inch high pressure natural gas pipeline approximately 7 miles long (20 inch natural gas
pipeline originating at the Godfrey Compressor Station (USR'11-0005) and terminating at the Mewbourn
Gas Plant (5MJUSR17-83-0542) in the A (Agricultural) Zone District
This project is along multiple parcels
ACCESS
An Access Permit is required for locations that need to be accessed during or after construction. Please
work with Public Works to determine if construction of your pipeline requires an access permit or if access
will be addressed through a right-of-way permit.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying
out your site plan to ensure the approved accesses are compatible with your layout.
For new accesses and/or change of use of an existing access, the fee and photos are required (photo
looking left and right along roadway from the access point and looking in to and out of the access point).
These photos are used to evaluate the safety of the access location. Access permit instructions and
application can be found at https://www.weldgov.com/departments/public works/permits/. Chapter 6,
Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria offer access design
guidance, which can be accessed at: https://www.weldgov.com/departments/public works/engineering/.
For shared accesses, Public Works strongly recommends the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road. This is not a requirement, but is recommended to avoid property owner
conflicts in the future.
Per Chapter 12, Appendix 12A.4.1 of the Weld County Code, an access approach that is gated shall be
designed so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface
be less than 35 feet.

County Road 38 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a(n) local road, which requires 60 feet of right-of-way. The applicant shall delineate
on the site map or plat the future and existing right-of-way and the physical location of the road. If the right-
of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County
Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained
by Weld County.
County Road 35 on the southern portion of the pipeline is a gravel road and is designated on the Weld
County Functional Classification Map (Code Ordinance 2017-01) as a(n) collector road, which requires 80
feet of right-of-way. The applicant shall delineate on the site map or plat the future and existing right-of-way
and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant
to the definition of setback in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required
setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered
in the right-of-way. This road is maintained by Weld County.

County Code, Chapter 23, Article III, Section 23.3-50, the required setback is measured from the future
right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is
maintained by Weld County.
County Road 46 is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a(n) collector road, which requires 80 feet of right-of-way. The applicant shall
delineate on the site map or plat the future and existing right-of-way and the physical location of the road.
If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld

This portion of County Road 33 is under the jurisdiction of the City or Town (municipality) of Evans. The
municipality has jurisdiction over access to the road. Please contact the municipality to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
Pipelines crossing a county road shall obtain a Right -of -Way Permit and possibly a Special Transport
Permit. Pipelines crossing county roads shall be bored, unless otherwise approved by Public Works.
Any pipeline crossing an arterial road, such as Weld County Road 49 shall be bored with a minimum
crossing depth of 10 feet below the lowest roadside ditch flowline elevation for all lines, except for oil and
gas lines whose minimum depth will be 15 feet below the lowest roadside ditch flowline elevation.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRACKING CONTROL POLICY
Per Chapter 12, Appendix 12A.10.1, traffic volumes to the proposed facility may require the installation of
a tracking control device and/or a minimum of four inches of compacted recycled asphalt or aggregate road
base. Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards
are listed below. Tracking control devices must maintain drainage from the site and along roadside ditches.
Temporary tracking control shall be used during construction unless permanent tracking control is installed
ahead of construction activities.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Public Works may require an Improvements Agreement for one or all the following reasons:
• Off -Site Public Improvements
• Road Maintenance Agreement
• Construction Maintenance Agreement
• Access Improvements Agreement
An Improvements Agreement is required for sites with required offsite improvements per Chapter 12, Article
V, Section 12-5-60. Collateral is required to ensure the improvements are completed, and maintained.
Improvements/Road Maintenance Agreement: An example agreement is available at:

eview/sprusr.pdf. It will detail the approved haul route(s), outline when offsite improvements will be
triggered, and include a maintenance agreement for the haul routes. Possible mitigations included in the
road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage
repairs, and future improvement triggers.
CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this
location. Road maintenance including, but not limited to dust control, tracking control, damage repair,
specified haul routes and future traffic triggers for improvements will be included. (Department of Public

B. The plan shall be amended to delineate the following:
1. County Road 38 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge
of right-of-way. This road is maintained by Weld County. (Department of Public Works)
2. County Road 40 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge

8. If required, show and label the approved access(es) (APXX-XXXXX), and the appropriate turning
radii (60") on the site plan. (Department of Public Works)
9. Show the approved Municipality of Evans access(es) on the site plan and label with the approved
access permit number if applicable. (Department of Public Works)
10. Show and label the entrance gate if applicable. An access approach that is gated shall be designed

that may access the site from the Department of Public Works Permitting/Inspection agent.

3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

Drainage Requirements:

Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets exception 1.a.5 for pipelines.
Grading Permit
If more than 1 acre is to be disturbed for construction of non -pipeline items such as structures, parking lots,
laydown yards etc..., a Weld County grading permit will be required prior to the start of construction. Grading
Permit applications are accepted after the planning process is complete (plan recorded). An Early Release
Request Form may be entertained only after the applicant and Planning Department have reviewed the
referral and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:

Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.

Environmental Health Services has reviewed this proposal for a site Specific
Development Plan and Special Review Permit for a greater than 12 -inch high pressure
natural gas pipeline approximately 7 miles long (20 inch natural gas pipeline originating
at the Godfrey Compressor Station (USRI 1-0005) and terminating at the Mewbourn
Gas Plant (5MJUSR17-83-0542) in the A (Agricultural) Zone District
Permanent water and sewer is not required as this request is a temporary construction
use. Portable toilets and bottled water can be utilized during construction of the
pipeline. As the amount of disturbed area exceeds 25 acres an Air Pollution Emission
Notice (APEN) is required.
We have no objections to the proposal; however, we do recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. Fugitive dust and fugitive particulate emissions shall be controlled along the
construction route. Uses on the property should comply with the Colorado Air
Quality Commission's air quality regulations.

Emissions Permit Application and obtain a permit from the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as
applicable.
6. Adequate toilet facilities and handwashing units shall be provided during

be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.

I wish to submit the following information regarding the above referenced project.
The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal. FRICO requires a minimum of 25' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment. The boundaries of the Right of Way must be agreed upon.
Drainage is another concern that must be addressed as FRICO does not allow any
developed storm flow into our canals. This will apply if any development happens.
Property concerns need to be resolved.

This letter is being sent by Anadarko Petroleum Corporation on behalf of its subsidiaries
Kerr-McGee Oil & Gas Onshore LP ("KMG") and Kerr-McGee Gathering LL ("KMGG") in
response to USR17-0049 and LISR17-0050 (together the `Project"). KMG is the owner of valid
oil and gas leases underlying numerous parts of the Project ("Leased Lands") and KMGG is the
owner of numerous existing pipelines along or in close proximity to the proposed Project route.
KMGG and KMG (together the "Anadarko entities") are submitting this comment timely, in
accordance with State of Colorado and the County ' s procedural requirements.
KMG's recorded oil and gas leases are real property interests entitling it to produce oil and gas
from the Leased Lands (and, as may be applicable, adjacent lands). KMG has the right to utilize
the Leased Lands to produce from existing wells, to maintain, rework, recomplete, and fracture
those existing wells to enhance production, and to drill new wells to produce oil and gas, in
accordance with applicable Colorado Oil and Gas Conservation Commission regulations and
Colorado Statutes. KMG's oil and gas assets have significant value, and KMG is consequently
concerned about any development, surface use, plan of use, PUD, zoning or rezoning, or other
action by the County that would impair or preclude its ability to develop its oil and gas interests.
The Anadarko entities do not object to the Project contingent upon the resolution of the
following two issues:
1. KMGG is the owner of a valid Right -of -Way Grant that was executed on July 27m,
1992, and recorded on June 3011, 1995 with the Weld County Clerk and Recorder
at reception number 2444883. Referenced Right -of -Way Grant is an exclusive
easement located in the 5/2 of 4N -66W-35. The Applicant is wishing to cross this
easement in order to enter Parcel # 105735400002, which is owned by the
Applicant. KMGG will grant DCP Midstream LP a Crossing Agreement once an
exact crossing location is provided.
2. The Applicant's route is encroaching on one of the State's prescribed drilling
window located in the center of the SW/4 of the SW/4 of 4N -66W-13, Parcel tt
105713300066. The Applicant is working with the surface owner, Barbara
Hungenberg, to move their initial centerline 45' to the east to avoid the conflict
with said drilling window. The amended route is depicted on the revised Exhibit B:
Tract A-009 executed October 2 t `, 2017, and attached hereto. The route
adjustment will allow KMG to access their mineral interests from the drilling
window.

FRAC OUT CONTINGENCY PLAN
FOR DIRECTIONAL / HORIZONTAL DRILLING
Introduction and Purpose
Directional bore operations have a potential to release drilling fluids into the native
surface environment through frac-outs. A frac-out is the condition where drilling mud is
released through fractured ground and travels toward the surface. Because drilling muds
consist largely of bentonite clay -water mixture, they are not classified as toxic or
hazardous substances.
While drilling fluid seepage associated with a frac-out is most likely to occur near the
bore entry and exit points where the drill head is shallow, fracaouts can occur in any
location along a directional bore. This Frac-Out Contingency Plan FP) establishes
operational procedures and responsibilities for the prevention, containment and clean-up
of frac-outs associated with the proposed directional drilling utility project.
Jomax Construction and Sub -Contractors responsible for the work must adhere to this
plan during the directional drilling process.
The specific objectives of the plan are to:
1. Minimize the potential for a frac-out associated with the drilling activities.
2. Provide for the timely detection of frac-outs.
3. Protect the environmentally sensitive riverbed and associated riparian vegetation.
4. Ensure an organized, timely and minimum -impact response in the event of a frac-
out and release of drilling bentonite.
Description of Work
The proposed project consists of: (Explain work task in detail to crew members.)
Drilling operations will be hatted by the drill rig operator immediately upon detection of
a drop in drilling pressure or other evidence of a frac-out. The clean-up of all spills shall
begin immediately. A vacuum truck and containment materials, such as straw bales, shall
also be on -site prior to and during all operations. The Site Supervisor will be immediately
notified. In the event of a f'rac-out, the foreman/supervisor will conduct an evaluation of

the situation and direct recommended mitigation actions, based on the following
guidelines.
I. If the frac-out is minor, easily contained, has not reached the surface and is not
threatening sensitive resources, drilling operations may resume.
2. If the frac-out has reached the surface, it will be contained and properly disposed
of at an approved disposal facility or properly recycled in an approved manner.
The Site Supervisor shall notify and take any necessary follow-up response
actions. The Site Supervisor will coordinate the mobilization of equipment stored
at off -site locations (e.g., vacuum trucks) on an as needed basis.
Site Supervisor/Foreman Responsibilities
The Site Supervisor/Foreman has overall responsibility for implementing this FMCP. The
Site supervisor' la oreman will ensure that all employees are trained prior to all drilling.
The Site supervisor/Foreman shall be notified immediately when a frac-out is detected.
The Site Supervisor/Foreman will be responsible for response, cleanup, notification and
coordination to ensure proper clean-up and disposal of recovered material.
The Site Supervisor/Foreman shall be familiar with all aspects of the drilling activity, the
contents of the Frac-Out Contingency plan and the conditions of approval under which
the activity is permitted to take place. The Site Supervisor/Foreman shall have the
authority to stop work and commit the resources (personnel and equipment) necessary to
implement this plan. The Site Supervisor/Foreman shall assure that a copy of this plan is
available (on site) and accessible to all construction personnel. The Site
Supervisor/Foreman shall ensure that all workers are properly trained and familiar with
the necessary procedures for response to a ac -out, prior to commencement of drilling
operations.
Equipment
The Site supervisor shall ensure that:
l . All equipment and vehicles are checked and maintained daily to prevent leaks of
hazardous materials.
2. Spill kits and spill containment materials are available on site at all times and that
the equipment is in good working order.
3. Equipment required to contain and clean up a frac-out release will either be
available at the work site or readily available at an offsite location within 30
minutes of the bore site.
Training
Prior to the start of construction the site supervisor/Foreman shall ensure that the crew
members receive training in the following:
1. The provisions of the Frac-Out Contingency Plan, equipment maintenance and
site specific permit and monitoring requirements.
2. Inspection procedures for release prevention and containment equipment and
materials.
3. Contractor/crew obligation to immediately stop the drilling operation upon first
evidence of the occurrence of a frac-out.
4. Contractor/crew member responsibilities in the event of a release.
5. Operation of release preventions and control equipment and the location of
release control material, as necessary and appropriate.
Drilling Procedures
The following procedures shall be followed each day prior to the start of work. The Frac
Out Contingency Plan shall be available on site during all construction. The Site
Supervisor/Foreman shalt be on site at any time that drilling is occurring or is planned to
occur. The Site SupervisonToreman shall ensure that a job briefing meeting is held at the
start of each day of drilling to review the appropriate procedures to be followed in case of
a fracnout. Questions shall be answered and clarification given on any point over which
the drilling crew or other project staff has concerns.
Drilling pressures shall be closely monitored so they do not exceed those needed to
penetrate the formation. Pressure levels shall be monitored randomly by the operator.
Pressure levels shall be set at a minimum level to prevent frac-outs. During the pilot bore,
maintain the drilled annulus. Cutters and reamers will be pulled back into previously
drilled sections.
Exit and entry pits shall be enclosed by dirt berms if necessary. A vacuum truck shall be
readily available on site prior to and during all drilling operations. Containment materials
straw waddles, sand bags, etc., shall be staged on site at location where they are readily
available and easily mobilized for immediate use in the event of an accidental release of
drilling mud frac out. If necessary bathers straw bales or silt fences between the bore site
and the edge of the water source shall be constructed prior to drilling to prevent released
bentonite material from reaching the water.
Once the drill rig is in place and drilling begins the drill operator shall stop work
whenever the pressure in the drill rig drops significantly or there is a lack of returns in the
entrance pit. At this time the Site Supervisor/Foreman shall be informed of the potential
frac out. The Site Supervisor/Foreman and the drill rig operator shall work to coordinate
the likely location of the frac out. The following subsections shall be adhered to when
addressing a frac out situation.
Water containing mud, silt bentonite or other pollutants from equipment washing or other
activities shall not be allowed to enter a lake, flowing stream or any other water source.
The bentonite used in the drilling process can be disposed of at an approved manner.
Other construction materials and wastes will be recycled, or disposed of, as required.

Vac Truck
A vacuum truck shall be staged at a location from which it can be mobilized and re-
located so that any place along the drill shot can be reached by the apparatus within ten
minutes of a frac out.
Field Response to Frac-out occurrence
The response of the field crew to a frac out release shall be immediate and in accordance
with procedures identified in this Plan. All appropriate emergency actions that do not
pose additional threats to sensitive resources will be taken as follows:
1. Directional boring will stop immediately.
2. The bore stem will be pulled back to relieve pressure on the frac out.
3. The Site Supervisor/Foreman will be notified to ensure adequate response actions
are taken and notifications made.
4. The Site Supervisor/Foreman shall evaluate the situation and recommend the type
and level of response warranted including the level of notification required.
5. If the frac out has reached the surface a dike or berm may be constructed around
the frac out to entrap released drilling, fluids, if necessary.
6. If a frac out occurs, reaches the surface and becomes widespread, the Site
Supervisor/Foreman shall authorize a readily accessible vacuum truck stored off
site to be mobilized. The vacuum truck may be either positioned at either end of
the line of the drill so that the frac out can be reached by crews so that
contaminated soils can be vacuumed up
Response Close out Procedures
When the release has been contained and cleaned up, response closeout activities will be
conducted at the direction of the site Supervisor/Foreman and shall include the
following:
1. The recovered drilling, fluid will either be recycled or hauled to an approved
facility for disposal. No recovered drilling fluids will be discharged into streams,
storm drains or any other water source.
2. All frac out excavation and clean-up sites will be returned to preeproject contours
3. All containment measures fiber rolls, straw bales, etc. will be removed, unless
otherwise specified by the Site Supervisor/Foreman.
Construction Re -Start
For small releases, drilling may continue, if containment is achieved through the use of a
leak stopping compound or redirection of the bore and the cleaneup crew remains at the
frac out location throughout the construction period.

Bore Abandonment
Abandonment of the bore will only be required when all efforts to control the frac out
within the existing directional bore have failed.
Notification
In the event of a frac out that reaches a water source, the Site Supervisor/Foreman will
notify the safety department so they can notify the appropriate resource agencies. All
agency notifications will occur within 24 hours and proper documentation will be
accomplished in a timely and complete manner.' The following information will be
provided:
1. Name and telephone number of person reporting.
2. Location of the release.
3. Date and time of release.
4. Type and quantity, estimated size of release.
5. How the release occurred.
6. The type of activity that was occurring around the area of the frac out.
7. Description of any sensitive areas and their location in relation to the frac out.
8. Description of the methods used to clean up or secure the site.
Communicating with Regulatory Agency Personnel
All employees and subcontractors will adhere to the following protocols when permitting
Regulatory Agency Personnel arrive on site. Regulatory Agency Personnel will be
required to comply with appropriate safety rules. Only the Site Supervisor Foreman and
the safety department are to coordinate communication with the Regulatory Agency
Personnel.

All materials and any rubbish construction debris shall be removed from the construction
zone at the end of each work day. Sump pits at bore entry and exits will be filled and
returned to natural grade. All protective measures fiber rolls, straw bale, silt fence, etc.

whether any conflicting infrastructure exists. Potholing is utilized to further identify any such utilities prior
to the commencement of boring.
Bores arc typically 1.5 times the installed pipeline diameter. Slurry will be used to remove spoils and fill
voids. The slurry will remain in place to reduce the possibility of settling. All spoils will be removed by a
vac -truck. Bore profiles are taken throughout the process to determine actual placement of the pipeline.
DCP requires that frac-outs be immediately contained \\ith a vac unit and proper traffic control measure
will be taken to insure public safety. In the event a tool is lost in the bore, recovery options will be
discussed with COOT official to determine the safest and best option for recovery.
