RE: APPROVE APPLICATION TO THE PUBLIC UTILITIES COMMISSION FOR
IMPROVEMENTS TO RAILROAD CROSSING AT COUNTY ROAD 49 AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application to the Public Utilities
Commission (PUC) related to certain safety improvements to be constructed to the Union Pacific
Railroad Crossing (NTC #805-243D) at County Road 49, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Application to the Public Utilities Commission be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of May, A.D., 2017.

SUBJECT: Public Utilities Commission Application for Union
Pacific Railroad Crossing near CR 54 and CR 49
Please place the attached application on the BOCC Agenda.
The BOCC approved the pass -around request and a work session to put this on the BOCC agenda on •
May 1, 2017. This application needs to be made to the Colorado Public Utilities Commission so the
Union Pacific Railroad (UPRR) can complete the final crossing design and schedule construction for the
railroad crossing of CR 49 just north of CR 54.
UPRR is aware the crossing has been listed as exempt by the PUC due to the fact that there are no trains
on the line at this time. It is anticipated the final design and construction will include the extension of the
concrete panels and the installation of conduits for a future crossing signal. No signaling equipment is
anticipated to be installed as part of the CR 49 Corridor project. UPRR has provided an estimate of
$102,638 to complete this work. The work is anticipated to happen between August and October, 2017.
IHC has included the cost of the work in their bid. IHC is responsible for the reimbursement through the
design -build contract.
I will plan on attending the BOCC hearing to answer any questions that the Board may have regarding
this agreement.

Brief description of the problem/issue:
In order to complete the CR 49 corridor, the project has to cross the Union Pacific Railroad just north of CR 54.
UPRR has provided a cost estimate for the installation of the new exempt crossing just north of CR 54. The
estimate provided by UPRR is $102,638. IHC will be responsible for paying all costs associated with the
crossing. However, UPRR will not enter into the agreement with IHC. The agreement has to be with Weld
County since the road is ultimately ours to maintain.
UPRR is aware the crossing has been listed as exempt by the PUC due to the fact that there are no trains on the
line at this time. The estimate includes the extension of the concrete panels through the width of CR 49 and the
relocation of the signaling equipment. It is anticipated the design will include plumbing the crossing for future
signals but no signaling equipment will be placed.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
1. Approve the PUC application so it can be submitted to the PUC for their approval and UPRR can
schedule the construction activities as soon as possible.
2. Do not sign the PUC application.

The Weld County Board of County Commissioners, hereinafter referred to as the County, hereby submits
this application to the Public Utilities Commission, hereinafter referred to as PUC, for an order authorizing
the replacement of existing crossing material with a longer segment of concrete crossing material to allow
for roadway widening, removal of existing active warning railroad flashing -light signals, and installation
of new cross bucks with "EXEMPT" signs at the crossing of Weld County Road 49 and the tracks of the
Union Pacific Railroad Company, hereinafter referred to as UPRR, National Inventory Crossing ID No.
805-243D, at UPRR milepost 145.19, in Weld County, Colorado.
Note that this crossing was the subject of previous Docket No. 16A -0040R and subsequent Decision No.
C 16-0206, dated March 9, 2016, requesting and receiving authority to install "EXEMPT" signing on the
existing active warning railroad flashing -light signals. This application seeks to maintain the "EXEMPT'
signing relocated onto new cross bucks, as part of this request to remove the active warning railroad
flashing -light signals at the crossing.
The following information is provided, as required by 4 CCR 723-7:7204(c):

(V) The U.S. Department of Transportation designation of the crossing is #805-243D. The
crossing location is further described as UPRR Mile Post 145.19 in Weld County,
Colorado. Weld County does not use mile post referencing.
(VI) Weld County is improving a twenty -mile portion of Weld County Road 49, which includes
widening the roadway at this crossing. Widening of the roadway necessitates the placement
of additional crossing material at the track crossing. Because the track at this location is
currently inactive, Weld County proposes to remove the active warning railroad flashing -
light signals, rather than relocate them, and install new cross buck signs with "EXEMPT"
signing.
(VII) The average daily vehicular traffic count (ADT) at the crossing is 6,500 in 2014 and a speed
of 65 miles per hour. There are no train movements at the crossing location.
(VIII) Statement of work of the project:
The crossing at this location currently has active crossing warning devices consisting of
railroad flashing -light signals (active), advance warning signs and pavement markings. The
existing crossing material is bituminous pavement and is approximately 28 linear feet. As
a result of the roadway widening, the County's project proposes to install 104 linear feet
of concrete crossing material. The widened portion of the roadway will be to the geographic
west of the existing roadway. The County's project proposes to remove the existing active
warning railroad flashing -light signals at the crossing, and replace with new cross bucks,
relocating the current RI 5-3P "EXEMPT" signing from the active warning devices to the
cross buck posts. The County will be responsible for construction zone traffic control
during the period of roadway widening, equipment removal, and sign installation. The
County will continue to maintain, at its expense, the roadway approaches to the crossing.
The County has received an estimate from UPRR for $102,638.00 to remove the existing
crossing material and install new concrete crossing material. This estimate is attached as
Exhibit D. Within that correspondence UPRR indicated that removal of the existing
railroad flashing -light signals and replacement with new cross bucks will cost $20,000.
That correspondence is also attached as part of Exhibit D.
The County will provide for 100% of the cost.
(IX) Because the track at this location is currently inactive, Weld County proposes to remove
the existing active warning railroad flashing -light signals, rather than relocate them, and
install new cross buck signs with "EXEMPT" signing in accordance with MUTCD, Section
8B.07. The County will coordinate with UPRR regarding the equipment removal and
relocation of the "EXEMPT' signing from the existing railroad signals to the new cross
buck posts. "EXEMPT" signing would also be added to the W10-1 signs on each approach
to the crossing.
(X) The CR 49 roadway widening project is a design -build contract. Work on the widening
along CR 49 outside of the railroad right-of-way, began in April 2016 and is anticipated to
be complete by December 2017. Work at the UPRR track crossing is scheduled for
completion between July 1, 2017 and December 1, 2017, but will be dependent upon the
schedule of UPRR work forces.

(XII) The following plan exhibits are provided:

Exhibit C — Roadway Signing/Striping Plan
(XIII) A profile of the roadway is included in Exhibit B.
(XIV) No new railroad active warning devices are being installed as part of this project. No
schematic diagram was received from UPRR with the railroad work items cost estimate.
(XV) No interconnection or preemption is a part of this application. Therefore, no signal related
information is provided.

(XVII) The existing crossing is an at -grade crossing of WCR 49 with no train use currently.
Creating a grade separation is not practical, warranted or cost effective for a crossing
with no conflicts (train traffic). A grade separated crossing would require a profile change
of WCR 49 and modification of several property accesses, and to have the tracks go over
WCR 49, would require the adjustment of more than one mile of track for a segment that
currently has no train traffic.
